APPROVE RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A
CONTRACT WITH THE STATE OF CALIFORNIA DEPARTMENT OF ALCOHOLIC
BEVERAGE CONTROL TO RECEIVE A GRANT OF $80,000.00.
RECOMMENDATION:
That the City Council approve the Resolution authorizing the City Manager to enter into
a contract with the State of California Department of Alcoholic Beverage Control to receive a
grant of$80,000.00 (eighty thousand dollars).
BACKGROUND:
In March of 2000, the Department of Alcoholic Beverage Control solicited requests for
proposals from law enforcement agencies for grants of up to $100,000.00 (one-hundred
thousand dollars) to provide funds to communities that have identified alcohol-related problems
associated with alcoholic beverage licensed establishments. Staff responded to the request
and submitted a proposal focusing on ABC licensed establishments in the Downtown
Experience District.
The proposal outlined a comprehensive strategy to use a community-oriented policing
approach to mitigate problems associated with retail alcoholic beverage outlets that violate ABC
laws. The project will focus equally on prevention and enforcement. Sworn personnel will be
used for education, training, enforcement and media outreach. In addition to increased
assistance from ABC the Palm Springs Police Department plans to involve the D.A.R.E. officer
and local school district in providing prevention efforts at elementary and middle school levels.
The enforcement part of this project will include investigation of ABC licensed premises,
employing minor decay programs and D.U.I. enforcement. Also, inspection efforts will include
fire, code enforcement and County health department personnel as needed.
We were recently notified that as a result of our grant application the Palm Springs
Police Department was eligible to receive $80,000.00 (eighty thousand dollars) in grant monies
from ABC. The funds will be used to pay for the costs of one full-time police officer and
administrative support to implement the project. The grant period is from July 1, 2000 through
June 30, 2001.

FISCAL IMPACT:
The ABC grant was not included in the estimated revenues in the FY2000-01 budget. We do
not need to increase the Department's allocated positions as a result of this grant, but will carry
out the program with existing authorized personnel, which include the two (2) additional officers
added to the Department in the FY2000-01 budget.

RESOLUTION NO.
OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, AUTHORIZING THE CITY
MANAGER TO ENTER INTO AN AGREEMENT WITH THE
STATE OF CALIFORNIA, ALCOHOLIC BEVERAGE
CONTROL BOARD FOR THE SPECIAL PROJECT ABC
EDUCATION AND ENFORCEMENT
WHEREAS, THE City of Palm Springs desires to undertake a certain project as
ABC Education and Enforcement to be funded in part from funds made available through
the Grant Assistance to Local Law Enforcement Agencies Project administered by the
Department of Alcoholic Beverage Control (hereafter referred to as ABC);
NOW, THEREFORE, BE IT RESOLVED that the City Manager of the City of Palm
Springs is authorized, on its behalf of the City Council of the City of Palm Springs the
attached contract, including any extensions or amendments thereof and any subsequent
contract with the State in relation thereto.
IT IS AGREED that any liability arising out of the performance of this contract,
including civil court actions for damages, shall be the responsibility of the grant recipient
and the authorizing agency. The State of California and ABC disclaim responsibility for
any such liability.
BE IT FURTHER RESOLVED that grant funds received hereunder shall not be
used to supplant expenditures controlled by this body.
IT IS ALSO AGREED that this award is not subject to local hiring freezes.
