FOR THE INSTALLATION OF A COMMERCIAL COMMUNICATIONS ANTENNA ON A 60-FOOT TALL MONOPOLE AND A 200 SQUARE FOOT EQUIPMENT SHELTER ON A 1.53 ACRE PARCEL LOCATED AT 2050 EXECUTIVE WAY, W-M-1-P ZONE, SECTION 6. RECOMMENDATION: The Planning Commission recommends City Council approval of a Type II Conditional Use Permit for the installation of a Commercial Communications Antenna on a 60-foot tall monopole and a 200 square foot equipment shelter on a 1.53 acre parcel located at 2050 Executive Way, W-M-1-P zone, Section 6. The applicant is Barbara Saito of Nextel Communications, Inc. and the property owner is Ralph B. Coomber. BACKGROUND: Nextel Communications, Inc. has submitted an application for a Type II Conditional Use Permit to install a commercial communications antenna on a 60-foot tall monopole structure and 200 square foot equipment shelter at 2050 Executive Way. The site currently contains a 6,160 square foot office/warehouse building and a commercial communications antenna on a 60- foot tall monopole approximately 130 feet south of the proposed communications antenna. This antemra was recommended for approval by the Planning Commission on February 26, 1997 and approved by the City Council on March 19, 1997. The applicant is leasing approximately 1,290 square feet of the site from the current property owner for their communications facility and obtaining all necessary access easements from the property owner to service the facility. Nextel is currently in the process of expanding their wireless teleconummication services to cover the immediate area as well as the entire Coachella Valley. Nextel currently has a site behind the Boys and Girls Club on Mesquite Avenue and at the Spa Hotel and Casino. Sites in the northwest and southwest parts of the City are also being contemplated by the applicant. In addition to these sites,Nextel also has approximately 10 sites that are either existing or contemplated within the western half of the Coachella Valley, as shown in the Attachment 4. The communications antenna array is proposed to be a three-sided structure typical of wireless telecommunications antennas. These antennas operate on line of sight and will be oriented in a fashion as to directly communicate with other antennas in the area. The equipment shelter is proposed as a pre-fabricated stricture with an exposed aggregate exterior finish approximately 10 feet in height. The antenna and equipment shelter are proposed to be secured by a 6-foot tall wrought iron fence with landscaping around the perimeter of the facility. On October 27, 1999, the Planning Commission recommended that the project be continued to allow staff to complete an Environmental Assessment of the project. . The Enviromnental Assessment has been completed and attached to this report.The Enviromnental Assessment identifies aesthetics and hazards as specific environmental issues, related to the location of the proposed structure in relation to the flight patterns from the Palm Springs International 3,9 Airport and in relation to two scenic vehicular corridors,Vista Chino and Gene Autry Trail. ANALYSIS: 30q 1. Airport Impacts: One of the primary considerations of this application is the potential impacts to operations of the Palm Springs International Airport. The proposed commercial communications antenna is in the immediate vicinity of the traffic pattern for Palm Springs International Airport, especially, the base and final leg approaches to runway 13L. The Federal Aviation Administration (FAA) has determined that, based on its criteria, the proposed commercial communications antenna structure is not an obstruction. However, staff has consulted with the office of the Director of Aviation for the Palm Springs International Airport. This office has stated that the FAA's ruling does not mean that the new structure is not a hazard, it simply means that the tower does not penetrate airspace around the airport. The office of the Director of Aviation feels that the location of the tower poses a greater hazard than if the tower were installed at a greater distance from the airport traffic pattern. As stated earlier, there is a 60-foot tall commercial communications antenna structure approximately 130 from the proposed antenna. If the new antenna were to be installed,it is the opinion of the office of the Director of Aviation that the antennae should be clustered, marked and identifie& to be easily recognizable to a particular area. By clustering, the antenna structures could be easier to identify on aeronautical charts. In the opinion of the office of the Director of Aviation, the proposed 130-foot separation meets the intent of clustering the antennae,but the closer the antennae can be clustered,the better,understanding there are separation requirements for the antennae and lease limits that come into play. A condition of approval;.s recommended that the applicant work with the property owner,the lessee of the adjacent commercial communications antenna and staff to determine if the antenna can be clustered to a greater extent within the applicants leased area and marked to the satisfaction of the Director of Aviation and the Director of Planning and Building. Therefore, in the opinion of staff,the potential hazard issue has been mitigated to a level of insignificance and staff will continue to work with the applicant to install the antemza in an even more clustered location if feasible. 2. Visual Impacts: The second issue the Planning Commission considered is the aesthetic impacts of the commercial communications antenna to the immediate area. Again, the subject site is located on Executive Way,north of Vista Chino and East of Gene Autry Trail. Vista Chino and Gene Autry Trail are designated as scenic corridors pursuant to the General Plan Land Use Map. Objectives and policies set forth in the General Plan regarding Scenic Corridors include but are not limited to the enhancement of visual amenities of local and regional highway travel,the encouragement of landscape medians,the construction of bike trail links, etc. Within the immediate area,numerous overhead power lines exist at a height very similar or slightly taller than the 60-foot tall structure proposed under this application. The power poles are in addition to the existing commercial communications antenna on the property. In addition, there are several manufacturing uses and an electrical substation