AN INTERIM ORDINANCE OF THE CITY OF PALM
SPRINGS, CALIFORNIA, TO ALLOW THE DIRECTOR OF
COMMUNITY DEVELOPMENT TO GRANT A TEMPORARY
SPECIAL PERMIT OR OTHERWISE PERMITTING, SIGNS,
ADVERTISING OR PERTAINING TO ANY CIVIC,
PATRIOTIC OR SPECIAL EVENTS OF GENERAL PUBLIC
INTEREST, AND DECLARING THE URGENCY THEREOF.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1. AUTHORITY. This ordinance is adopted pursuant to the
provisions of Government Code Section 65858 and 36937 .
SECTION 2 . URGENCY ORDINANCE - FINDINGS. The City has received
requests for special signing in conjunction with special events
that is provided for presently under section 9320. 09 A. 5 . GENERAL
PROVISIONS OF THE ZONING ORDINANCE. Because approval of these
signs is usually needed on a very short turn-around time and
because the processing of an application through City Council
requires substantial time in order to be considered on the regular
agenda, City Council finds that a more expedient approval process
is desirable. In addition, the Council finds it is not necessary
for the Council to personally review each such request. There are
new pending requests for special signing, which cannot be
considered by the Council in a timely manner. Therefore, the City
Council declares it to be urgent that this ordinance become
effective immediately upon adoption.
SECTION 3 . Section 9320. 09A of the Zoning Ordinance is hereby
amended to add a new subsection to be numbered 11611 , said subsection
to read as follows:
"SPECIAL PERMITS ALLOWED BY DIRECTOR OF COMMUNITY
DEVELOPMENT. The Director of Community Development shall
have the authority to grant a temporary special permit or
otherwise permitting, on such terms as he may deem
proper, signs advertising or pertaining to any civic,
patriotic or special event of general public interest
held in the City which event is likely to attract
substantial visitors to the community, when it can be
found that such signs will not be materially detrimental
to the public welfare, interest or safety, nor injurious
to adjacent property. Such signs shall only be permitted
prior to and during such events.
SECTION 4 . EFFECTIVE DATE. On January 29 , 1991, the City Council
adopted an interim urgency ordinance (Ordinance No. 1367) adopting
the provisions in Section 3 above for a period of 45 days. Since
the adoption of said ordinance, the City has undertaken various
planning studies which are not yet complete. By adopting this
ordinance, the Council hereby extends the provisions of Ordinance
No. 1367 effective immeidately for a period of 10. 5 months until
January 15, 1992 .
SECTION 5. PUBLICATION. The City Clerk is :hereby ordered and
directed to certify to the! passage of this ordinance, and to cause
the same or a summary thereof or a display advertisement, duly
prepared according to law to be published in accordance with law.
