HomeMy WebLinkAbout7/7/1999 - STAFF REPORTS (7) DATE: July 7, 1999 TO: City Council FROM: Assistant City Manager-Operations SAFETY INFRASTRUCTURE REPLACEMENT AND ENHANCEMENT NEEDS(SIREN) "CITY PLAN' RECOMMENDATION: It is recommended that City Council approve the"City Plan"related to the SIREN General Obligation Bond ballot measure, adopt a Resolution of Interest&Necessity and introduce for first reading an Ordinance calling for the ballot measure. BACKGROUND: The decade of the nineties brought very austere budgets which provided for little or no capital improvements. Of particular note,the safety service facilities replacement and expansion needs have not been met. The total immediate needs for the safety services amount to more than$4.7 million. The City Council has authorized the investigation of placing a General Obligation Bond Issue on the November 1999 ballot. Pursuant to Govermuent Code 43600 et seq, a series of projects may be combined into a"City Plan" for purposes of placing a General Obligation Bond Issue on the ballot. The "City Plan" has been developed, copy attached, and was recommended for City Council approval by the Pluming Commission at a special meeting held on June 16, 1999. The projects included in the Plan are as follows: 1. Relocate Fire Station 91 $2,100,000. 2. Fire Station#2 Refurbish/Expand 230,000. 3. Fire Station#3 Security&Safety Needs Expansion 130,000. 4. Fire Station#4 Fuel Facility and Safety Improvements 90,000. 5. Replace Dilapidated Animal Shelter 2,100,000. 6. Police Range Addition 50,000. TOTAL PROJECT NEEDS $4,700,000. The suggested method to finance the above improvements is to sell a General Obligation Bond Issue. The bond issue would be a 30-year tax-exempt issue with an overall size not to exceed$5 million. (Note that the size of the issue is larger than the"Total Project Needs"to cover the cost of issuing the bonds.) A tax rate,not to exceed$9.00 per annum,per$100,000 assessed valuation would be required to pay the obligation. Pursuant to Government Code 43607, "Proceedings are initiated when the city legislative body passes a resolution by a two-thirds vote of all its members determining that the public interest or necessity demands the acquisition, construction or completion of any municipalimprovement." It should be noted that the relocation of Fire Station #1 is called for in the City General Plan Implementation Program Policies,item 6d/26,adopted in 1993. The "City Plan"and Resolution of Interest&Necessity are recommended by staff as the most immediate method of meeting the Safety Infrastructure Replacement and Enhancement Needs as the City enters the new millennium. A Minute Order approving the "City Plan"and the Resolution are attached for City Council consideration. An Ordinance calling for a General Obligation Bond Issue ballot measure with the acronym "SIREN' is also attached to this report for City Council introduction and first reading. ALLEN F. WHEREAS, the public interest and necessity require the implementation of the City Plan For Its Safety Infrastructure Replacement Needs to ensure the continued provisions of needed safety services into the new millennium; and WHEREAS, the general laws of the State of California authorize the property acquisitions, construction and facility rehabilitation such purposes and the incurrence of indebtedness to finance the costs of such plan implementation; and WHEREAS, to initiate the procedure for the authorization of indebtedness, it is necessary for this City Council to adopt, by a two thirds majority of its members, a Resolution determining that the public interest and necessity require the implementation of said City Plan and incurrence of the indebtedness; NOW THEREFORE BE IT RESOLVED by the City Council ofthe City of Palm Springs,California as follows: SECTION 1. The City Council hereby finds and determines that the public interest and necessity require the implementation of the City Plan For Its Safety Infrastructure Replacement and Enhancement Needs to ensure the continued provisions of needed safety services into the new millennium. SECTION 2. The City Council further finds and determines that the estimated cost to complete the City Plan For Its Safety Infrastructure Replacement and Enhancement Needs is $5 million, and such amount being an expenditure greater than the revenues currently available to the City, it is in the public interest and necessity to incur indebtedness to find the cost of such City Plan and, subject to the satisfaction of certain proceedings, to be hereafter undertaken. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,CALIFORNIA,CALLING AND ORDERING A SPECIAL MUNICIPAL ELECTION TO BE CONSOLIDATED WITH THE GENERAL MUNICIPAL ELECTION ON NOVEMBER 2, 1999 FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY A PROPOSITION TO INCUR BONDED INDEBTEDNESS FOR THE IMPLEMENTATION OF "CITY PLAN FOR ITS SAFETY INFRASTRUCTURE REPLACEMENT AND ENHANCEMENT NEEDS." WHEREAS a regular General Municipal Election shall be held on Tuesday,November 2, 1999,for the election of a Mayor and two (2) members of the City Council and Council and, WIIEREAS at its meeting of July 7, 1999, the City Council, by a vote of at least two-thirds of its members, adopted a Resolution determining that the public interest and necessity demand the implementation of the "City Plan For Its Safety Infrastructure Replacement and Enhancement Needs," and making findings relating thereto (the "Resolution of Necessity"), NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, as follows: SECTION 1. That there shall be and there is hereby ordered a Special