AN INTERIM ORDINANCE OF THE CITY OF PALM
SPRINGS, CALIFORNIA, TO AMEND SECTION
9209.01.B.2, 9209.01.B.3 AND ADDING
SECTION 9209.01.6.4 OF THE ZONING
ORDINANCE TO ALLOW THE USE OF VENDING
CARTS IN THE CBD ZONE INCLUDING ALLOWANCE
TO LOCATE ON PUBLIC PROPERTY AND
DECLARING THE URGENCY THEREOF.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES ORDAIN AS
FOLLOWS:
SECTION 1. Authority. This ordinance is adopted pursuant to the provision of
Government Code Section 65858.
SECTION 2. Urgency Ordinance - Findings. The City, in conjunction with the
local Main Street Program, has been developing programs intended to promote
the lively pedestrian ambience necessary for the success of the downtown. In
order to implement a vending cart program for this tourist season , it is
necessary to have the enabling zoning ordinance provisions in place prior to
the time a normal zoning ordinance amendment could be promulgated. Therefore
the City Council declares it to be urgent that this ordinance become effective
immediately.
SECTION 3. Section 9209.01 .B.2 is hereby amended to read as follows:
2. Outdoor uses as an accessory to a permitted main use and located
on the same property as the permitted main use.
a. Art displays
b. Artisans, Artists
C. Car shows
d. Christmas tree Sales not as an accessory use to a main use.
e. Display cases in malls or courts
f. Farmers market
g. Fashion shows
h. Festivals , Exhibits & Special Events
i . Florists
j . Musicians/Entertainment (subject to provisions of noise
ordinance)
k. Outdoor dining including beverage service
1 . Plant and floral sales and displays
M. Postcaro displays (limited to one per store frontage)
n. Theatre and public assembly
0. Vending carts dispensing the following:
1. Food
2. Beverages
3. Crafts
4. Floral items
5. Other uses as determined by the Planning Commission
SECTION 4. Section 9209.01.B.3 is hereby added to read as follows:

on public property including the public right-of-way streets and

SECTION 6. EFFECTIVE DATE. This Ordinance shall be in full force and effect
immediately upon adoption by at least a four-fifths votes of the City Council ,
and shall be of no further force and effect forty-five days from its day of
adoption, except that before 45 days from its day of adoption, the City
Council , after notice pursuant to Government Code Section 65090 and public
nearing, may extend the time this ordinance will be full force and effect for
an additional ten months and fifteen days and subsequently may extend this
ordinance for an additional one year. Any such extension shall also require a
four-fifths vote of the City Council for adoption.
SECTION 7. PUBLICATION. The City Clerk is hereby ordered and directed to
certify to the passage of this Ordinance, and to cause the same or a summary
tnereof or a display advertisement, duly prepared according to law, to be
published in accordance with law.
