MID-VALLEY PARKWAY PHASE-3 DESIGN AMENDMENT NO. 11
RECOMMENDATION:
That City Council approve Amendment No. 11 to consultant services contract with Robert
Bein, William Frost &Associates (RBF Consulting) in the amount of$24,100 for expanded
engineering services(Construction Survey Staking, etc.)for the Mid-Valley Parkway(Phase
3) Construction, and revising RBF's contract to a new total of $102,200 (for Phase 3)
and a new combined total of $1,096,091 for all three phases of the Mid-Valley Parkway
Engineering Services Contract with RBF Consulting; City Project No. 99-13
BACKGROUND:
On November 3, 1993 City Council approved a consultant services contract with RBF
Consulting for traffic engineering and design consulting services for the City of Palm Springs
(Minute Order 5277-Agreement No. A3298).
RBF Consulting was then hired to design MVP Phase-1 (Dinah Shore Bridge and Mesquite
Avenue from Gene Autry Trail to east City limits). Next RBF was hired to design MVP Phase-
2(Vella Road Traffic Signal and Airport entrance off Ramon Road).Then on February 5, 1997
City Council approved RBF Design Amendment No.4 in the amount of$53,200 to design the
street widening at Gene Autry Trail and Ramon Rd. (MVP Phase-3). Design Amendment No.
8 (9/16/98-MO 6230) increased RBF's contract by$19,200 to$72,400 and Amendment No.
10 (4/5/00-MO 6594) increased the design contract by$5,700 to$78,100 for the MVP Ph.-3
design.
The design work is complete and the MVP Phase 3 is moving to the construction phase and
the City Engineer has requested a proposal from RBF Consulting to provide Construction
Staking services for the project. Extra work is also required for the Caltrans permit process
and additional survey plotting related to utility work due to the project. On June 10, 2000 RBF
Consulting submitted a written proposal totaling $24,100 for the requested extra work. The
additional work increases the MVP Ph.-3 contract to $102,200. This work, combined with
Phase-1 and Phase-2 of the MVP Project design increases the master Purchase Order No.
606095 with RBF Consulting to $1,096,091.
Sufficient Funds are available forthe RBF Consulting design contract in Measure A accounts
134-4497-50133 (Regional Measure A portion from CVAG) and 134-4498-50133 (Local
Measure A match portion). No costs are required from the City General Fund as all costs are
covered by the Riverside County sponsored Measure A ('Y2 cent sales tax) transportation
program.

AGREEMENT#3298 - TRAFFIC ENGINEER CONSULTING SERVICES
THIS ELEVENTH AMENDMENT TO THE MASTER AGREEMENT FOR CONTRACT SERVICES
NO. 3298 (approved by City Council on November 3, 1993 - Minute Order 5277) (herein
"Agreement'), is made and entered into this day of , 2000, by and
between the CITY OF PALM SPRINGS, (herein "City") a Municipal Corporation,and Robert Bein,
William Frost & Associates (RBF Consulting), (herein "Contractor"), and is hereby amended
effective , 2000, as follows:
1.0 SECTION 2.1,ContractSum, is hereby amencledto provide an increase of TWENTY FOUR
THOUSAND ONE HUNDRED DOLLARS ($24,100)forexpanded engineering services for
the Mid-Valley Parkway-Phase 3(City Project No.99-13),increasing the MVP Ph.-3 Design
contract to $102,200 and increasing master Purchase Order No. 606095 to new total of
$1,096,091 for all three phases of the Mid-Valley Parkway design contract with RBF
Consulting.
2.0 EXHIBIT "A", Scope of Services, is hereby amended by adding Construction Staking and
expanded Engineering Services as detailed in Attachment"A"to this Amendment,(see RBF
Proposal dated June 10, 2000).
3.0 EXHIBIT "C", Schedule of Compensation, is hereby amended by adding the following:

4.0 Corporate AuthorLty. The persons executing this Agreement on behalf of the parties hereto
warrant that(i)such party is duly organized and existing, (ii)they are duly authorized to execute and
deliver this Agreement on behalf of said party, (iii) by so executing this Agreement, such party is
formally bound to the provisions of this Agreement, and (iv)that entering into this Agreement does
not violate any provision of any other agreement to which said party is bound.