Municipal Election, to be consolidated with the General Municipal Election to be held November 2, 1999, for the purpose of submitting to the qualified voters of the City of Palm Springs the proposition hereinafter set forth of incurring indebtedness and issuing General Obligation bonds of the City therefor,in the principal amount stated hereinafter for the purpose set forth in said City Plan and said Resolution ofNecessity, and in the ballot proposition. SECTION 2. That the estimated cost of implementing the City Plan For Its Safety Infrastructure Replacement and Enhancement Needs described in the ballot proposition is $5 million; and the estimated cost of implementing the City Plan includes the following:(a)legal or other fees incidental to or connected with authorization, issuance and sale of the bonds, and (b)the costs of printing the bonds and other costs and expenses incidental to and connected with the authorization,issuance and sale of the bonds. SECTION 3. That the maximum rate of interest to be paid on said indebtedness shall not exceed the maximum rate currently permitted by law, to wit, twelve percent(12%)per annum, the actual rate or rates of interest on the bonds to be determined at or prior to the time of sale or sales thereof. Said interest shall be payable semiannually except that interest in the first year may be payable at the end of said year. SECTION 4. That on the ballots to be used at said General Municipal Election,in addition to any matters required by law, there shall be printed substantially the following: BOND PROPOSITION: Shall the City of Palm Springs provide increased safety and animal shelter services by incurring bonded indebtedness in the principal amount of up to $5 million to implement the"City Plan For Its Safety Infrastructure Replacement and Enhancement Needs for construction of a yES new Fire Station 41, a new Animal Shelter, Police Firearms Training Simulator Storage Facility, and the rehabilitation of three other Fire Stations related to Fire personnel life safety and emergency preparedness, all as set forth in the City Plan For Its Safety Infrastructure Replacement and Enhancement • Needs? 0 0 5Jq SECTION 5. That a cross(+)placed in the voting square after the word "yes" in the box provided shall be considered in favor of the adoption of the proposition. A cross (+) placed in the voting square after the word "no" in the box provided shall be counted against the adoption of the proposition. SECTION 6. That if the proposition for increasing of bonded indebtedness so submitted receives two-thirds of the votes of the qualified electors voting YES on the proposition, bonds of said city, not exceeding the principal amount stated in such proposition, may be issued and sold for the purpose set forth in the proposition. SECTION 7. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. SECTION 8. That the polls for said election shall be open at seven o'clock a.m. on the day of said election and shall remain open continuously from said time until eight o'clock p.m.of the same day when said polls shall be closed, except as provided in Section 14401 of the Elections Code of the State of California. SECTION 9. That the Board of Supervisors of Riverside County is hereby requested to conduct the special municipal election hereby called and to consolidate the special municipal election with the regular election to be held on November 2, 1999. The precincts, polling places and officers of election for the special municipal election hereby called shall be provided by the Registrar of Voters and placed on file with the City Clerk. The Board of Supervisors is hereby authorized to canvass the returns of the special municipal election. The Board of Supervisors shall certify the results of the canvass of the returns of the special municipal election to the City Council which shall thereafter declare the results thereof. A proposition submitted by this ordinance shall be designated on the ballot by a letter printed on the left margin of the square containing the description of the measure, as provided in Section 10219 of the Elections Code. SECTION 10. That in all particulars not recited in this Resolution, said election shall be held and conducted as provided by law for holding consolidated municipal elections in said City. SECTION IL That Notice of time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election, in time, form and manner as required by law. SECTION 12. That the City Clerk shall reimburse said County, or other resource, for services performed when the work is completed and upon presentation to the City of a properly approved bill. SECTION 13. That pursuant to Section 10263 of the Elections Code of the State of California, the canvass of the General Municipal Election to be held in said City is hereby ordered to be made by the City Clerk, and the Registrar of Voters of said County. SECTION 14. That the City Clerk of said City shall cause to be complete the canvass of said election and shall certify the results to the City Council on November 30, 1999. SECTION 15. That the City Clerk is hereby directed to transmit a copy of the measure set forth in Section 1 above to the City Attorney, who shall prepare an impartial analysis of the measure in accordance with Section 9280 of the said Elections Code. SECTION 16. This Ordinance shall take effect immediately after its passage. SECTION 17. That the City Clerk shall certify to the adoption of this Ordinance and cause the same to be published daily for six consecutive days in the Desert Sun as required by law, within fifteen (15) days after its passage.
