AN ORDINANCE OF THE CIT1P OF PALM SPRINGS, CALIFORNIA,
AMENDING CHAPTER 11.34 OF THE PALM SPRINGS
MUNICIPAL CODE TO PARTIALLY DECONTROL TAXICAB
ACCESS TO THE PALM SPRINGS REGIONAL AIRPORT.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES ORDAIN AS
FOLLOWS:
SECTION 1. Section 11.34.060 of the Palm Springs Municipal Code is hereby amended
to read:
.11.34.060. Taxicab,operation of: Taxicab Companies operating under a license
granted by the City of Palm Springs (and designated a franchised company) may pick-up
passengers at the Airport, and only within those areas designated by the Director of
Aviation.
'Taxicab Companies (other than 1r'anchise taxicab companies) after obtaining an
'Airport Use' Taxicab Permit, may fail in line in the franchised taxicab lane and pick-up
persons or passengers without (proof of advanced reservations upon meeting the
following requirements:
'1. At any time there are less than four (4) cars waiting in the franchise cab
loading lanes at the airport; and
-2. Having rates and charges similar to the franchised cab company; and
"3. Each vehicle shall be equipped with an operating, certified taxi meter;
and
-4. Subject to the payment of fees and charges similar to that paid to the
City and Airport by the Franchised Taxicab Company; and
.5. A rate card shall be posted) in each vehicle, in full view of any passenger,
stating the current rages authorized to be charged for taxicab service
within the City of Palm Springs, including any and all surcharges; and
-6. No driver shall be employed who does not have in his possession a valid
State of California license, and a license from the Police Department of
the City of Palm Springs for the operation of a commercial taxicab
vehicle. The license from Police Department shall be displayed in the
taxicab, in full view of any passengers at all times that the driver is
operating the vehicle;
"It will be the responsibility of the driver of the non-franchised cab company,
immediately upon falling into line, to sign in at the Ground Transportation Center as
required under Section 11.34.100 of this Chapter. If the driver does not pickup a person
or passenger at the airport, again,for any reason, it will be the responsibility of the driver
to contact the Ground Transportation Center prior to leaving the airport so that his entry
on the log will be listed as a'no pick up" and the entry will be eradicated from the lag by
the Ground Transportation officer on duty.
"The Director of Aviation may revoke or suspend any permit upon sending, by
certified mail, a written notice of revocation or suspension,whenever a permit holder and
or agent of permit holder has violated any rule, regulation or condition of this section.
SECTION 2. Section 11.34.080 of the Pakn Springs Municipal Code its hereby amended
to read:
.11,34.080 Signs and Insignia. No signs, poster or similar devices shall be
erected, displayed or maintained in view of the general public in the terminal building,
adjacent areas or anywhere on the Airpon property without prior written approval of the
Director of Aviation. The signing utilized on the permittee's vehicles shall be subject to
prior written approval of the Director of Aviation. Under no circumstances shall a charter
party carrier of passengers maintain upon his vehicle any sign or inscription incorporating
the words "taxi,' 'taxicab," or 'cab' regardless of whether or not such words are part of
the corporate or business of the permittee; nor shall such vehicle be equipped with a
"taximeter.' The Director of Aviation expressly reserves the right to approve or disapprove
the exterior decor and signing of the permittee's vehicles except as required by the PUC.
Further,the Director of Aviation shall have the authority to approve or disapprove signage
of meeters and greeters as to its appropriateness.'
SECTION 3. SeverabilitV and Savings. If any section, subsection, sentence, clause or
phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such
decision shall not affect the validity of the remaining portions of this Ordinance, all the
parts being declared severable and independent of all others. If any provision of this
Ordinance is in conflict with or contrary to the rules and regulations of the Federal
Aviation Administration that are now in effect, or as hereafter may be promulgated, that
provision in this Ordinance shall be void and the rules and regulations of the Federal
Aviation Administration shall prevail.
SECTION 4. OPERATIVE DATE. This Ordinance shall become operative September 20,
1990.
SECTION 5. EFFECTIVE DATE. This Ordinance shall be in full force and effect thirty (30)
days after passage.
SECTION 6. PUBLICATION. The City Clerk is hereby ordered and directed to certify to
the passage of this Ordinance, and to cause same or a summary thereof or a display
advertisement, duly prepared according to law, to be published in accordance with law.
