L„ I DATE: July 7, 1999 TO: City Council FROM: Special Districts Manager via Assistant City Manager- Operations ANNUAL MAINTENANCE DISTRICTS (10 ) - PUBLIC HEARINGS FOR 1999/2000 RECOMMENDATION: That City Council hold annual Public Hearings for 4 Lighting Maintenance Districts and 6 Parkways Maintenance Districts and approve Resolutions adopting maintenance costs for fiscal year 1999/00 for:Lighting District No. 1-Belardo Area; Lighting District No.2- McManus Drive; Lighting District No. 3 - Crossley Tract; Lighting District No. 4 - Eagle Way area; Parkways District Nos. 6A, 6B and 6C - various locations; Parkways District No. 7- Sunrise Norte ; Parkways District No. 8 - Vintage Palms and Parkways District No. 9 - The Springs Tract. BACKGROUND: At the June 2, 1999 Council Meeting,Engineer's Reports and the Resolutions of Intention were approved by City Council, setting the Public Hearing date for July 7, 1999, for the following maintenance districts: 1. Street Lighting Maintenance District No. 1 (Belardo Area-166 Properties) 2. Street Lighting Maintenance District No. 2(McManus Drive-25 Properties) 3. Street Lighting Maintenance District No. 3 (Crossley Tract- 75 Properties) 4. Street Lighting Maintenance District No. 4 (Eagle Way Area- 43 Properties) 5. Parkways Maintenance District No. 6A(Chia Rd. Area- 24 Properties) 6. Parkways Maintenance District No. 6B ("Parkside Estates" Tract- 93 Properties) 7. Parkways Maintenance District No. 6C ("Park Sonora" Tract- 30 Properties) 8. Parkways Maintenance District No. 7("Sunrise Norte" Tract- 53 Properties) 9. Parkways Maintenance District No. 8 ("Vintage Palms" Tract- 63 Properties) 10. Parkways Maintenance District No. 9 ("The Springs" Tract- 77 Properties) Eight(8)of the districts listed above,are under the"Landscaping and Lighting Act of 1972" which requires Public Hearings every year. Lighting Districts No. 1 & 2 are under the "Street Lighting Act of 1931," which require public hearings every five (5)years, the last being in July, 1996. Public hearings for Lighting Districts No. 1 &2 are required this year, because cost increases are being approved over July 1996 amounts,however the increases do not exceed maximum assessments approved in fiscal year 1990/91. Attached are the Fixed Charges Reports for 1999/00 for the ten(10)Maintenance Districts listed above. Individual assessments are listed by assessor's parcel number and County Fund Number. Upon approval by City Council on July 7, 1999, the amoral assessments will be forwarded to the Riverside County Tax Collector to be listed on the 1999/00 tax rolls. Under new laws governing maintenance districts, any increases in annual assessments would require two (2) Public Hearings and individual mailed notices to all affected property owners. Also, the recent Proposition 218 (Article XIIID, Section 4 of the California Constitution), approved by voters on November 5, 1996, requires a Notice and Ballot(2/3 majority vote) for any increased or new assessments. There are 649 properties within the 10 maintenance districts. Note: There are no cost increases over and above previous public hearing set maximum limits in any assessments for the maintenance districts in 1999/00. / ,4 ' Annual Maintenance Districts - Public Hearings for 1999/00 1A Page 2 Assessments for all ten maintenance districts are detailed in the Engineer's Reports approved by City Council on June 2, 1999, summarized as follows: SLMD No.1 (Belardo): Assess $6,497; SLMD No.2 (McManus): Assess $4,250; SLMD No.3 (Crossley): Assess $0; SLMD NoA(Eagle Way): Assess $1,129; PMD No.6A (Fairport):Assess $4,810; PMD No.6B (Parkside): Assess $1,818; PMD No. 6C (Park Sonora):Assess$6,264;PMD No.7(Sunrise Norte):Assess$23,747;PMD No.8(Vintage Palms): Assess $11,118 and PMD No.9 (The Springs): Assess$0. The following districts had increases in 99/00: SLMD Nos. 1 & 2 and PMD Nos.6A, 6C, 7 & 8. Districts remaining the same as prior year are: SLMD 3 &4 and PMD 6B; District with decrease from prior year: PMD No. 9. Assessments are based on comparison of actual costs incurred in prior years vs. assessments in prior years to obtain annual adjustments to compensate for debits and credits on an annual basis. Attached for City Council consideration are Resolutions adopting assessments for all ten Maintenance Districts for 1999/00, which are reported to Riverside County on the Fixed Charges Reports for placement on the tax rolls for the fiscal year beginning July 1, 1999 thru June 30, 2000. Parkways District 9 77 1997 "The Springs" Tract (The Springs Tract) landscape buffer strip will Sunrise Way- Via be developer installed on Escuela to Rac.Club Surise Way at Via Escuela, petioned by the property owners(1972 Act) TOTAL PROPERTIES 649 Additional Information: Lighting Maintenance Districts The Neighborhood Street Lights are maintained by the Southern California Edison Co.(SCE)- (facilities maintenance crews, managed by local Cathedral City Regional SCE office ). Most of the annual costs (about 80%) are the basic SCE monthly electrical charges. In many cases the street lights were requested by property owners as a crime deterrent. Most of the general public, however, seem to prefer the dark desert sky atmosphere and do not wish neighborhood street lighting promoted by the City. The lighting districts are only in areas where more than 60% of the given area residents had petitioned the City to have the street lights installed. There are 309 properties in Palm Springs within the 4 lighting district boundaries. Parkways Maintenance Districts The parkways districts are primarily developer oriented projects that installed off-site landscaping along the public right-of-way perimeters of subdivisions as a condition-of-approval requirement of the Planning Commission. The landscaping is an enhancement to the project and neighborhood. -2- These are typically single-family property ownerships that are not within a condominium type situation to handle the costs by association dues. Their chosen option is to form the maintenance district to spread the costs annually on the tax rolls since there is no other practical method to collect and pay for the annual maintenance costs . There