within the immediate vicinity. The applicant has prepared a series of photo simulations of the antenna and how it would appear in the current visual environment surrounding the site. These simulations clearly represent the existing vi sual"clutter"in the immediate area,including many overhead power poles, billboards and an electrical substation, all readily visible from Vista Chino and Gene Autry Trail. Color versions of these simulations will be available at the City Council meeting. To minimize the number of tall structures in the immediate area, staff has discussed the possibility of co-location to the existing monopole on the property with the applicant. According to the applicant,the overall height of the existing monopole structure would have to be raised a minimum of 15 feet(to an overall height of approximately 75 feet), for a co- location to occur in this situation to avoid interference between users. Nextel operates at a frequency where a height of 60 feet would be the minimum acceptable for coverage in this situation. However, in consulting with the office of the Director of Aviation, raising the height of the existing monopole structure on the property to 75 feet would present an equal or potentially greater impact to the general aviation flight pattern than the proposed scenario of two 60-foot tall structures on the property separated by approximately 130 feet. Based on the above facts, the Planning Commission determined that the proposed 60-foot tall commercial communications antenna structure would not significantly impact the existing visual environment and the overall aesthetics of the immediate area. To insure that the aesthetic impacts will be minimized,staff has incorporated mitigation measures into the Negative Declaration,which by definition become recommended conditions of approval of this application. These items are as follows: 1. The final color and finish treatment of the monopole and antennae shall be submitted for review and approval of the Director of Planning and Building prior to the issuance of building permits. A light gray matte paint or light gray matte final finish treatment shall be used. The color shall blend and disappear into the sky and natural surroundings as much as possible to reduce the visual impacts of the structures. The color shall be used on the monopole and antennae. A color sample meeting this criteria shall be submitted for review and approval of the Director of Planning and Building prior to installation of the antennae and monopole. 2. Additional landscaping at key visual locations where transmission would not be impacted shall be provided to further screen the communications antennae, to the satisfaction of the Director of Planning and Building. 3. Additional landscaping and a permanent irrigation system shall be provided to soften the perimeter of the enclosed area, to the satisfaction of the Director of Planning and Building. 4. If the commrmications antennae or monopole are ever proposed to be modified in any manner such as the inclusion of other antennae, satellite dishes and/or other support equipment, the proposed modifications shall be submitted to the Director of Planning and Building for review and approval prior to installation. 5. If the technology regarding the communications antennae changes in where the antennae as approved become obsolete, then the antennae shall be removed. 6. If the antennae and/or monopole are ever abandoned or if the Conditional Use Permit ever expires, the monopole and antermae shall be removed within 30 days. With regards to perimeter fencing, the Planning Commisson recommend that a decorative screening material, such as wrought iron with perforated metal as an attachment or a solid decorative block wall be provided. Dense landscaping aromid the perimeter of the facility was also recommended by the Planning Commission(Condition No. 17). The regional master plan diagram prepared by the applicant indicates a proposed location in the South Palm Canyon area. While no specific location has been discussed, staff has been contacted by Nextel about processing procedures. It is staffs understanding that Nextel is currently attempting to secure a site for development in the South Palm Canyon or Smoke � � Tree Ranch area,with a"monopalm" as the most like application of an antenna in this area. ENVIRONMENTAL ANALYSIS AND NOTIFICATION: 3#41 Staff has prepared a detailed Environmental Assessment of the project. In completing the Environmental Checklist,staff found that there could be a significant environmental impact in certain areas, such as Traffic and Circulation (related to operations at the Palm Springs International Airport) and Aesthetics, if mitigation measures are not incorporated into the project design. However, on the basis of the Initial Study, including all recommended mitigation measures as recommended conditions of approval for the project, it has been determined that the proposed project could not have a significant effect on the environment, and staff recommends that a Mitigated Negative Declaration be prepared. If the Planning Commission concurs, then a recommendation of adoption of a Mitigated Negative Declaration to the City Council would be in order. All property owners within 400 feet of the project site have been notified of the public hearing. To date,no opposition to the application has been received by staff. Several letters in support of the project have been attached to this report. PLANNING COMMISSION ACTION: On October 27, 1999,the Planning Commission recommended that the project be continued until such time that an Environmental Assessment can be reviewed in conjunction with the project. At its December 22, 1999 meeting, the Planning Commission recommended approval (6-0-1) approval of the project subject to conditions. The Planning Commission felt that the recommended mitigation measures in the environmental assessment and the recommended conditions of approval adequately addressed concerns related to aesthetics and operations at the Palm Springs International Airport.There was no voice of opposition to the project from members of the public at the Planning Commission meeting. 2 DOUGL R. Following iea discussion ofeach: Aesthetics—The proposed Nextel wireless telecommunication facility has been sited on an industrial property near the edge nf the Palm Springs city boundary. The location was chosen for two reasons: 1)the appropriate zoning for use and development standards and 2) the appropriate radio frequency propagation. 