HomeMy WebLinkAbout1/19/2000 - STAFF REPORTS (15) DATE: January 19, 2000 TO: City Council FROM: City Engineer ACCEPTANCE OF RIGHT-OF-WAY PARCELS AT CHUCKWALLA ROAD AND CHAPARRAL ROAD, IN SECTION 11, T. 4 S., R 4 E.; FILE NO. R-99-006 RECOMMENDATION: That the City Council accept right-of-way parcels being dedicated from Linsu Corporation and David C. Austin for public street right-of-way at the intersection of Chuckwalla and Chaparral Roads in Section 11, T. 4 S.,R 4 E., and instruct the City Clerk to process the right-of-way dedications with the Riverside County Recorder. BACKGROUND: The City Council vacated the right-of-way for Chuckwalla Road from Indian Canyon Drive to Chaparral Road at its February 17, 1999, meeting(Resolution 19469). This street vacation was a condition of approval of and associated with Smart Alex L.L.C.'s development of the Desert Shadows Resort, approved by the City Council at its January 20, 1999, meeting, Case 5.0701-A-PD-240 / TTM 29156. The Chuckwalla Road vacation proceeded at the request of Smart Alex prior to the completion of a final street design of the Chaparral/Chuckwalla Road intersection, with the understanding that modifications of the Chuckwalla Road right-of-way could be made, if necessary, subsequent to completion of the final design. The final design now requires that two small slivers of property be dedicated to the City so that the final street improvements at the intersection are within the public right-of-way. In accordance with the initial understanding, the property owners have executed the documents offering these dedications. This item is being forwarded for City Council approval as the right-of-way dedication is not officially required of any building or other process approval, and is being re- dedicated to correct a deficiency in the legal description of the Chuckwalla Road right-of-way vacation. The City Council, pursuant to Resolution 17047, adopted March 21, 1990, directs staff to present acquisitions of real property to the Council when the acquisition is not required by building or other process approval.
