AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, ENACTING AN INTERIM ORDINANCE
FOR THE PURPOSE OF PLACEMENT OF A
TEMPORARY STRUCTURE TO HOUSE VISITOR
INFORMATION SERVICES, TO FORGO A FORMAL
CONDITIONAL USE PERMIT PROCEDURE, AND TO
ALLOW A PRIVATE SEWAGE DISPOSAL SYSTEM IN
LIEU OF HOOKING INTO MUNICIPAL WASTEWATER
TREATMENT PLANT.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES ORDAIN AS
FOLLOWS:
SECTION 1. AUTHORITY. This ordinance is adopted pursuant to the provisions
of Government Code 65858.
SECTION 2. URGENCY ORDINANCE - FINDINGS. It is necessary that the City
Council immediately provide an alternative to the dispensing of visitor infor-
mation to tourists and visitors coming to the community due to the recent
reduction in this type of service by other organizations. Because of the
critical need for this type of service to the visitor industry, the City
Council assuming this function as expeditiously as possible. A temporary
building may be necessary for, this purpose. The Council finds that the Zoning
Ordinance requirement for a Conditional Use Permit for temporary building was
established to give the private sector flexibility in building options while
maintaining some City control in the final removal of such temporary facili-
ties. Such control is obviously not a need in the case of municipal applica-
tions and the requirements were not reviewed in this regard at the time of the
original adoption. Based on the foregoing and other sufficient evidence, the
City Council further finds that there is a current and immediate threat to the
public health, safety, or welfare and that to require a Conditional Use Permit
for this purpose in order to comply with the Zoning Ordinance would result in
a threat to the public health, safety, or welfare.
SECTION 3. ARCHITECTURAL APPROVAL REQUIRED. As provided in the Zoning
Ordinance, any temporary building deemed necessary by the City Council for the
effective management and administration of the municipal government shall be
reviewed and approved by the Palm Springs Planning Commission under the proce-
dures set forth under Section 9404.00 et seq (architectural review) of the
Zoning Ordinance.
SECTION 4. SEWAGE DISPOSAL. Not withstanding any other provisions of City of
Palm Springs codes, ordinances, policies and regulations, temporary municipal
buildings shall be exempted for up to two years from the date of installation
and final occupancy from the requirement to hook up to the City sewer system
if a private sewer system is utilized to provide safe and effective treatment
of the sewage generated, and the cost of hooking up to the City sewer system
is more than five percent of the building installation cost.
SECTION 5 . EXCEPTIONS. This ordinance shall not apply to temporary struc-
tures in residential neighborhoods, or to structures which will be in place
more than two years.
SECTION 6. EFFECTIVE DATE. This Ordinance shall be in full force and effect
immediately by adoption by at least a four-fifths vote of the City Council and
shall be in no further force and effect 45 days from its date of adoption
except that before expiration the City Council , after notice pursuant to
Governmental Code 65090 and a public hearing may extend the time this
ordinance is in effect for an additional 10 months and 15 days and after that
by an additional one full years. Any such extension shall also require a
four-fifths vote of the City Council for adoption. 3 is

SECTION 7. PUBLICATION. The City Clerk is hereby ordered and directed to
certify to the passage of this Ordinance, and to cause the same or a summary
thereof or a display advertisement, duly prepared according to law, to be pub-
lished in accordance with law.
