RECOMMENDATION:
The Coachella Valley Mountain Conservancy(CVMC) and Riverside County Treasurer- Tax
Collector are requesting that the City Council agree to the purchase price of a 40 acre parcel
of land. This land is located in Blaisdell Canyon, approximately 1.5 miles south of Windy
Point. The attached Minute Order is submitted for City Council consideration. If acquired by
the Conservancy, the property will be held for permanent open space purposes.
BACKGROUND:
The CVMC is in the process of acquiring a 40 acre parcel of laid located approximately 1.5
miles south of Windy Point, in Blaisdell Canyon. This property will be set aside for the
protection of its environmental, anthropological, cultural, scientific, educational, scenic and wild
life purposes in accordance with Division 23.5 (commencing with Section 33500) of the State
Public Resources Code. This code section and the County Treasurer - Tax Collection
Agreement require that the City Council approve the selling price of$1,657.14. The purpose
of allowing the City the opportunity to object to the selling price is to provide notice of the
pending sale and allow the City to check for any liens due. In this instance, the City does not
have any lien on the property. Currently, the property's assessed valuation is $5655.
The property is located within the northwest 1/4 of the northeast 1/4 of Section 36, township 3
South, Range 3 East, San.Bernardino Base and Meridian. The attachments more specifically
show the location of this property. Land surrounding this property is vacant. Property
ownership surrounding the parcel is as follows:
South and East Double Dee Restaurants
West Indian owner
North Wildlands Conservancy
The property is located in Blaisdell Canyon. The property has a steep topography. Streams
traverse the property. The City's General Plan designates this property as Conservation.
Acquisition by the CVMC for open space purposes is consistent with the General Plan.
Additionally, the City has acquired lands in this area for open space. Other properties
referenced in the agreement are located outside of the City.

AGREEMENT TO PURCHASE TAX-DEFAULTED PROPERTY
This Agreement#4216 is made this day of 19_, by and
between the Board of Supervisors of Riverside County, State of
California, and Cnachella Valley Mountains Conservancy. a California State Ag ncy
("PURCHASER"), pursuant to the provisions of Division 1, Part 6, Chapter 8, of the Revenue and Taxation Code.
The real property situated within said County, hereinafter set forth and described in Exhibit"A" attached hereto
and made a part hereof, is tax-defaulted and is subject to the Power of Sale by the Tax Collector of said County
for the nonpayment of taxes, pursuant to provisions of law.
It is mutually agreed as follows:
1. that as provided by Section 3793.1 of the Revenue and Taxation Code, the cost of
giving notice of this Agreement shall be paid by the PURCHASER, and
2. that the PURCHASER agrees to pay the sum of $ y0.0 6�'1 for the real property
described in Exhibit "A" within 14 days after the date this Agreement
becomes effective. Upon payment of said sum to the Tax Collector,the Tax Collector
shall execute and deliver a deed conveying title to said property to PURCHASER.
3. that the purpose for which this real property is being purchased is as follows: To hold
the parcels in open space for the protection of their environmental, anthropological,
cultural, scientific, educational, recreational, scenic, and wildlife resources in
accordance with Division 23.5 of the Public Resources Code.
If all or any portion of any individual parcel listed in Exhibit"A" is redeemed prior to the effective date of this
Agreement,this Agreement shall be null and void as to that individual parcel. This Agreement shall also become
null and void and the right of redemption restored upon the PURCHASER'S failure to comply with the terms and
condition of this Agreement. Time is of the essence.

