HomeMy WebLinkAbout2/16/2000 - STAFF REPORTS (4) DATE: February 16, 2000 • TO: City Council FROM: City Clerk COMPREHENSIVE FEE SCHEDULE RECOMMENDATION: That the Council adopt a recodified Comprehensive Fee Schedule, which provides minor updates, adds new fees, and incorporates all previously approved fee schedule amendments; and Rescind Resolution 18591. BACKGROUND: Periodically, the fee schedule is recodified to incorporate the various changes which are approved subsequent to the last codification. It also provides an opportunity to modify, add or delete fees which are a result of a program or policy changes by the Council. The last recodification was in April, 1995; to which there have been 18 amendments. The changes/additions to the Comprehensive Fee Schedule are as follows: Community Television: Numerous pieces of equipment may be utilized to accomplish any given task. Example: To record a meeting in Studio B requires the sound system, video switcher, 5 monitors, 3 cameras, a graphics computer, a video cassette recorder, a mini disc player and a modulator (to transmit signal to Time Warner). A video tape will be needed to store the meeting for replay at a later date. Fees are based on three factors: 1) cost of supplies (video tape); 2) cost of personnel to operate equipment; and, 3) pro-rated cost of replacement equipment based on an average 5-year life span. Fire: Proposes changes to the following: Smoke detector inspection fee, Fire Inspector inspections (referred by the Engine Company); safety training to include, but not be limited to cardiopulmonary resuscitation (CPR), and C.A.R.E.S. (Community Assistance and Response to Emergency Situations) training; Medical Aid During Emergency/Disaster, Emergency Preparedness/Response and Basics of Fire Extinguishment, Light Search and Rescue, and Introduction to Disaster Psychology and Community Emergency Response Teams (CERT);pyrotechnic display (indoor/outdoor)permit. Planning: Development Agreements (DAs) - Currently, the City does not charge a fee for development agreements. DAs are legal contracts between the City and property owners which outline legal commitments for a specific development project. The proposed fee will cover staff time, report preparation, ordinance preparation and processing, public meetings, on-going monitoring, and City Attorney costs. The City Attorney legal costs should be paid in fidl by the property owner. Codes, Covenants & Restrictions (CC&Rs) - Review and approval of CC&Rs is required as a condition of approval for many residential, commercial and industrial projects where multiple ownerships are involved. The proposed fee would cover staff and City Attorney Cost. Resolution/Certification Fee - Cost to prepare a certified Planning Commission or Historic Site Preservation Board resolution. Resolution of Convenience & Necessity - New Alcoholic Beverage Control licenses require applicants to secure a Resolution of Convenience and Necessity from the City Council. This proposed fee would Page 2 offset the City costs in reviewing and issuing a Resolution of Convenience and Necessity. Zoning Letter-This fee is intended to cover costs for researching and preparing a zoning and General Plan letter. Financial institutions request this letter as part of reviewing proposed developments and/or refinancing properties. Zoning/Code Compliance Inspection and Letter - This proposed fee is to cover site inspections, research, and letter preparation where a detailed code compliance letter is necessary. Real estate disclosure requirements have caused an increase in requests for this service. Specific Plan - State law provides for Specific Plans. These are complex planning documents which require extensive analysis, review and processing. Technical Study Review - This proposed fee would offset staff cost for reviewing technical reports for development projects. Technical reports may include archaeology reports, biological assessments, noise studies, and traffic studies, to name a few. The proposed fee is an actual hourly rate to cover actual staff costs. City Attorney Review of Development projects - This proposed fee would cover the City Attorney's actual costs to review development related documents. Specific examples include Environmental Impact Reports, Specific Plans, and Planned Development Districts. This fee would not be used for routine development projects which are routed through the City Council agenda process. In-Lieu Parking Fee Agreement - This fee would offset staff costs for preparing and approving an In-Lieu Parking Fee Agreement. Police: Proposes changes to the following: Concealed Carry Weapons Permits - Initial Applicant and Renewal fees; Modification/Amendment fee; Annual Range Qualification fee; State Mandated Training; Reimbursement of Fees Paid; Initial Applicant fees; Renewal fees; Modification/Amended CCW Permit fees; CCW Permit Annual Range Qualification fees; State Mandated Training for Initial and Renewal CCW Permit Applicants. Transportation - Right-of-Way: The changes to the right-of-way fees shown are a reflection of errors in the current fee schedule which do not reflect the actual fees imposed (i.e., the "per hour" is missing from the fee schedule, as it is $50 per hour that is charged for document preparation); preparation of conveyance documents is similar to the preparation of leases or notes and deeds of trust, and therefore should have a similar fee(i.e. $50 per hour). Transportation - Streets: The Administrative Adjudication Program is to provide for the hearing and disposition of all contested parking citations involving violations of the California Vehicle Code (CVC) and the Palm Springs Municipal Code (PSMC) as they pertain to the parking of vehicles within the area of jurisdiction of the City of Palm Springs. OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADOPTING A COMPREHENSIVE FEE SCHEDULE, AND RESCINDING RESOLUTION 18581, AS AMENDED, WHEREAS, Resolution 18581 incorporated changes and amendments to the Comprehensive Fee Schedule in effect at the time of adoption of said resolution; and WHEREAS, numerous amendments and organizational changes have been made to Resolution 18581; and WHEREAS, it is desirable to reflect all changes in a complete document format, and to accurately reflect organizational structure, NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, that the attached Comprehensive Fee Schedule is hereby adopted, and all fees contained therein become effective immediately; and that Resolution 18581, as amended, is hereby rescinded.