1) In an industrial zone, generally the more noxious uses are allowed. In this area, there are several manufacturing uses and an electrical plant There isan existing sixty (60)foot wireless telecommunication facility on site as well as antennas on nearby properties. The surrounding rights�of-vvay have overhead power lines approximately sixty (00) feet inheight. The allowed height /n the zone io sixty (8O) feet. The zoning regulations allow more than one wireless on a property in the industrial zone. Because of the remote location from residences and the setback from major thoruughfaree. the property in well suited asu candidate for the proposed use. Attached are photographs of the surrounding area with views towards the proposed location. Also attached are two photo simulations uf the proposed facility. 2) When the site wan chosen asa candidate, two drive tests were performed for radio transmission. Two heights were tested: sixty (60) feet and fifty (50). As a rule, Nexte| tests two heights to achieve to optimal height(subject tu zoning regulations) for its facilities, Attached are the results of the two tests. The green lines indicate the desired level of service achieved at the subject height. It is clear that the sixty (60) foot height provides more coverage than the fifty (50) height. At the sixty (60) foot height, the proposed facility will provide the handoff to its neighbor sites without allowing calls to drop. Due to the existence of the power poles and wireless telecommunication facility as well as the setback from Gene Autry Trail, the proposed facility represents little or no visual � impact topaase/o'hy. Most drivers will be focused on the road nr the adjacent billboards � that facilities that sit further off the road. Safety—The concern over safety was due to the proximity of the local airport and its flight pattern for general aviation. NexLe| filed notice with the Federal Aviation Administration (FAA) for Steve Hayes October 20, 1999 Page 2 the proposed structure. Attached is a copy of the approval from the FAA According to the approval, the proposed structure meets the standards of FAR, Part 77, Subpart C and will not require any special marking or lighting. There will not have to be any circulation. However, the notice to the FAA will have to be refiled as it has expired prior to construction of the site. These approvals are only in effect for six months prior to construction. As the proposed Facility meets the FAA standards, it is unclear why there is a concern for the airport. There are many existing poles of similar height in the area. The addition of one more pole does not significantly increase any potential hazard. One additional item bears explanation. Nextel submitted a map of existing and proposed sites for the City of Palm Springs. Because each site is part of a nationwide system, each interacts with multiple other sites that provide coverage over jurisdictional boundaries. Consequently, the map provided shows sites outside the Palm Springs proper. Attached is a copy of the map. As of today, there is one existing site on the Spa hotel on Hwy 111. There is one site under construction at the Boys and Girls Club. The map also shows this proposed site (6085)just outside the City boundaries. There are two future sites planned in Palm Springs, one to the northwest off Hwy 111 and one further south of Hwy 111. As the two future sites are planned for construction in 2000, no exact location has been determined. Futures sites are also planned for nearby cities and county areas. All future sites will be determined based on the availability for a lease, the zone and development regulations, constructability, and radio frequency propagation. CA 6085 Nextel Communications Inc. is proposing to install an existing wireless telecommunication facility at 2050 Executive Drive as part of the Southern California service area. The proposed facility will consist installing fifteen (15) panel antennas on a sixty (60) foot lattice tower and placing radio equipment in a 10'x20 shelter. The facility will be unstaffed but will transmit continuously. This type of facility is allowed in the Industrial zone with the approval of the City of Palm Springs, System Description Nextel has been authorized by the Federal Communications Commission to construct and operate the first dual purpose digital mobile radio system in the United States. The system will provide superior service to the public in each of two areas: 1) It will be fully digital and 2) it will provide dispatch services to large fleet users. The "dispatch" service will enable the system to handle a one-to-many form of communications, wherein one dispatcher can contact numerous mobile parties simultaneously. This service will be offered to local public safety entities, as well as to the general public. The advantages of a truly digital communications system over the analog/digital hybrid systems available today are many-fold. The system is three times more efficient, with three times fewer sites to serve the same number of customers. Among other things, the transmissions will be indecipherable for any potential eavesdropping devices, except perhaps those specially constructed and used by the most sophisticated government intelligence services. The system will also provide location-sensitive dispatching, wherein a dispatcher can contact only the closest units to a given location, rather than the entire fleet. This will greatly streamline the dispatching process, thus allowing faster response to demand. The service area is divided into a grid of theoretically hexagonal geographic areas. At the center of each area is a low power unmanned radio repeater station, which handles the calls to and from mobile customers within the area. As a mobile customer moves from one area to another with a call in progress, the call is automatically "handed off" to the next repeater station, without interruption. Telephone line connections between repeater sites and the switching office and from the switching office to the telephone company central office permit mobile customers within the serving area to utilize their phones just as they would a home or office telephone -- with direct dialing. Several types of subscriber units will be available. There