RESOLUTION 98-07 OF THE GOVERNING BOARD
OF THE COACHELLA VALLEY MOUNTAINS CONSERVANCY
ADOPTED IN REGULAR SESSION
November 9, 1998
WHEREAS,the Coachella Valley Mountains Conservancy was established by the State of
California on September 17, 1990, to acquire and hold in open space,mountainous lands
surrounding the Coachella Valley, for the protection of natural and cultural resources and the
public's enjoyment thereof; and
WHEREAS,these mountainous lands, including the San Jacinto and Santa Rosa Mountains,
provide critical habitat for diverse species, including the peninsular bighorn sheep and
numerous other sensitive, rare, threatened,and endangered species; and
WHEREAS,Assessor's Parcel Numbers 522-200-001-4, 522-240-007-4, 660-240-002-8,
660-240-003-9, 753-120-007-1, 753-260-005-2, 753-330-020-1,and 755-050-012-3, as further
described in Exhibit A which is hereby incorporated by reference, are located within the
Conservancy's boundaries,a legal description of which is attached as Exhibit B and hereby
incorporated by reference, and their purchase for any purpose other than resource conservation
could result in adverse impacts to their wildlife, scenic, and cultural resource values;
NOW, THEREFORE, be it resolved in regular session of the Governing Board of the
Coachella Valley Mountains Conservancy that the Conservancy objects to the public sale of
the parcels identified above; and,
FURTHER,the Conservancy hereby offers to purchase said properties at the prices indicated
in Exhibit A through a Chapter 8 Agreement of Sale; and
FURTHER,the Conservancy hereby agrees to pay the lot book fees and the costs of giving notice,
which are in addition to the purchase price identified in Exhibit A; and
FURTHER,the'Conservancy's purpose in acquiring the land would be to hold it in open space
for the protection of its environmental, anthropological, cultural,scientific, educational,
recreational, scenic, and wildlife resources in accordance with Division 23.5 (commencing
with Section 33500) of the Public Resources Code.

Conservancy Governing Board, held on this 9th day of November, 1998,by the following vote, to

The following excerpt from Public Resources Code Section 33502 defines the boundaries of
the Coachella Valley Mountains Conservancy,
Ch. 977
DIVISION 23.5. COACHELLA VALLEY MOUNTAINS
CONSERVANCY
CHAPTER 1. ESTABLISHMENT AND PURPOSES
33500. The Legislature hereby finds and declares that the Santa
Rosa Mountains, the San Jacinto Mountains, and the Indio Hills, all
of which surround the Coachella Valley in Riverside County,
constitute unique and important open-space, environmental,
anthropological,cultural,scientific,educational,recreational,scenic,
and wildlife resources that should be held in trust for the enjoyment
of, and appreciation by, present and future generations.
33501. The Coachella Valley Mountains Conservancy is hereby
created to acquire and hold, in perpetual open space, mountainous
lands surrounding the Coachella Valley and to provide for the
public's enjoyment of, and the enhancement of their recreational
and educational experiences on, those lands in a manner consistent
with the protection of these lands and the resource values specified
in Section 33500.
33502. (a) The territory of the conservancy consists of that
portion of Riverside County bounded by a line commencing at the
intersection of the highest elevation of the San Jacinto Mountains and
the range line common to R.2 E. and R.3 E., S.B.M., in the vicinity
of the headwaters of the West Fork of Snow Creek; thence north
along that range ' line to its intersection with the San
Bernardino-Riverside County boundary, thence.east along the San
Bernardino-Riverside County boundary to its intersection with the
western boundary of Joshua Tree National Monument; thence south
and east along the western and southern boundaries of Joshua Tree
National Monument to the intersection of the southern boundary
with'1te range line common to 11,8 E.and R,9 E.,S,B,M.;thence south
along that range line to its intersection with the San Diego-Riverside
County boundary; thence west along the San Diego-Riverside
County boundary to its intersection with the highest elevation of the
Santa Rosa Mountains east of the summit of Rabbit Peak; thence
meandering .northwest and north along the points of highest
elevation of the Santa Rosa and San Jacinto Mountains to the point
of beginning; and as more specifically set forth in that certain map
entitled"Coachella Valley Mountains Conservancy" and dated May
31, 1989, and-placed on file with the Secretary of State, which map
