FOR MID- VALLEY PARKWAY PHASE 1, LANDSCAPE IMPROVEMENTS RECOMMENDATION: That the City Council approve Construction Change Order No. 3 to Tapuz Enterprises, Inc., for an increase of $45,424.22 for the Mid-Valley Parkway - Phase 1, Landscape Improvements, City Project No. 95-38. BACKGROUND: On April 7, 1999, Council awarded Tapuz Enterprises, Inc. the contract for the Mid- Valley Parkway - Phase 1, Landscape Improvements Project. Bid Item A-There are 4 irrigation controllers proposed per plans and specifications in this contract. Irrigation Controller A was to have its own electrical service pedestal. Irrigation Controllers B and C were to have a combination of one electrical service pedestal. Irrigation Controller D was to be tied into an existing electrical service pedestal. This electrical work was not in the contractor's scope of work. Since there was no electricity for the contractor to tie into, the City had to bid this portion out to the lowest bidder. The City entered into a service agreement with ARB, Inc., to install 2 electrical service pedestals, including conduit, pullboxes and transformer, per SCE approved plans and specifications, for Irrigation Controllers A, B and C. The City contractor, Tapuz Enterprises, Inc., per his construction schedule, installed all the proposed irrigation and conduit for the irrigation controllers, including landscape, except palm trees and plants around the palm trees in the median. After the power was available, the contractor still had to wait until the City was cleared to do any work in the median island. In the meantime, the contractor had to water the landscape by manual labor. Total cost for this work is $19,889.50. Items B & C - There is a court injunction currently in effect, restricting the contractor from continuing with any work in the median island, from the west side of Dinah Shore Bridge to Gene Autry Trail. All of the miscellaneous equipment items listed in Section B for Items B and C in C.C.O. No. 3 are due to the court injunction delays. This includes additional costs to maintain his construction yard, paying for his storage container as well as office overhead for a one-month period. Total cost for this work is $3,696.19. Item D - The contractor, per plans and specifications, excavated to install 96 proposed palm trees in the median island from thee west side of Dinah Shore Bridge to Gene Autry Trail. Per the current court injunction and directive from the City, the contractor can't install the proposed palm trees, per plans and specifications. The cost to excavate and backfill these locations totals $3,185.16. i?A 040\ Change Order No. 3 Mid-Valley Parkway Phase 1 - Landscape Improvements February 2, 2000 Page 2 of 3 Item E- The contractor had to re-trench 27 proposed palm tree locations in the west and east sides of the Dinah Shore Bridge, including the median island in the Cathedral City side of the project., due to the delays of the court injunction, restricting the contractor from working. After several meetings with the City staff, restrictions from working in the bridge planters and median island in the Cathedral City side were lifted and the contractor completed this work per plans and specifications. Three working days will be added to the contract. Total cost for this work is $4,913.24. Item F - Per plans and specifications, the existing electrical service pedestal was to be within 10 ft. of the proposed Irrigation Controller D. The contractor found an existing electrical service pedestal approximately 150 ft. north of the location in which the plans call it to be. This cost, which is listed in Section B, Item F, includes preliminary investigation to determine if an existing conduit could be used and install conductors from the actual location of the existing electrical pedestal for the necessary tie-in to the proposed tree lighting. The tie-in work is part of the contract and no additional cost will be added . Two working days will be added to the contract. Total cost for this work is $3,600.00. Item G - Per plans and specifications, the existing electrical service pedestal was to be within 10 ft. of the proposed Irrigation Controller D. The contractor found an existing electrical service pedestal approximately 150 ft. north of the location in which the plans call it to be. This cost, which is listed in Section B, Item G, includes preliminary investigation to determine if an existing conduit could be used, and providing and installing the existing conduit from the actual location of the existing pedestal for the necessary tie-in to the proposed irrigation. The tie-in work is part of the contract and no additional cost will be added . One working day will be added to the contract. Total cost for this work is $1,200.00. Item H - At the recommendation of the Director of Facilities, install tree staling for the 180, 15 gal. trees in the median island between west side of Dinah Shore Bridge and Gene Autry Trail. These trees have flourished enough to necessitate tree staking, 2 wood stakes with 4 ties each to control the growth alignment. Four working days will be added to the contract. Total cost for this work is $9,000.00 In addition to the ten working days added to the contract for the extra work above, sixty- three working days are added because the contractor was not permitted to work due to the court injunction. The net increase for this change order totals $45,424.22 Change Order No. 3, Mid-Valley Parkway Phase 1 - Landscape Improvements February 2, 2000 Page 3 of 3 Funds are available in account number 134-4497-50113 (Mid-Valley Pkwy Ph 1) and reimbursement from Martin Communications.
