AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,
ADDING SECTION 11.08.007 TO THE PALM SPRINGS MUNICIPAL
CODE PROHIBITING THE CONSUMPTION OF ALCOHOLIC BEVERAGES
ON HOTEL POOL GROUNDS FROM 11 :00 P.M. UNTIL 6:00 A.M.
THE FOLLOWING DAY DURING EASTER WEEK
WHEREAS, during the periods in which colleges and high schools are
closed immediately preceding and following the Easter holiday, large numbers
of people, primarily college or high school students and persons in the age
groups typical of college and high school students, come to Palm Springs to
participate in activities generally referred to as Easter Week; and
WHEREAS, the people coming to Palm Springs for Easter Week mainly stay
at hotels or motels and gather at the pool areas of these establishments to
celebrate the holiday; and
WHEREAS, incidents of disorderly conduct, excessive noise and drinking
by minors have occurred during previous Easter Week holidays at the pool areas
of hotels and motels housing Easter Week tourists; and
WHEREAS, in order to protect the public peace, safety, health .and welfare,
the City Council finds it necessary to regulate the consumption of alcoholic
beverages at hotel pool areas in an effort to prevent the problems of excessive
drinking and noise during Easter Week.
NOW, THEREFORE, the City Council of the City of Palm Springs does ordain
as follows:
Section 1. Section 11.08.007 is hereby added to the Palm Springs Municipal
Code to read as follows:
11.08.007 Liquor Consumption on Hotel Pool Grounds--Prohibited.
(a) During that period known as Easter week, no person shall drink,
use or consume any alcoholic beverage, as defined in Section 23004 (and
related sections) of the Business and Professions Code of the State
of California, when such person is on a pool deck of a hotel , public
areas surrounding the swimming pools, or area open to public access,
having not less that six (6) dwelling units, from 11:00 P.M. until 6:00
A.M. the following day. This subsection shall riot apply to any hotel
establishment having a retail on-sale or off-sale license issued by
the Department of Alcoholic Beverage Control .
(b) For the purpose of this section, the following definitions
shall apply:
(1) "Easter Week" shall be defined as the period commencing
one week prior to Good Friday and terminal:ing the Monday after
Easter Sunday.
(2) "Hotel " shall be defined as any structure, which is
occupied or intended or designed for use or occupancy by transients,
including but not limited to dwelling, lodging or sleeping purposes,
and includes any hotel , inn, motel , studio hotel , bachelor hotel ,
lodginghouse or roominghouse.
(c) It shall be an infraction for any person to violate any of
the provisions of this section and upon convicl:ion thereof shall be
punished as provided in Section 1.01.155 of the Palm Springs Municipal
Code.

Section 2. PUBLICATION: The City Clerk is hereby ordered and directed
to certify to the passage of this Ordinance, and to cause the same or a summary
thereof or a display advertisement, duly prepared according to law, to be
published in accordance with law.