will be a dispatch-only unit that will handle communications only between a mobile and a specified dispatcher, and will support fleet dispatching similar to current services. There will be an interconnect only unit, which will be similar to the mobile phones used by "Cellular" which allow only one-to-one communications except through conference calling. There will also be a dual function unit that will provide the mobile user with the advantages of both protocols. The proposed site will serve businesses and residents in the Palm Springs area. Existing Conditions The subject site is fully developed with an industrial building. The surrounding properties are also developed. The proposed facility will be in the rear yard. There is an existing cellular facility on the site. This proposal meets all the development standards of the City of Palm Springs. Why is the height necessary Certain uses by their very nature require height to be effective. Examples include silos, chimneys and water towers, which have practical as well as safety reasons that require them to be of greater height that allowed by the zoning regulations. Silos as designed to store dry materials. The height not only allows for more storage in a small area, but also helps to keep the dry goods dry. Chimneys have increased height to guide smoke away from the occupied area. Water towers utilize height to create the necessary water pressure to provide for domestic uses as well as fire protection. Restricting on these types of facilities would certainly reduce their effectiveness, and possibly render them useless. Just as the water tanks utilize physics to create water pressure, so radio transmission utilizes physics to provide communication. Limiting a transmission facility to a certain height does not recognize the physical needs of the facility, and can render the facility useless. The subject antennas must be able to send out signals to, and receive signals from mobile radios. These radios are either installed in motor vehicles or are portable. A mobile radio and a portable radio operate at differ power levels. The transmission signals must be stronger for a portable radio to receive them. As implied, these radios move around from place to place. They are sometimes in the path of the signal, sometimes out of the path. While they are in the path of a signal, they can receive and transmit to the base antennas, and communicate with the world. While out of the path, they cannot transmit or receive the base signal, therefore cannot communicate with anyone. In a shadow area, the signal is sometimes strong enough to be received by the mobile radio, but not by the portable. This point is of great significance when the users of the portable radio are emergency personnel. 3Aa3 3�t�y The Palm Springs area has a very changing topography. There are hills and valleys. The roads curve and wind, move up and down. The radio signal, while moving in a straight path, must navigate its way through all this. Shadows are caused by those hills that do not totally block the signal. By increasing the height of the subject antennas, the blockages and shadows can be reduced and eliminated entirely, thereby allowing communication to occur. Radio communication is transmitted through waves. If something is in the way of the wave, the wave can either bounce off the obstruction (refraction), bounce back (reflection), or stop its forward motion (absorption). Hills, trees, buildings and other objects represent obstructions in the path of the radio waves. Some of this obstruction is majorly based on the proximity, material, and size of the object. For instance, a tall hill that is immediate to the transmission site will effectively stop the radio wave from continuing on its path. A building made of steel will stop the transmission but a building made of wood frame construction will allow the wave to penetrate and continue along its path. Some of the energy is lost as the radio wave travels past the building, and the signal is dissipated. (See Exhibit A) Antennas are the facilities that allow radio waves to be transmitted or received. An antenna placed on the rooftop of a 40 foot building with a ground elevation of 100 feet, will send out its signal at 140 feet. This signal will keep going until it reaches something in its path which defracts, reflects, absorbs or receives it. If there were a 200 foot hill between the transmitting antenna and the receiving antenna, the hill would absorb some of the transmitted energy and defract the rest. The antenna on the far side of the hill will not be able to receive or transmit to the first antenna. (See Exhibit B ) By raising the height of the first antenna in either of these examples, the radio signal can be received by the other antennas. The shadow can be reduced or eliminated entirely. (See Exhibit C) What impact will this facility make on the neighborhood There is a minor impact that the antennas will make on the neighborhood. This is the visual impact. The perspective of a motorist is through his windshield. The passers-by would be more inclined to see the existing buildings, trees and other vegetation. From a distance, the site will be more visible, however, it will blend with the nature of the surrounding industrial uses. In some situations the addition of more frequencies or more transmission sites can mitigate the need for additional height. Nextel has considered both these options, but these alternatives do not exist. Through licensing by the Federal Communications Commission, the frequencies are allotted to providers. Although the frequencies are strictly regulated to establish the most equitable use, there will not be more frequencies. Radio frequencies are a finite, natural resource. As to alternate locations, the appropriate area to place additional antennas would also require the building of new tower. Colocation Nextel Communications Inc., as a policy, always attempts to install the telecommunication base stations on existing facilities. Most times, the existing facilities will be rooftops, water tanks, or communication sites. It has been very difficult to colocate on a cellular facility due to the competitive nature of the business and technical requirernents for coverage as Nextel's system matures. There are four key conditions that must be met for colocation to be feasible. 