M-1 ZONE, SECTION 19. RECOMMENDATION: The Planning Commission recommends approval to the City Council of Tentative Parcel Map 28236 allowing the current three(3)parcel,2.8 acre site to be subdivided into six(6)parcels with conditions. BACKGROUND: Ron Williams has submitted a Tentative Parcel Map requesting consideration of the reduction in the required twenty(20)twenty to forty(40)thousand square foot minimum lot size for new lots along Gene Autry Trail,a maj or thoroughfare in the M-1 zone. The proposed lots range in size from 17,250 square feet to 23,697 square feet. Zoning Ordinance Section 9217.03(A)provides for lot area reductions from 40,000 square feet to 20,000 square feet for lots fronting on a major thoroughfare,(Gene Autry Trail),where the development has an approved master plan and meets the intent ofthe Zoning Ordinance. A variance is required to reduce lot sizes and dimensions in this instance. The Plamiing Commission approved the variance on November 10, 1999 and no action is required by the City Council. The 2.8 acre property is currently subdivided into three(3)roughly equal parcels,each just under an acre.The zoning is M-1 to the north,south,west and east.The Tentative Parcel Map proposes to subdivide the three(3)lots into six(6)lots. Proposed parcels one (1),three(3)and five(5) will contain the existing buildings on the western portion of the property. The new lot square footages,building sizes(existing),and parking spaces(existing)will be as follows: Parcel 1. A. Parcel size - proposed 21,475 square feet B. Lot depth required 100 feet; proposed: 102 feet C. Existing building square footage: 7,427 square feet D. Existing parking spaces: twenty-five (25) parking spaces Parcel 2. A. Parcel size -proposed 23,696 square feet; fronts Gene Augy Trail B. Lot depth required 200 feet; proposed: 114 feet C. Proposed building square footage: 5,500 square feet D. Proposed number of parking spaces: twenty-two (22) parking spaces Parcel 3. A. Parcel size -proposed 17,250 square feet B. Lot depth required 100 feet; proposed 115 feet Parcel 4. A. Lot depth required 200 feet; proposed 141 feet Driveways are located on Sunny Dunes Road(1),Eugene Road(2)and Gene Autry Trail(1).A reciprocal access easement for all proposed and existing parcels to utilize driveways hasbeen included as a condition of approval. Shared parking between all parcels is also a condition of approval. All three proposed parcels with existing development meet or exceed parking requirements. ZONING/LAND USES: North: M-1, mixed commercial/industrial uses South: M-1, GTE offices, yard East: W-M-1, moving business, offices West: M-1, service oriented commercial ENVIRONMENTAL ANALYSIS: A Categorical Exemption per CEQA Section 15332, (urban infill development project), is applicable for this project. Levels of Service at the intersection of Sunny Dunes Road and Gene Autry Trail are not currently impacted per Cal Trans and City criteria (Level of Service B),and the project is not expected to create a significant traffic impact. All properly owners within a 400 foot radius ofthe parcel considered for subdivision were notified. PLANNING COMMISSION ACTION: The Planning Commission,at its November 10, 1999 meeting voted 5-0-1-1,(Mathews abstained; Caffery absent) to recommend approval of the proposed Tentative Parcel Map 28236 and approved the related Variance(6.435)subj ect to the attached conditions. This reduction will allow subdivision of three existing parcels on a 2.8 acre site into six parcels, per TPM 28236; Section 19. Continued from meeting of October 27, 1999 at request of applicant. This is a Categorical Exemption per CEQA Section 15332 (urban in-fill development project). Commissioner Matthews abstained, as his business in the vicinity. David Dawson, Associate Planner, reviewed the staff report, itemizing the variances requested; and stated that staff recommends approval, as there are a number of difficulties, particularly economic hardship, in attracting a viable buyer;that staff would condition for architectural and landscaping consistency to present a unified architectural appearance on Gene Autry Trail; and that applicant has concerns about being able to develop each parcel separately. Commissioners discussed the proposal, with the focus being on configuration of existing lot pattern and proposed lots, rationale for taking a conforming lot and making it non-conforming, and creating lots that are more substandard than they are now. Planning Commission Minutes November 10, 1999 - Page 13 Case 6.435-VAR and TPM 28236 - Ron Williams - Cont'd Chairman Mills stated that the proposal for the tentative parcel map allows for maximum flexibility; Commissioner Klatchko questioned the findings for allowing a variance from the City's established rules; Staff responded to questions by Commissioners and stated that the property is being divided among three family members; that the requested variances are in character with the area; that there are four driveways, with reciprocal access and