AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFOR-
NIA, AMENDING CHAPTER 11.33 OF THE PALM SPRINGS
MUNICIPAL. CODE TO PRESCRIBE SECURITY REGULATIONS
FOR THE USE OF THE PALM SPRINGS REGIONAL AIRPORT
AND STATING PENALTIES FOR THE VIOLATION THEREOF.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES ORDAIN
AS FOLLOWS:
SECTION 1 . CHAPTER 11.33 of the Palm Springs Municipal Code is hereby
amended by adding a new "Number 4" definition to Section 11.33.040, as
follows , and by renumbering the succeeding definitions to allow the
insertion.
"(4) Airport Master Security Program. That, security program
prepared in response to Federal Aviation Regulation Part 107
and adopted by Resolution by the City Council of the City of
Palm Springs. "
SECTION 2. CHAPTER 11.33 of the Palm Springs Municipal Code is hereby
amended by adding new sections to be numbered 11.33.052, 11.33.054,
11.33.056, and 11.33.058 and reading as follows:
"11.33.052 Compliance to the Palm Springs Regional
Airport Approved Master Secures. Ali tenarts, concession-
aires, lessees, invitees, contractors, subcontractors ,
together with their agents , employees, invitees and guests
using the facilities of the Palm Springs Regional Airport
shall comply with the Airport Master Security Program. "
"11.33.054 Security Badges. The issuance of airport
security badges is at the sole discretion of the Airport and
said badges remain the property of the Airport and shall be
surrendered upon demand or upon termination of the need of
access to the area(s) authorized. "
"11.33.056 Federal Fines. Any fines or penalties
levied or imposed against the Airport as a result of viola-
tions of Title 14, CFR, Part 107, shall , in turn, be imposed
by the Airport on the entity whose employee or agent has
committed such violation."
"I1.33.058 Airport Enforcement of Federal Aviation
Regulation Part 107. The Airport Law Enforcement Officers
are hereby empowered to issue warnings or violations or
remove or suspend any tenant or concessionaire whose agent or
employee violates Federal Aviation Regulation (FAR) Part 107
or the Airport' s Master Security Program. For any violation
of Federal Aviation Regulation (FAR) Part 107 or the Air-
port's Master Security Program, penalties shall be imposed,
as follows:
"1. First offense for any violation by and individual
employee or agent of any tenant., concessionaire or
contractor shall result in a written warning;
2. Second offense for any violation by a previously warned
employee or agent of any tenant, concessionaire or
contractor shall result in a fine of $50; and /_

3. Third or subsequent offenses for any violation by a
previously cited employee, contractor's employee or
agent of any tenant, concessionaire or contractor shall
result in a fine of $100.
"Any tenant or concessionaire wishing to appeal any fine
levied in accordance with this Chapter must, within ten
(10) calendar days after imposition of the fine, file a
written notice of such an appeal with the office of the
Director of Aviation. Such appeal will be heard by the
Airport Commission at its next regular meeting. The decision
of the Airport Commission shall be a final determination.. of
such appeal . "
SECTION 3. EFFECTIVE DATE. This Ordinance shall be in full forcr and
effect thirty (30) days after passage.
SECTION 4. PUBLICATION. The City Clerk is hereby ordered and directed
to certify to the passage of this Ordinance, and to cause same or a
summary thereof or a display advertisement, duly prepared according to
law, to be published in accordance with law.