1. The site must meet the designed coverage objectives. Each carrier has different objectives based on its FCC licensing requirements, location of existing sites, technological capabilities, capacity demands, and other needs. Consequently, not all site locations meet the objectives of each carrier. Nextel's digital ESMR system is designed to be more efficient than an analog cellular system which rneans Nextel will need less base stations to serve the same number of customers as cellular does. The design of the ESMR system utilizes this strength. A colocation requirement of the use of a particular site can alter the design sufficiently to cause the need of an additional site. This can defeat the purpose of using colocation to limit the number of sites. 2. Interference and intermodulation become important issues in any instance where radio service providers colocate. There must be enough room for both vertical and horizontal antenna separation. The antenna separation is a site specific determination due to antenna types, frequencies, and power levels in use as well as coverage objectives as mentioned above. 3. The site must be able to be leased, permitted, constructed, and be served by power and telephone. There must be a willing landlord. There must be physical room available on the site for the radio equipment and cabling either as space within an existing building or a vacant area for which a shelter can be permitted. 0 0 There must be space for the antennas on the rooftop, on an existing tower, or as a vacant area permitable for a tower. An existing tower and its foundation must have the structural ability to support a second carrier's platform and required height. Lattice towers and guyed towers lend themselves to multiple carrier uses much better than monopoles because of their structural design and higher weight bearing capacity. Generally, existing monopoles have not been designed to support more than two platforms with their attendant antennas and microwave dishes. For a new tower, the vacant area must be (a) large enough for the tower foundation and (b) large enough to provide sufficient separation between any existing antenna systems. The ground must be able to bear a foundation depth generally 1/3 the height of the monopole 4. The first carrier will build the tower and place the antennas to meet its own design characteristics. A second carrier will analyze the tower, its location, its structure, the available space on the tower, the proximity of the radio equipment space as well as the interference and intermodulation issues in order to determine the placement of the antennas. In mature systems such as San Diego, each additional set of antennas must be placed at a height which is compatible with the rest of the network. Antennas placed too high can be as ineffective as antennas placed too low. None of these conditions can be observed in isolation; each interacts with the others. A change in an attribute will change other attributes. The existing cellular facility is sixty feet tall. In order to colocate on the existing tower, the overall height of the tower would have to be raised by fifteen feet to an overall height of seventy five (75) feet. The difference in height allows for diversity for the frequencies to eliminate interference as well as creating a safe area for technicians to work on each carrier's antennas without closing down both systems. Benefits to the City of Palm Springs Enhanced Specialized Mobile Radio (ESMR) offers improved voice quality and consistency. ESMR conversations are sharp and clear, free from the cross-talk. There is less static, less fading. Additionally, because a digital system can accommodate more voices and data traffic than an analog system, there are fewer incomplete and dropped calls. ESMR provides emergency contact to 911; has authorization to provide emergency services during periods in which normal communications facilities are disrupted as a result of hurricane, flood, earthquake, or similar disaster; and is authorized to transmit communications necessary for the implementation of civil defense activities as assigned by local civil defense authorities. 3 � a� 3�3d ESMR eliminates the need for separate paging and interconnect devices. Furthermore, because digital is also the medium of data transmission, the service will include data services as well-- all in the same lightweight handset. ESMR provides secure lines of communication. This digital signal is not scannable and would require extensive allocation of resources to unscramble or decode. This is important to emergency personnel as well as individuals. ESMR provides a more efficient use of a finite natural resource. Nearly every radio use is at capacity, requiring operators to request more spectrum. Nextel is making multiple use of already allocated frequencies by increasing the capacity of each signal through code division multiple access. Summary The proposed application by Nextel Communications Inc. for a wireless telecommunication facility is in compliance with the Palm Springs Zoning Code and the development standards of the commercial zone. Based upon a review ofthe Federal Emergency Management Agency,Preliminary Flood Insurance Rates Maps(Community Panel No.060257 0007C),and the knowledge of the Department of Planning and Building and the City Engineer, the site is within a"Al"flood zone area,where there is a flood hazard on-site during the 100 year flood event. However,due to the nature of the project and its location,butthe project,which entails the installation of an unmanned commercial communications antenna will not alter the existing on-site flood potential or expose any additional persons to potential flood hazards, create a change in the course or direction of water movements,the quantity of ground waters or after the flow of ground water. There are no wells on the subject site The site is located west of the Whitewater River channel.Therefore,the project will not be impacted by water and flood related issues nor create impacts on water related issues. 5. This statement acknowledges that it is not feasible to reduce City-wide growth related impacts to air quality to a level of insignificance at this time. Additionally, due to the relatively small size of the overall project in regional context and the projected number of employees and patrons at any one time should not have a significant impact on the surrounding area.The project will also be consistent with the South Coast Air Quality Management District(SCAQMD)CEQA Air QualityHandbook. However,due to project construction and grading activities,short term impacts to air quality could occur Theprolect will thus need to comply with the City's Fugitive Dust and Erosion Control Ordinance.Therefore,short term impacts(PM70 related) will be mitigated to a level of insignificance. 