July 21, 1999 TO: Community Redevelopment Agency FROM: Jerry Ogburn, Director of Downtown Development Center VIA John Raymond, Director of Economic Programs DESIGN CONTRACT FOR FRANCES STEVENS FESTIVAL PARK/PHASE ONE RECOMMENDATION: That the Agency: 1) authorize the expenditure of North Palm Canyon RDA Capi- tal Projects Funds for site improvements to the City-owned Frances Stevens Park; and 2) approve a consulting contract with T.K.D. Associates, Inc. of Palm Springs in the amount of $15,500.00 for Landscape Architectural and Engi- neering services for the design and preparation of construction documents for site improvements adjacent to a fountain and sculpture to be located at the southwest corner of Frances Stevens Park, with the cost of these services to be paid by Agency funds. BACKGROUND: The Palm Springs Public Arts Commission has retained sculptor David Morris to create a major sculpture piece and water feature to be located at the southwest corner of Frances Stevens Park. Mr. Morris is scheduled to begin construction on this project during July with completion anticipated by the end of October, 1999. The "Phase One Project Area" of Frances Stevens Park which is to be di- rectly impacted by this public arts piece is bounded by Indian Canyon Drive on the east, Alejo Road on the south, Palm Canyon Drive on the west and the Palm Canyon Theatre building on the north. Within this "Project Area", existing side- walks, irrigation lines, electrical lines, grass areas and landscaping will be re- moved or relocated in order for this major public arts project to be construct- ed. This demolition and site preparation process was scheduled to begin on or about July 1, 1999. Also, the Heritage Trail Project is scheduled to be in pro- gress during this same time frame, and will include the construction of a new decorative concrete bicycle/pedestrian link along Palm Canyon Drive at this lo- cation in conjunction with the sculpture/fountain element. All of this construction activity requires that the following new site improve- ments be constructed within the remainder of the "Project Area" upon com- pletion of the fountain/sculpture and Heritage Trail: 1) revised landscape irriga- tion and water Supply system; 2) revised electrical system for fountain and site lighting; 3) revised site grading; 4) new sidewalk and hardscape construction; and new lawn and landscaping. Design documents need to be prepared for these site improvements by a professional Landscape Architect together with appropriate engineering consultants. The design documents will need to be ap- proved by Planning Commission and Parks and Recreation Commission prior to preparation of construction drawings and specifications by the Landscape Architect. The City Engineer will then need to prepare a Bid Package in order to receive competitive construction bids from qualified contractors. Time is of the essence in order to minimize the length of time Frances Stevens Park is dis- rupted by construction so that scheduled events can proceed at ties location by early December, 1999. Page Two C to d _ A Z The Agency has been planning and budgeting for this Phase One project at Frances Stevens Park for several years. As a result, funds have been accumulat- ing and are currently available in CRA Capital Projects Account Number 8186- 6511 1 "Frances Stevens Festival Park" within the North Palm Canyon Redevel- opment Area On March 18, 1998, Palm Springs City Council approved a design contract with TKD Associates, Inc. of Palm Springs, along with sub-consultants, for the Herit- age Trail Project. This award resulted from a competitive proposal and inter- view process involving a number of consulting firms and teams responding to a Request for Proposals issued by the City. The anticipated site improvements within the "Phase One Project Area" will be very similar to the Heritage Trail site improvements to be constructed along the Palm Canyon Drive frontage adjacent to the fountain/sculpture. Therefore, given the time constraints for completion of these site improvements, staff recommends that the Agency award a contract to TKD Associates, Inc. of Pala► Springs for the preparation of design and con- struction documents for this Phase One site work. The Contract Sum, as pro- posed by TKD Associates, Inc., is $15,500.00. The Time for Performance shall be within thirty (30) days from the date that David Morris establishes "as-built" di- mensions and elevations of the fountain/sculpture with suitable accuracy for in- tegration into construction drawings for the adjacent site improvements. The consultant shall prepare the required Bid Package documents, including Speci- fications, in the established City format as determined and approved by the City Engineer. The City Attorney has determined that in order for Agency funds to be applied to the construction of site improvements on City-owned property, a Resolution authorizing this expenditure needs to be approved by the Agency. This expen- diture on site improvements at Frances Stevens Festival Park is consistent with economic development objectives of the North Palm Canyon revitalization ef- fort, since improvements to this City-owned property are continuing to be in- strumental in stimulating private sector reinvestment and redevelopment on nearby properties in the "Uptown" area The Uptown Palm Springs Association has enthusiastically endorsed the Frances Stevens Festival Park project and re- lated funding by the Agency from the North Palm Canyon RDA Capital Projects Fund. THIS CONTRACT SERV ES AGREEMENT ( erein "Agreement") , is made and entered into this day of 1999 by and between the THE CITY OF PALM SPRINGS, (herein "Ci ' ) , a body, corporate and politic and TKD Associates, Inc. (herein "Contractor") . The parties hereto agree as follows: 1. 0 SERVICES OF CONTRACTOR 1. 