parking required; that Gene Autry Trail is designated as a major thoroughfare with an ultimate width of 100 feet, intended to attract large corporate companies, and that it is important to have cohesive development patterns along this frontage. He referred to the staff report for the four elements of findings to justify the variance, i.e., parcel has special circumstances requiring the variance, economic hardship with marketable land use/location/dimension,does not constitute a special privilege as there are similar sized parcels, not a detriment to public safety and welfare, and does not impact the General Plan negatively. Public Hearing was opened. Allen Sanborn, Sanborn A & E, stated that he is the architect for the project, responded to Planning Commissioners'questions, and stated that the three existing lots are owned by three separate entities; that the fourth lot to the south was split several years ago making the rear vacant lot a separate parcel from the developed parcel on Eugene (also owned by family members); that this is investment property that has been owned by the family for years; that the proposal allows the most flexibility for future development, and described the present difficulties. He stated that the one curb cut will service the southern two lots, and the first developer would construct the driveway approach; that there will be CC&Rs requiring reciprocal access to the rear properties, and described the proposed ingress/egress. Mr. Sanborn stated that due to the multiple ownership the conditions of approval need to be clarified or separated, and addressed the conditions as follows: No. 35 - requires an 8-foot wide combination sidewalk/bikepath along the entire Gene Autry Trail frontage; needs to be separated, requiring each development to construct its related portion. No. 36- Handicapped ramp on northeast corner of the property should be conditioned to the corner lot only. /647 Planning Commission Minutes 1649 November 10, 1999 - Page 14 Case 6.435-VAR and TPM 28236 - Ron Williams - Cont'd No. 39 - one-half of the referenced curb and gutter on Sunny Dunes Road is existing, and this requirement would only be along the new lot frontage of the vacant parcel. No. 40 - exists. No. 42 - one-half of the referenced sidewalk exists; would only relate to the unimproved frontage. No. 43 - Handicapped ramp currently exists. No. 45 and 46 - These items are on Eugene Road, which is an improved road with curb/gutter/sidewalk/parking - Applicant proposes to do no improvements there; that a project could be sold before they go through, so they would not be the same owners as the properties on Eugene Road . No. 65 and 66 - These refer to Eugene Road and should be removed so there is no confusion regarding a future owner having to be responsible for something on Eugene Road. Don William, owner, stated that his family owns the property on the corner, itemized family ownership of each parcel, and that the proposed plan appears to be the only logical way to develop it, and urged approval. There being no further appearances the Public Hearing was closed. Staff clarified that the corrected width of the parcels on Gene Autry is currently substandard (less than 200-feet); that the original three lots are substandard in width, but not in depth; that the subdivision approval would create lots that are substandard in depth and width fronting on Gene Autry Trail; that regarding Condition No. 34, the indicated location on the tentative map will be the accepted ingress/egress point for that parcel. Regarding Conditions Nos. 35, 36, 39, 40, 42, 43, 45, 46, 65 and 66, staff stated that these are engineering conditions, some of which are "boilerplate"; that if the buildings on Eugene are upgraded or demolished/replaced, they will be subject to the pertinent conditions, which will be implemented at the time the application occurs on these properties. Planning Commission Minutes November 10, 1999 - Page 15 Case 6.435-VAR and TPM 28236 - Ron Williams - Cont'd Chairman Mills stated that the findings are acceptable from a variance standpoint, and he is concerned about the future of the property if these lots are not allowed to become frontage properties versus rear properties; that this is an opportunity to improve the look on Gene Autry Trail and that the conditions should be amended to reflect certain conditions that will be subject to each lot as it develops. Director stated that staff will clarify with the Engineering Department and remove any unnecessary condition of approval before it goes to City Council, and if there is a specific reason for it being there, that justification will be included in the City Council report. Discussion followed, and Commissioner Klatchko stated that Gene Autry Trail has a different look than at the time small lots were created in subject area and other alternatives should be pursued; that if this application is approved, that he would expect the highest architectural standards commensurate with a major thoroughfare. Chairman Mills