5.b)-d). The proposed cormnercial communications antenna is in dne immediate vicinity of the traffic pattern for Palm Springs International Airport,especially,the base acid final leg approaches to runway 13L. The Federal Aviation Administration (FAA) has determined that the proposed structure is not an obstruction. However, staff has consulted with the office of the Director of Aviation for the Patin Springs International Airport. This office has stated that the FAA's ruling does not mean that the new structure is not ahazard,it simply means that the tower does not penetrate airspace around the airport. The office of the Director of Aviation feels that the location of the tower poses a greater hazard than if the tower were installed at a greater distance from the airport traffic pattern. As stated earlier,there is a 60-foot tall commercial communications antenna structure approximately 130 from the proposed antenna. If the new antenna were to be installed,it is the opinion of the Director of Aviation that the antennae should be clustered,marked and 3648/ Potentially Significant Potentially Unless Less Than No Significant Mitigation Significant Impact Impact Incorporated Impact identified to be easily recognizable to a particular area. By clustering,the antenna structures could be easier to identify on aeronautical charts. In the opinion of the office of the Director of Aviation, the proposed 130-foot separation meets the intent of clustering the antennae,but the close the antennae can be clustered,the better,understanding there are separation requirements for the antennae and lease limits that come into play. The applicant will be required to work with the property owner,the lessee of the adjacent commercial communications antenna and staff to determine of the antenna can be"clustered"to a greater extent within the leased area. Therefore, in the opinion of staff,the potential hazard issue has been mitigated to a level of insignificance and staff will continue to work with the applicant to install the antenna in an even more clustered location if feasible. 7. According to the General Plan,the site would be in allo Fire Risk area. The proposed project will not create any possible interference with an emergency response plan and will not create any health hazard. Therefore,this project will not result in a risk,nor create any health hazards,nor expose people to potential health hazards. 10. Vista Chino and Gene Autry Trail are designated as scenic corridors pursuant to the General Plan Land Use Map. Objectives arid policies set forth in the General Plan regarding Scenic Corridors include but are not limited to the enhancement of visual amenities of local and regional highway travel,the encouragement of landscape medians,the construction of bike trail links,etc.Given the close proximity of the existing and proposed lowers to each other,the close proximity and visibility of the new structure to Vista Chino and Gene Autry Trail,and the relatively undisturbed scenic quality of the surrounding desert in the area,it is staffs opinion that the additional visual clutter could have a negative aesthetic impact in the immediate area. Within the immediate area,numerous overhead power lines exist at a height very similar or slightly taller than the 60-foot tall structure proposed under this application. The power poles are in addition to the existing commercial communications antenna on the property In addition,there are several manufacturing uses and an electrical plant within the immediate vicinity. The applicant has prepared a series of photo simulations of the antenna and how it would appear in the current visual environment surrounding the site. These simulations clearly represent the existing visual"clutter"in the immediate area,including many overhead power poles,billboards and the electrical substation,all readily visible from Vista Chino and Gene Autry Trail. To minimize the number oftall structures in the immediate area,staff has discussed the possibility of co-location to the existing monopole on the property with the applicant According to the applicant,the overall height of the existing monopole structure would have to be raised a minimum of 15 feet (to an overall height of approximately 75 feet), for a co-location to occur in this situation to avoid interference between users. Nextel operates at a frequency where a height of 60 feet would be the minimum acceptable for coverage in this situation. In consulting with the office of the Director of Aviation,raising the height of the existing monopole structure on the property to 75 feet would present an equal or potentially greater impact to the general aviation flight pattern than the proposed scenario of two 60-foot tall structures on the property separated by approximately 130 feet,previously referenced in Section 6(Traffic and Circulation). Within manufacturing zones, more than one commercial communications antenna could be permitted subject to consideration of a Conditional Use Permit by the Planning Commission and City Council. Based on the above facts, it is staffs opinion that the proposed 60-foot tall commercial communications antenna structure would not significantly impact the existing visual environment and the overall aesthetics of the immediate area. However,to insure that the,the following mitigation measures are recommended: 348Saeon Potentially M86 Significant Potentially Unless Less Than No Significant Mitigation Significant Impact Impact Incorporated Impact Mitigation Measures: 1 The final color and finish treatment of the monopole and antennae shall be submitted for review and approval of the Director of Planning and Building prior to the issuance of building permits. A light gray matte paint or light gray matte final finish treatment shall be used. The color shall blend and disappear into the sky and natural surroundings as much as possible to reduce the visual impacts of the structures. The color shall be used on the monopole and antennae. A color sample meeting this criteria shall be submitted for review and approval of the Director of Planning and Building prior to installation of the antennae and monopole. 