RECOMMENDATION: That the City Council approve Amendment No.1 to Contract Services Agreement No. 4173 with Infotox, Inc., in an amount not to exceed$3,717.50 for Professional Services, related to asbestos survey at 3709 El Dorado Blvd., City Project No. 98-05. BACKGROUND: On November 11, 1999, the City entered into a Contract Services Agreement with Infotox for an asbestos survey of 3709 El Dorado Blvd. This work was performed pursuant to a request by the Economic Development Department to proceed toward demolition of the structures on said property as an addition to C.P. #98-05. The survey has been completed and the report submitted. Federal regulations require removal of asbestos materials be monitored by an independent consultant with asbestos certification. Infotox, Inc. is asbestos certified. As a separate item on the February 2, 2000 agenda, Council has, for their consideration, a change order to Environmental Control Systems, Inc., for the asbestos abatement and demolition of 3709 El Dorado Blvd. Should that be approved, the City will be responsible for monitoring and inspection. The City has requested a proposal for oversight services for the removal of asbestos containing materials from the existing structures at 3709 El Dorado Blvd., and compliance monitoring, which shall include: - Background air samples collection and analyses - Compliance air samples collection and analyses during each separate operation - Clearance air samples collection and analyses, and final inspection. For the professional services requested, the proposal received on January 5, 2000, for 3709 El Dorado Blvd., was $3,717.50. Engineering staff has reviewed the proposal and recommends that the City Council approve Amendment No.1 to Contract Services Agreement No. 4173 with Infotox, Inc., in an amount not to exceed $3,717.50. CITY PROJECT NO. 98-05 The following articles of Agreement No. 4173 are hereby amended to read as follows: 1. SECTION 2.1, Contract Sum, is hereby amended to provide a maximum contract amount of$6,517.50, an increase of$3,717.50 2. SECTION 5.1, Term, is hereby amended to read: Unless earlier terminated in accordance with Section 5.2 below, this Agreement shall continue in full force and effect until June 30, 2000. 3. EXHIBIT "A", Scope of Services, is hereby amended by adding the following: Contractor shall provide professional services to the City of Palm Springs for City Project No. 98-05 as follows: A. Provide oversight services for removal of asbestos containing materials from structures located at 3709 El Dorado Blvd., and compliance monitoring in accordance with the project specifications (Section 02080). The services shall include: - Background air samples collection and analyses - Compliance air samples collection and analyses during each separate operation - Clearance air samples collection and analyses, and final inspection. Air samples shall be analyzed by Phase Contrast Microscopy. 4. EXHIBIT "B", Schedule of Compensation, is hereby amended by adding the following: The Contractor's compensation for services described by Article 3A of amendment No.l for 3709 El Dorado Blvd., shall be on hourly basis, in accordance with Contractor's hourly rate schedule (attached), for an amount not to exceed $3,717.50 The above fee is based upon the schedule provided for the project.
