AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AMENDING THE ZONING ORDINANCE_
IN REGARD TO MINI-WAREHOUSES, TEMPORARY
SALES TRAILERS, USES AND Id ALL HEIGHT IN
THE R-1 ZONES, RECREATIONAL EQUIPMENT,
AND MISCELLANEOUS USES.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES ORDAIN AS
FOLLOWS:
SECTION 1. Section 9100.10A of the Zoning Ordinance is amended with the
addition of the following:
"138.1 MINI-WAREHOUSE shall Mean a facility designed and operated for
the storage of goods in individual compartments or rooms, which are available
for use by the general public on a rental or lease basis. In no case shalt
storage spaces be used for manufacturing, retail , or wholesale selling,
compounding, office functions, other business or service uses , or human
habitation.
A mini-warehouse shall not include the following facilities;
a) No water, sanitary facilities or electricity, with the
exception of lighting fixtures, shall be provided in individual storage
Spaces, unless otherwise approved by the Planning Commission.
b) Prefabricated shipping containers shall not be used as
mini-warehouse facilities, unless specifically approved by the Planning
Commission.
In addition, the following materials shall not be stored in mini-
warehouses:
a) Flammable or explosive matter or material ;
b) Material which creates obnoxious dust, odor or fumes ; or
c) Hazardous or extremely hazardous waste."
SECTION 2. Section 9201.01C. of the Zoning Ordinance is amended with the
addition of the following:
"3. Temporary on-site sales trailer in conjunction with the sale of
subdivision lots, provided :
a. the total subdivision shall occupy at least 10 acres;
b. the trailer shall not be more than one (1) year old at the
time it is placed and shall be maintained in good order;
C. the final map shall be recorded prior to the placement of
the trailer;
d, the trailer shall be located within the subdivision and not.
closer than twenty-five (25) feet from any property line;
e. the yard between the trailer and any street shall be
adequately landscaped and maintained; and
f. the trailer shall be removed at such time ninety percent;
(90%) of the lots are sold or a model home is constructed but, in any case, no
later than eighteen (18) months from the time the trailer is installed."
SECTION 3. Section 9201.01D. of the Zoning Ordinance is amended with the
addition of the following:

9. The following uses may be allowed by conditional use permit on
parcels which are located within the 'N' Noise Impact and Non-Suit Covenant
Combining Zone and also have frontage along a major thoroughfare as indicated
by the General Plan. The design of the facility and the required parking (per
Section 9306.00 shal 'I be compatible with the surrounding residential area , no
outdoor storge may be allowed, and identification shall be limited to a
single, non-illuminated, sign which shall be no greater than six (6) square
feet in size, and shall face the major thoroughfare.

a. Offices (executive, administrative, professional and
clerical ) , excluding those of building trade contractors.
b. Private clubs.
C. Artist studios, including on-premise galleries.
d. Catering.
e. Community Center building,"
SECTION 4. Section 9201.02A of the Zoning Ordinance is amended to read as
follows:
"Commercial uses, except as provided for by Section 9201.01D.9."
SECTION 5. Section 9201.03D.5. of the Zoning Ordinance is amended to read as
follows :
The provisions of Section 9302.00 shall apply, except that walls and
fences, not exceeding six (6) feet in height, may be installed not less than
fifteen (15) feet from the front property line (or future right-of-way line)
on parcels which have frontage on major thoroughfares as indicated by the
General Plan."
SECTION 6. Section 9209.01A of the Zoning Ordinance is amended with the
addition of the following:
"50. Modeling school , in conjunction with an approved modeling
agency."
SECTION 7. Section 9210.01A. of the Zoning Ordinance is amended with the
addition of the following:
"39. Convenience stores."
SECTION 8. Section 9210.01C. of the Zoning Ordinance is amended with the
addition of the following:
"Drive-through facilities"
SECTION 9. Section 9210.02B. of the Zoning Ordinance is amended by deleting
the following:
"Drive-through facilities"
SECTION 10. Section 9212.01A.7. of the Zoning Ordinance is amended with the
addition of the following:
"Blueprinting and photocopying"
SECTION 11. Section 9213.01A. of the Zoning Ordinance is amended with the
addition of the following:
"ii . Bicycle rental (indoor)"
SECTION 12. Section 9214.01A.6 of the Zoning Ordinance is amended :
a. by deleting the following: "Blueprinting and photocopying."
( indoor) ." b. with the addition of the following: "Bicycle rental
SECTION 13. Section 9217.01D.12 of the Zoning Ordinance is amended to read aS
follows :
"Drive-through and drive-in facilities"
SECTION 14. Section 9222.01 of the Zoning Ordinance is amended to read as
follows :
"A. Uses consistent with the General Plan Land Use Element permitted
subject to approval of a Planned Development District pursuant to Section
9403.00.

B. Uses permitted subject to approval of a Land Use Permit pursuant to
Section 9402.01
1. Agricultural
2. Caretaker' s residence (]1 ,000 sq. ft. max. )
3. Organized off-road vehicle tours
C. Uses permitted subject to approval of a Conditional Use Permit
pursuant to Section 9402.00, when such uses are deemed by both the Commission
and Council to be essential or desirable for the public wel Fare and
convenience and in conformity with the General Plan and its objectives.
1. Temporary governmental facilities
D. Accessory uses customarily incidental to 'those uses permitted, and
to those uses approved as part of a Planned Development District."
SECTION 15. Section 9301 .00F.7. of the Zoning Ordinance is amended to read as
follows:
"Flag poles and poles supporting basketball hoops , and other similar
equipment, not to exceed the height limit allowed in the subject zone may be
allowed in any front yard, setback ten (10) feet from the property fine,
unless otherwise approved by the Planning Commission."
SECTION 16. Section 9306.00D.18. of the Zoning Ordinance is amended to read
ds follows :
"Mini-warehousin , selF-stordgee or dead stora e. A minimum of six (6)
spaces per comp ex; additional parking to be as required by the Planning
Director. Where a caretaker's residence is provided, a minimum of two parking
spaces shall be provided for the exclusive use of such residence in addition
to those required for the mini-warehouse function."
SECTION 17. EFFECTIVE DATE. This Ordinance shall be in full force and effect
thirty (30) days after passage.
SECTION 18. PUBLICATION. The City Clerk is hereby ordered and directed to
certify to the passage of this Ordinance, and to cause the same or a summary
thereof or a display advertisement, duly prepared according to law, to be
published in accordance with law.

adopted by the City Council of the City of Palm Springs, California,
in a meeting held on the 2nd day of January, 1991, and that same was

printed and published in said City on January 8, 1991.