2. Additional landscaping at key visual locations where transmission would not be impacted shall be provided to further screen the communications antennae,to the satisfaction of the Director of Planning and Building. 3. Additional landscaping and a permanent irrigation system shall be provided to soften the perimeter of the of the enclosed area,to the satisfaction of the Director of Planning and Building. 4. If the communications antennae or monopole are ever proposed to be modified in any manner such as the inclusion of other antennae, satellite dishes and/or other support equipment,the proposed modifications shall be submitted to the Director ofPlamning and Building for review and approval prior to installation. 5. If the technology regarding the communications antennae changes in where the antennae as approved become obsolete,then the antennae shall be removed. 6. If the antennae and/or monopole are ever abandoned or if the Conditional Use Permit ever expires,the monopole and antennae shall be removed within 30 days. 13. c) NO IMPACT.The project does not contemplate any additional lighting on the property. Therefore,no impacts from light and glare are anticipated. 14. NO IMPACT. As per the zoning Ordinance Section 9402.00,the project is being processed as a Conditional Use Permit. As part of the Conditional Use Permit process, all property owners within a 400 foot radius will be notified of the public hearing for the Conditional Use Permit,which will require consideration by the City's Planning Commission and City Council. Thus,in thejudgment of the Department of Planing and Building,the project is not lanown to be environmentally controversial,nor is it reasonably expected to become controversial upon disclosure to the public. 17. Evans Date Director of Planning & Building Draft Planning Commission Minutes October 27, 1999 CASE 5.0818-CUP - Application by NEXTEL COMMUNICATIONS, INC. for the installation of a commercial communications antenna on a 60-foot tall monopole and a 200-square foot equipment shelter on a 1.53-acre parcel located at 2050 Executive Way, W-M-1-P Zone, Section 6. The site currently contains a 6,160-square foot office/warehouse building and a commercial communications antenna on a 60-foot tall monopole approximately 130 feet south of the proposed communications antenna. The applicant is leasing approximately 1,290 square feet of the site from the current property owner for their communications facility. This action is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per Section 15303 (New Construction or Conversion of Small Structures) Steve Hayes, Principal Planner, reviewed thestaff reportand exhibits, noting othersites where Nextel has antennas and stated that they want to expand within the Coachella Valley, with 10 sites either existing or contemplated in the western half; that the additional height is needed as the facilities operate on line-of-sight; that the proposed area will be secured by 6-foot high chainlink fence with barbed wire on top and a building on the property for internal operations; that the area to the south and east of the site is industrial and primarily undeveloped, with open desert vistas along Gene Autry Trail and Vista Chino; that he feels this would have a negative aesthetic impact to the area and has discussed this concern with applicant, along with possible co- location of this antenna array on the existing antenna on the property. Nextel feels that their antenna would have to be placed higher than the existing, and staff is concerned that the required height of 75 feet would have a potential impact on the operations of the airport. The Director of Aviation indicated their concern with either the 60 or 75- foot tall monopole. Nextel has approval for the 60-foot antenna through the FAA, and would have to go through a separate process for a taller structure. Staff recommends that applicant pursue an alternative that minimizes the aesthetic concerns and impact to the airport and that the Planning Commission direct staff to prepare an environmental assessment in compliance with CEQA that addresses potential concerns. He further stated that staff has prepared a resolution of denial, with one of the findings referring to the Community Design Element of the General Plan which includes siting and designing electrical communications facilities in a manner that minimizes visual impacts along scenic roadway corridors. Staff presented photographic simulations of existing and proposed antennas in relationship to surroundings submitted by applicant,and recommended thatthis application be denied subject to the findings in the staff report. Commissioner Matthews left the meeting. �� �� 31#%0 Draft Planning Commission Minutes October 27, 1999 CASE 5.0818-CUP - NEXTEL COMMUNICATIONS, INC. Cont'd Planning Commissioners concerns included: alternative solutions, visual obstruction and comparison with existing structures and utility poles. In response to Commissioners'questions, staff stated that the existing monopole on the property was approved in March 1997; that applicant feels this is the most viable location from a coverage standpoint to connect with existing and proposed antenna arrays; that the photo simulations are intended to show existing and proposed monopoles and existing surroundings(landscape, mountain views,and existing above- ground utility structures); that the Director of Aviation would prefer minimizing any potential obstruction; that the proposed site is in fairly close proximity to the flight pattern typically used by smaller aircraft, and there could be a potential obstruction, and noted the crash of a small aircraft within the last year approximately 1/4 mile from proposed site; that M-1 zone allows (through Conditional Use Permit) more than one communications antenna on a property with site specific conditions. Public Hearing opened. Barbara Saito, representing Nextel Communications, stated that they had submitted a substantial amount of information in written form to staff and Planning Commissioners, and responded to comments that have been made, stating that the proposed area is open (flood control channel and a lot of undeveloped property);that regarding optional sites, the nearest tall building is the Bird