5.0 Except as expressly provided herein, all other terms and conditions of the Agreement shall
remain unchanged.

EXHIBIT "A"
SCOPE OF SERVICES
A. REF agrees to perform the following Scope of Services:
TASK NO. 1 SURVEY CONTROL
RBF shall provide survey control in the vicinity of the proj ect both vertically and horizontally. The
control will be utilized in later tasks.
TASK NO. 2 SAW CUT / LIMITS OF CONSTRUCTION STAKES
RBF shall provide one set of removal stakes/paint depicting the limits of the constniction area.These
stakes will be set along the limits of construction sections of the roadway. RBF shall provide one
set of stakes/paint to delineate the saw cut for removals at 100 stations and at all Angle Points,BC's
and EC's. All saw cut lines and removal limits for the intersecting streets will be delineated.
TASK NO. 3 CURB AND GUTTER STAKES
RBF shall provide one set of line and grade stakes for curb and gutter. These stakes will be located
on 25 foot stations. Stakes will be set with appropriate offsets to the face of curb, as agreed upon
by the contractor and RBF. All stakes will be marked to the finish top of curb grade. Cut sheets
shall be supplied to the client for distribution to the contractor.
RBF shall place one stake, on line only, for the centerline ofdriveways and ramps. _
TASK NO. 4 STORM DRAIN STAKES
RBF shall install one set of line and grade stakes for the storm drain system on 25-foot stations and
at all angle points,beginning and end of curves,junctions,manholes and inlets and outlets,marked
cut to flowline of pipe.
The stakes for structures shall be set on appropriate offsets agreed upon by RBF and the contractor,
and shall be marked for finish grade to the openings, top of structure, and rim of manhole covers.
One set of stakes for a structure shall consist of a minimum of three and a maximum of four offsets
per structure.
All storm drain stakes shall be set starting from the point of connection to the existing system, and
no stakes shall be set until the point of connection to the existing system has been uncovered by the
contractor and verified by RBF for compliance with the line and grade as shown on the storm drain

plans. If the Client requests RBF to set stakes prior to verification of connection point, Client
assumes all responsibility for any additional costs of restaking by RBF or reconstruction by the
contractor due to variation between the approved plan grade and the actual"as-built"line and grade.
TASK NO. 5 TRAFFIC SIGNAL STAKES
RBF will provide one set of offset stakes to facilitate the installation of traffic signal poles and
associated facilities in accordance with the approved construction drawings.
TASK NO. 6 DESIGN EXCEPTION FACT SHEET
RBF shall prepare a Fact Sheet to facilitate Caltrans' Encroachment Permit process.
TASK NO. 7 AS-BUILT CURB PLAN
RBF shall prepare a horizontal and vertical As-Built Design Plan, for the Street Improvements on
Gene Autry Trail, to alleviate the need to relocate Souther California Edison's utility vault.
OPTIONAL SERVICES AND CONDITIONS
Work relating to the following items is specifically excluded fiom this Scope of Services and, if
required,will be undertaken for an additional fee:

COMPENSATION
B. Client agrees to compensate Consultant for services described in Exhibit "B" as follows:
A fee of Twenty-Three Thousand Nine Hundred Dollars ($23,900),plus reimbursable expenses at
direct cost plus five percent.

Estimated Reimbursable Budget $ 200
Progress billing will be forwarded to the Client on a monthly basis. These billings will include the
fees earned for the billing period plus all direct costs advanced by RBF. The Client shall make every
reasonable effort to review invoices within fifteen(15)working days from the date of receipt of the
invoices and notify RBF in writing of any particular item that is alleged to be incorrect.
Services which are not specifically identified herein as services performedby RBF or its consultants
are considered"Additional Services" for purposes of this Agreement. Client may request that RBF
perform services which are Additional Services. However, RBF is not obligated to perform such
Additional Services unless an amendment to this Agreement has been fully executed setting forth
the scope, schedule and fee for such Additional Services. In this event RBF performs Additional
Services before receipt of such executed amendment,Client acknowledges its obligation to pay for
such services at RBF's standard rates,within 30 days of receipt of RBF's invoice.