stated that the character of the neighborhood is smaller lots, and suggested development possibilities fora larger project; that he has confidence that the process will maintain a desired look on Gene Autry Trail, and does not see a problem with the proposal; that the existing three income properties create a "rear yard" look which he would like to see changed, and this is an opportunity Don Williams stated that they have been approached about development of a large office building on the corner of Sunny Dunes Road and Gene Autry Trail, and that the three existing income properties will be there for a long time. The location of the trash enclosure is acceptable subject to approved construction details approved by the Director of Building and Safety consistent with approved City details. Water supplies and fire hydrants shall be in accordance with 19094 Uniform Fire Code,Article 9, Sec. 901 and 903, and Desert Water Agency or Mission Water District specifications. 25. For Commercial Cooking Operations a ventilating Hood&Duct system shall be installed in accordance with 1994 Uniform Fire Code, Article 10, NFPA 96 and UL - 300. 26. Fire Alarm System required. Installation and Maintenance of a fire alarm system shall be in accordance with 1994 Uniform Fire Code, Article 10, Sec. 1007 and NFPA Pamphlet 72. 27. Developer shall obtain State permits and approval ofplans for all work done on State Highway 111 prior to the City ofPalm Springs issuing any grading or building permits.See the City ofPahn Springs Field Supervisor pertaining to work being allowed according to City of Palm Springs Resolution 17950-Restricting Street Work on Major and Secondary Thoroughfares.Condition Nos. 3 through 7 are subject to Caltrans approval. *32. The driveway approach shall be constructed in accordance with City of Palm Springs Standard Drawing No. 205 and have minimum width of 24 feet to accommodate a curb ramp. 33. Gene Autry Trail South is a limited access highway.The access to the southerly 2 lots shall be one driveway approach centered on the common property line.Access to the northeast lot shall be from Sunny Dunes Road East. *34. Construct an 8 foot wide combination sidewalk and bicycle path along the entire GENE AUTRY TRAIL SOUTH frontage.The construction shall be adjacent to the curb with colored Portland Cement concrete.The admixture shall be Palm Springs Tan,Desert Sand,or approved equal color by the Engineering Division. The concrete shall receive a broom finish. *35. Construct a sidewalk handicap ramp meeting current California State Accessability standards at both sides of the driveway approach and at the NORTHEAST corner of the subject property. *36. Any improvements within the street right-of-way require a City ofPalm Springs Encroachment Permit. *3 8. Construct a 6 inch curb and gutter,20 feet SOUTH of centerline along the entire frontage,with a 35 foot radius curb return at the NORTHWEST corner of the subject property per City of Palm Springs Standard Drawing No. 200. *39. Construct the EAST half of a 6 foot cross gutter and spandrel at the intersection of SUNNY DUNES ROAD EAST and EUGENE ROAD with a flow line parallel to the centerline of SUNNY DUNES ROAD EAST in accordance with City of Palm Springs Standard Drawing Nos. 206 and 207. *40. The driveway approach shall be constructed in accordance with City of Palm Springs Standard Drawing No. 201 and have minimum width of 24 feet. *41. Construct a minimum 8 foot wide sidewalk behind the curb along the entire frontage in accordance with City of Palm Springs Standard Drawing No. 210. *42. Construct a ramp for the physically handicapped at the NORTHWEST corner of the subject property in accordance with City of Palm Springs Standard Drawing No. 212. 43. All broken or off grade CURB,GUTTER,AND AC PAVEMENT shall be repaired or replaced. EUGENE ROAD 44. Any improvements within the street right-of-way require a City ofPalm Springs Encroachment Permit. 45. All broken or off grade CURB, GUTTER, AC PAVEMENT AND SIDEWALK shall be repaired or replaced. SANITARY SEWER 46. Connect all sanitary facilities to the City sewer system. GRADING 47. A copy of a Title Report prepared/updated within the past 3 months shall be submitted to the City Engineer with the first submittal of the Grading Plan. 48. Submit a Grading Plan prepared by a Registered Civil Engineer to the Engineering Division for plan check.Grading plan shall be submitted to the Planning Department for comments prior to submittal to the Engineering Division.The Grading Plan shall be approved by the City Engineer prior to issuance of any grading or building pen-nits. Minimum submittal includes the following: A. Copy of final Planning Department comments. B. Copy of signed Conditions of Approval from Planning Department. C. Drainage swales shall be provided adjacent to all curbs and sidewalks-Y wide and 6"deep-to keep nuisance water from entering the public streets, roadways, or gutters. 