AN URGENCY ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AMENDING SECTION
5. 40. 010 (d) OF CHAPTER 5.40 OF TITLE
5 OF THE MUNICIPAL CODE TO
DEREGULATE PASSENGER CARRIER FARES
AND TARIFFS .
WHEREAS the City of Palm Springs ("City") currently regulates
fares and tariffs charged by businesses operating passenger
transportation services in the City, particularly taxicab services;
and
WHEREAS fares and tariffs are regulated by the City by
requiring each such passenger carrier to obtain approval of the
City Council for their schedule of fares or tariff; and
WHEREAS updating and revising the regulation of fares and
tariffs is necessary on an immediate basis to properly coordinate
passenger carrier service fares in the City with the partial
decontrol of taxicab services at Palm Springs Regional Airport; and
WHEREAS for the reasons stated in the above Recitals, it is
necessary for the City to amend the Municipal Code to effectively
coordinate and clarify passenger carrier fares and tariffs on an
immediate and urgent basis,
NOW THEREFORE BE IS RESOLVED by the City Council of the City
of Palm Springs that City Council does ordain as follows:
Section 1 . Section 5. 40 . 010 (d) of Chapter 5 . 40 of Title 5 of
the Palm Springs Municipal Code is deleted in its
entirety and replaced with the following:
(d) In any such franchise, license, permit or
contract, or in the conditions of requirements
attached thereto pursuant to subsections (a) and
(b) of this section, the holder thereof may, in the
discretion of the City Council, be required to file
with the City Manager a tariff or schedule of fares
listing any and all fares, charges, fees, prices,
costs and the like which are to be charged to
members of the public during the course of
business. If the City Council requires the holder
to file such tariff or schedule of fares with the
City Manager, the holder shall also file updated
tariffs or schedules of fares as the holder
modifies or revises same. The filing of such
tariff or schedule of fares with the City Manager
shall be for informational purposes and holder who
otherwise satisfies the requirements contained in
this chapter shall not be required to obtain
approval of its tariff or schedule prior to
conducting a passenger carrier operation in the
City.
Section 2 . The City Council finds and determines that, for the
reasons demonstrated in the above Recitals, there
is a current and immediate threat to the public
health, safety and general welfare that requires
this urgency ordinance be enacted as provided
herein.
Section 3 . This ordinance is hereby declared an urgency
measure and shall take effect immediately 'upon its
passage on December 18 , 1990.
Section 4 . The City Clerk of the City of Palm Springs shall
certify to the passage and adoption of this urgency
ordinance and shall cause the same to be posted and
published in the manner required by law.
