HomeMy WebLinkAbout8/2/2000 - STAFF REPORTS (21) August 2, 2000 To: City Council From: Director of Human Resources via City Manager APPROVE PERSONAL SERVICES AGREEMENT WITH PORTER TANNER RECOMMENDATION: It is recommended that City Council approve a Personal Services Agreement with Mr. Porter Tanner to conduct personnel investigations on a case-by-case basis, for the period June 1, 2000 through June 30, 2001, in an amount not to exceed $25,000 and in a form acceptable to the City Attorney. BACKGROUND: Occasionally, sensitive personnel issues arise that require investigations by objective third-parties to be able to be resolved. Such issues may involve workplace violence, sexual or racial harassment, discrimination and hostile work environment, to name a few. Rutan & Tucker recommended the services of Mr. Porter Tanner, a Personnel Consultant specializing in the kinds of issues identified above. Mr. Tanner was contracted to perform a number of assignments during the 1999- 2000 fiscal year, each of which were within staffs contract authority. However, as the number of issues and assignments have expanded, because these employment issues are becoming more identifiable and reported as employees become more aware of the law, the amount of the various assignments individually and collectively have begun to exceed staff's authority. The City Attorney has suggested that a Contract Services Agreement with Mr. Tanner be developed and put in place to provide staff with the ability to respond quickly to these sensitive personnel matters, for quick resolution. The agreement deal points will be: 1. Term: June 1, 2000 to June 30, 2001. 2. Rates: $100 per hour. 3. Assignments: Consultant to provide estimate of time to complete requested assignment, to be reviewed and approved by City's Human Resources Director and City Manager prior to commencement of work. 4. Reports: Consultant shall provide bi-weekly progress reports for each case he is contracted to work, and a final report with conclusions and recommendations. 194 August 2, 2000 Staff Report Pagetwo 5. Contract Budget Control: Each case assigned will be applied against and reduce the authorized contract amount available for future assignments. 6. Cancellation: Either party may cancel this Agreement, without cause, upon 30 days notice. SUSAN E. I HEREBY CERTIFY that this Minute Order, approving a Personal Services Agreement between Porter Tanner and the City of Palm Springs for the conduct of personnel investigations, on a case by case basis, for the period June 1, 2000 through June 30, 2001, in an amount not to exceed $25,000, in a form acceptable to the City Attorney, was adopted by the City Council of the City of Palm Springs, California, in a meeting thereof held on the 2°d day of August, 2000.
