LEE WEIGEL, CHIEF OF POLICE USE OF SKATEBOARDS ON CITY STREETS AND SIDEWALKS RECOMMENDATION: It is recommended that the City Council amend Sections 12.64.100 and 12.64.110 of the Palm Springs Municipal Code, regulating the use of skateboards and roller skates on city streets and sidewalks. BACKGROUND: The existing ordinances make it illegal for anyone to skateboard or roller skate on Palm Canyon, both the sidewalks and the roadway, from Alejo Road to Ramon Road. Skateboarders and roller skaters are very aware of the boundaries and skate on the side streets between the boundaries. Businesses and buildings located on corner lots, such as Super Crown Books, suffer because the skateboarders skate and "grind" on the steps and planters causing property damage to the sides of the property adjacent to the side streets. Additionally, skateboarders ride off the curbs into the roadways with no way to stop themselves from careening into traffic thereby creating traffic hazards, especially in areas that are not well lighted. The significant change to the Municipal Code would be in redefining the boundaries to include the eastern sidewalk of Indian Canyon and the western sidewalk of Belardo Road and all side streets transversing the described area. Chapter 12.64.100 of the Palm Springs Municipal Code relating to the use of skateboards on city streets and sidewalks is hereby amended by redefining the boundaries, to read as follows: 12.64.100 Use of skateboards on city streets and sidewalks. No person shall propel a skateboard on any public or private street or sidewalk as follows: (1) The area bordered by the northern sidewalk of Alejo Road to the southern sidewalk of Ramon Road, and the eastern sidewalk of Indian Canyon to the western sidewalk of Belardo Road. (2) All side streets transversing the above described area. SECTION 2. Chapter 12.64.110 of the Palm Springs Municipal Code relating to the use of roller skates on city streets and sidewalks is hereby amended by redefining the boundaries, to read as follows: 12.64.110 Use of roller skates on city streets and sidewalks. No person shall propel roller skates on any public or private street or sidewalk as follows: (1) The area bordered by the northern sidewalk of Alejo Road to the southern sidewalk of Ramon Road, and the eastern sidewalk of Indian Canyon to the western sidewalk of Belardo Road. (2) All side streets transversing the above described area. SECTION 3. EFFECTIVE DATE. This Ordinance shall be in full force and effect thirty (30) days after passage. SECTION 4. PUBLICATION. The City Clerk is hereby ordered and directed to certify to the passage of this Ordinance, and to cause the same or a summary thereof or a display advertisement, duly prepared according to law, to be published in accordance with law.