1 Scope of Services. In compliance with all terms and conditions of this Agreement, the Contractor shall provide those services specified in the "Scope of Services" attached hereto as Exhibit "A" and incorporated herein by this reference, which services may be referred to herein as the "services" or "work" hereunder. Contractor warrants that all services will be performed in a competent, professional and satisfactory manner in accordance with the standards prevalent in the industry, and all materials will be of good quality, fit for the purpose intended. 1. 2 Contractor' s Proposal. The Scope of Services shall include the Contractor' s proposal or bid which shall be incorporated herein by this reference as though fully set forth herein. In the event of any inconsistency between the terms of such proposal and this Agreement, the terms of this Agreement shall govern. 1. 3 Compliance with Law. All services rendered hereunder shall be provided in accordance with all ordinances, resolutions, statutes, rules, and regulations of the City and any Federal, State or local governmental agency having jurisdiction in effect at the time service is rendered. 1. 4 Licenses, Permits, Fees and Assessments. Contractor shall obtain at its sole cost and expense such licenses, permits and approvals as may be required by law for the performance of the services required by this Agreement. Contractor shall have the sole obligation to pay for any fees, assessments and taxes, plus applicable penalties and interest, which may be imposed by law and arise from or are necessary for the Contractor' s performance of the services required by this Agreement, and shall indemnify, defend and hold harmless City against any such fees, assessments, taxes penalties or interest levied, assessed or imposed against City hereunder. 1. 5 Familiarity with Work. By executing this Contract, Contractor warrants that Contractor (a) has thoroughly investigated and considered the scope of services to be performed, (b) has carefully considered how the services should be performed, and (c) fully understands the facilities, difficulties and restrictions attending performance of the services under this Agreement. If the services involve work upon any site, Contractor warrants that Contractor has or will investigate the site and is or will be fully acquainted with the conditions there existing, prior to commencement of services hereunder. Associates, Inc. was selected by the City to prepare the Herit- age Trail design documents through a competitive proposal and interview pro- cess; and this project bears a very close physical relationship to Heritage Trail and time is of the essence. None ATTEST: COMMUNITY REDEVELOPMENT AGENCY CITY OF PALM SPRINGS, CALIFORNIA By Assistant Secretary Chairman REVIEWED AND APPROVED c'.tA— A6 RESOLUTION NO. 1068 OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF PALM SPRINGS, CALIFORNIA, AUTHORIZING THE FUNDING OF IMPROVEMENTS TO FRANCES STEVENS PARK, A CITY-OWNED FACILITY WHEREAS, the Conum mitt' Redevelopment Agency of the City of Palm Springs ("Agency"), pursuant to the provisions of Health and Safety Code Section 33445, is authorized to pay for all or part of improvements which are publicly owned where the improvements are of benefit to a project area, nnmediate neighborhood therein, or adjacent project area of the Agency; and WHEREAS, the Agency finds that the use of Agency Capital Project Funds ("Agency Funds") for the improvements ("Improvements") to Frances Stevens Park ("Property"), a city-owned property, as designated herein, will benefit the North Palm Canyon Redevelopment Area ('Project Area") by promoting economic development therein; and WHEREAS, pursuant to Health and Safety Code Section 33445, the Agency finds that there are no reasonable means of financing the Improvements other than through the use of Agency Funds; and WHEREAS, the Agency finds that the use of the Agency Funds for the development of the Improvements will assist in the elimination of blighting conditions by the following: • brightening the Property at night through the installation of exterior lights; • beautifying the area through the installation of sidewalks, landscaping and irrigation systems, benches and trash receptacles at the Property; • improving electric services to the Property to support uses requiring increased energy service levels; • assisting users of the Property through the installation of campus directional signs and common parking and handicapped access features; • preserving the security of the Property through the installation of a wrought iron perimeter fence or other security devices; • providing a venue for professional and social gatherings through the installation of outdoor stages and seating areas for live performances and presentations; • beautify through art projects; and other measures to enhance the utility and setting of the property. WHEREAS, the Agency finds that the use of Agency Funds for the development of the Improvements is further consistent with the implementation plan adopted by the Agency pursuant to Section 33490. NOW THEREFORE BE IT RESOLVED by the Community Redevelopment Agency of the City of Palm Springs, as follows: Section 1. Recitals. The above recitals are all true and correct. The Agency finds that the expenditure of Agency Funds to construct the Improvements on the Frances Stevens Park Property will benefit the Project Area by promoting economic development therein, and the construction of well designed, lighted, landscaped, and engineered Improvements will assist in the elimination of blighting conditions in the Property and Project Area. Section 3. Implementation Plan. The use of the Agency Funds for the development of the Improvements is consistent with the implementation plan adopted by the Agency pursuant to Section 33490. Section 4. Agency Funding Assistance. The Agency finds that there are no reasonable means of financing the Improvements other than through the use of Agency Funds.