are 340 properties in the 6 parkway maintenance districts City-wide, (see attached location map). Currently, "Landscape West, Inc." is the contractor maintaining the parkways for the City. Their contract commenced mid-year 1995 and runs for four (4) years until December 31, 1999. Scott Mikesell,Facilities Manager, administers and oversees the Landscape West maintenance contract. The maintenance contract will be put out to Request for Proposals by Scott Mikesell and Harold Goad, Procurement Manager in the near future to obtain a new multi-year maintenance contract to commence January 1, 2000. With the exception of Lighting Districts Nos. 1 and 2,most of the maintenance districts were formed under the California "Landscapin and id Lighting zting Act of 1972". The exceptions are Lighting District No. 1 (Belardo area) and Lighting District No. 2 (McManus), which were formed under the California "Street Lighting Act of 1931". The 1931 Act only requires a public hearing once every five years, whereas the 1972 Act requires public hearings every year. The annual assessments (Fixed Charges Reporting Form) must be submitted to the County Tax Collector by the 3rd. week of August annually so we schedule to adopt the Resolutions of Intentions each June and the public hearings each July annually in order to make the deadline. According to the City Clerk, there have been no protests to date for any of the districts listed above, including the earlier districts dating back to 1967. There is no net cost to the City for the annual maintenance districts as all costs are assessed to the property owners. WHEREAS in accordance with the provisions of the Street Lighting Act of 1931, Division 14, Part 2 of the Streets and Highways Code, beginning with Section 18300, it is required that the Superintendent of Streets determine actual maintenance costs of the previous year and an estimate of costs for the ensuing year in order to prepare the annual spread of assessment; and WHEREAS the Street Lighting Act of 1931 requires public hearings every five (5) years (the last public hearing was held on July 17, 1996) approving the spread of assessments for the next five (5) years, commencing with fiscal year 1997/98 through 2000/2001; and WHEREAS cost increases, however, require a public hearing to accommodate increased costs in fiscal year 1999/00, but not exceeding maximums approved in 1990/91; and WHEREAS spread of assessment is forwarded to the County Tax Collector who, in turn, includes this assessment on the County Tax Roll. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as follows: Section 1. The improvement commonly known as"Street Lighting Maintenance District No. 1," (Belardo Area) and No. 2 (McManus Drive)the boundaries of which are on file in the Office of the City Clerk, and incorporated herein by reference, shall be maintained, pursuant to said Streets & Highways Code, for a period of five years commencing July 1, 1999, and ending June 30, 2004. Section 2. The spread of assessment for fiscal year 1999/00 for Street Lighting Maintenance District No. 1 (Belardo Area) and No. 2 (McManus Drive) on file in the office of the City Clerk and incorporated herein by reference, is hereby confirmed. Section 3. That all protests, if any, for Street Lighting Maintenance District No. 1 and No. 2 are hereby overruled in 1999/00, (Costs increased in 99/00 don't exceed 90191 limits) Section 4. The City Clerk is hereby directed to certify the said spread of assessment and map and forward same to the County Tax Collector prior to the third Monday of August, in accordance with Section 18401 of the Streets and Highways Code of the State of California. OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA OVERRULING THE PROTEST ON THE SPREAD OF ANNUAL ASSESSMENTS, AND CONFIRMING THE ENGINEER'S REPORT,DIAGRAM AND ASSESSMENT SPREAD FOR PARKWAY MAINTENANCE DISTRICT NO. 9 "THE SPRINGS" TRACT 26364, ALONG SUNRISE WAY(VIA ESCUELA TO RACQUET CLUB),FOR FISCAL YEAR 1999/00. WHEREAS in accordance with the provisions of the Landscaping and Lighting Act of 1972 that the Engineer of Work has determined the estimated maintenance costs for the first year in order to prepare the annual spread of assessment; and WHEREAS July 7, 1999, was set as the date to hear protests on the spread of assessment for Parkway Maintenance District No. 9; and WHEREAS notice duly was given by publication and a hearing duly conducted at which all persons interested testified; and WHEREAS written protests have been received representing less than fifty percent (50%) of the area of assessable lands within the maintenance area; and WHEREAS spread of assessment shall be forwarded to the County Tax Collector who, in turn, shall place this assessment on the County Tax Roll. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as follows: Section 1. Description of work: To maintain the landscaped parkway(buffer-strip 25' wide by approximately 1250' long)to be installed by the developer of Tract 26364 "The Springs" along the west side of Sunrise Way(Via Escuela to Racquet Club).Said maintenance work as described in detail in the Engineer's Report. Section 2. That all protests, if any, are hereby overruled for Parkway Maintenance District No.9. Section 3. The improvements,assessment amount, spread of assessment and the diagram as set out in the engineer's report are hereby confirmed for fiscal year 1999/00.($0 Assessment in 99/00 due to surplus in 98/99). Section 4. The City Clerk is hereby ordered and directed to file a certified copy of the diagram and assessment roll with the County Tax Collector, together with a certified copy of this Resolution upon its adoption and the auditor is requested to collect such assessments on the tax roll in the same manner and subject to the same penalties for non-payment as are county property taxes. Section 5. This project is statutorily exempt from CEQA under Section 15273 of the guidelines as an ongoing maintenance charge.All work is in accordance with the Landscaping and Lighting Act of 1972 (Part 2 of Division 15), Section 22500 of the Streets and Highways Code and Article XIIID, Section 4 of the California Constitution (Proposition 218).
