HomeMy WebLinkAbout2/2/2000 - STAFF REPORTS (19) RESOLUTION NO. 19739 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, REAFFIRMING THE CITY CLERK'S AUTHORITY TO ACCEPT GRANTS OF RIGHTS-OF-WAY AND EASEMENTS REQUIRED AS A CONDITION OF BUILDING OR PLANNING PROCESS APPROVAL. BE IT RESOLVED by the City Council of the City of Palm Springs, California, as follows: Section 1. That the City Clerk's authority to accept grants of rights-of-way and other easements, pursuant to Resolution 17047, as a condition of building or planning process approval, is hereby reaffirmed. Section 2. That said authority is subject to the following limitations: a) The City Engineer has reviewed and approved the document in terms of legal description, and compliance with the General Plan. b) The right-of-way or easement does not involve the expenditure of city funds; and is required by the General Plan, or is a condition of building permit, or is a condition of Planning Commission approval. Section 3. The acquisition of real property for any other purpose, whether it involves the expenditure of city funds, or is gift-deeded, shall be subject to approval of the City Council.