50. In accordance with City of Palm Springs Municipal Code,Section 8.50.00,the developer shall post with the City a cash bond of two thousand dollars ($2,000.00)per acre for mitigation measures of erosion/blowsand relating to his property and development. 51. A soils report prepared by a licensed Soils Engineer shall be required for and incorporated as an integral part ofthe grading plan for the proposed site.A copy of the soils report shall be submitted to the Building Department and to the Engineering Division along with plans,calculations and other information subject to approval by the City Engineer prior to the issuance of the grading permit. 52. Contact the Building Department to get PM10 requirements prior to request for grading permit. DRAINAGE 53. The developer shall accept all flows impinging upon his land and conduct these flows to an approved drainage structure.On-site retention/detention or other measures approved by the City Engineer shall be required if off-site facilities are determined to be unable to handle the increased flows generated by the development of the site.Provide calculations to determine ifthe developed Q exceeds the capacity of the approved drainage carriers. 54. The project is subject to flood control and drainage implementation fees.The acreage drainage fee at the present time is$9,212.00 per acre per Resolution No. 15189.Fees shall be paid prior to issuance of a building permit. ON-SITE 55. The minimum pavement section for all on-site streets/parking areas shall be aminimum of 2-1/2 inch asphalt concrete pavement over 4-inch Class H aggregate base with a minimum subgrade of 24 inches at 95%relative compaction,OR equal.The pavement section shall be designed,using "R"values,detemvned by a licensed Soils Engineer and submitted with the Fine Grading Plan to the City Engineer for approval. 56. The on-site parking lot shall be constructed in accordance with City of Palm Springs Zoning Ordinance, Section 9306.00. /o '47 GENERAL 57. Any utility cuts in the existing off-site pavement made by this development shall receive trench replacement pavement to match existing pavement plus one additional inch.See City of Palm Springs Standard Drawing No. 115. Pavement shall be restored to a smooth rideable surface. 58. All existing utilities shall be shown on the grading/streetplans.The existing and proposed service laterals shall be shown from the main line to the property line.The approved original grading/street plans shall be as-built and returned to the City of Palm Springs Engineering Division prior to issuance of the certificate of occupancy. 59. Developer shall contact all utility purveyors to obtain written confirmation of service and submit a copy of all utility company will-serve letters to the City Engineer with first plan check. 60. Nothing shall be constructed or planted in the corner cut-off area of any street intersection or driveway which does or will exceed 30 inches in height in order to maintain an appropriate sight distance. 61. All trees within the public right-of-way and within 10 feet ofthe public sidewalk and/or curb shall have City approved deep root barriers installed per City of Palm Springs Engineering specifications. MAP 62. The Title Report prepared for subdivision guarantee for the subject property and the traverse closures for the existing parcel and all lots created therefrom shall be submitted with the Final Map to the Engineering Division. 63. The Parcel Map shall be prepared by a licensed Land Surveyor or qualified Civil Engineer and submitted to the Engineering Division for review.Submittal shall be made prior to issuance of grading or building permits. TRAFFIC 64. The developer shall provide a minimum of 48 inches of sidewalk clearance around all street furniture for handicap accessibility.The developer shall provide same through dedication of additional right-of-way and widening ofthe sidewalk or shall be responsible for the relocation of all existing traffic signal/safety light poles,conduit,pull boxes and all appurtenances located on the GENE AUTRY TRAIL SOUTH, SUNNY DUNES ROAD EAST and EUGENE ROAD frontages of the subject property. 65. The developer shall replace all damaged or destroyed traffic control devices and provide any new traffic control devices required by the City Engineer on the GENE AUTRY TRAIL SOUTH, SUNNY DUNES ROAD EAST AND EUGENE ROAD frontages prior to issuance of a Certificate of Occupancy. 66. A 30 inch"STOP"sign and standard"STOP BAR"and"STOP LEGEND"shall be installed per City of Palm Springs Standard Drawing Nos. 620-626 at the following locations: Gene Autry Trail South @ Driveway Sunny Dunes Road East @ Driveway 67. Construction signing,lighting and barricading shall be provided for on all projects as required by City Standards or as directed by the City Engineer.As a minimum,all constriction signing,lighting and barricading shall be in accordance with State of California,Department of Transportation, "MANUAL OF TRAFFIC CONTROLS FOR CONSTRUCTION AND MAINTENANCE WORK ZONES"dated 1996,or subsequent additions in force at the time of construction.