Center and they would have to add another 15-20 feet to the top of the building with an architectural feature to get coverage; that they chose subject location on the advice of their engineers (their first choice is always to place on an existing building); that they did not think the height would be an issue because there is an existing 60-foot monopole, with power poles of approximately the same height; that the area is not in the flight pattern of the airport--would be pilot error or rogue pilot; that moving farther south would be closer to the airport, requiring reduced height; that with the setbacks from Gene Autry Trail and Vista Chino there would not be a significant impact when considering the existing utility poles; that they are willing to use a palm tree or lattice tower design, if desired; that they determined that co-location on the existing pole would not work; and submitted letters of support from some of their users. Ralph Coomber, owner of subject property, stated that one of his tenants, a Mr. Miller, had to leave the hearing and requested that he (Coomber) speak on his behalf. Mr. Coomber stated that Mr. Miller has landscape consultants; that he looks directly out at the AT&T tower and to him it is not unsightly; that he (Miller) is with Nextel and has difficulty in working with his personnel because reception is poor. Mr. Coomber further stated that this is M-1 zone and is the most appropriate area; that he counted over 40 power poles in the wash area and they appear to be much taller than the Draft Planning Commission Minutes October 27, 1999 CASE 5.0818-CUP - NEXTEL COMMUNICATIONS, INC: Cont'd proposed 60-foot tower; that there are also much taller poles on Gene Autry Trail from Vista Chino to the freeway; that view from the homes from the west side of Vista Chino is obstructed due to height of the road; that a previous comment by staff needs to be corrected to say to the "north and east" as being undeveloped, and described surrounding buildings and businesses to the south. He further stated that he has had subject property since 1986 and has never seen an airplane fly over the building, as they fly out and around; that he saw the plane that crashed this year, and the pilot had tried to land it in the wash and the tail of the airplane hit the power line, and he does not feel there is a problem with air traffic in this location. There being no further appearances, the Public Hearing was closed. Commissioner Klatchko stated that the City allowed a 60-foot pole in this location 2- 1/2 years ago and that the scenic vistas are already cluttered due to the other poles in the area, and he does not have a problem with two poles on the property. Barbara Saito responded that the issues are: radio frequency interference between the two carriers, and explained the need for separation of the sets of antennas; safety for the engineers who maintain the antennas; and that AT&T requirement is 15-foot separation due to the interference. She stated that they would prefer to locate at 75 feet which would require a variance and FAA clearance, but the airport might have strong objections; that 60 feet works minimally for them; that their leases typically are for 30 years, in 5-year increments, with removal clauses at the end of the term. She explained technical reasons why the antennas could not be clustered in one location and problems associated with co-location. Chairman Mills stated that in the existing facility substantial changes were made in the overall building and landscaping, and he wants to make sure this is dealt with, and suggested the applicant present a landscape plan with no barbed wire or chainlink fence He further stated his concern that even though there are a lot of poles in the area, this would set a precedent for additional poles (on property where a single pole now exists) in other areas of the city; that the intent is not to develop a "pole farm", and he is not in support of this application; that in another 30 years the existing power poles will probably be underground, possibly leaving communications towers. Steve Hayes, Principal Planner, gave an overview of the project, stating that this application was previously reviewed by the Planning Commission at the October 27, 1999 meeting, and at that time the Planning Commission recommended a continuance to allow time to conduct an environmental assessment of the project, specifically focusing on aesthetic issues related to the antenna monopole structure at the proposed location, and also any impacts the project would have on the operations of Palm Springs International Airport; that an environmental assessment revealed that the antenna is in the immediate vicinity ofthetraveling pattern of runway 13-L, which is the private, small plane runway, and could have a potential impact on the base and final leg approaches on that runway. The FAA determined that, based on their criteria, this structure does not constitute an obstruction; however, staff consulted with the Director of Aviation's office, who determined that even though the FAA stated it is not a hazard, (which means that it does not penetrate the airspace of the airport), the office of the Director of Aviation did feel that there could be a hazard, but since there is an existing antenna structure 130 feet from the proposed structure, in addition to the numerous power poles in the area, that if the poles were to be clustered and identified, it would not constitute a significant hazard. This location meets the definition of clustering, but it would be better to locate the structures closer, if possible. Staff recommends the open-ended condition that if it is possible to cluster the antennas closer, all parties involved could potentially pursue that; however, it is acceptable to the Office of the Director of Aviation as it is now. Hayes further stated that the second issue in the environmental assessment was the visual impact; that the antenna is located in an open desert environment where there are a large number of power poles that are approximately the same height as the proposed antenna, and that there is an electrical substation at the intersection of Executive and Vista Chino. Both Gene Autry Trail and Executive Drive are considered scenic corridors in the General Plan, with the intent to provide a visually pleasing environment; that there are also a number of billboards in the vicinity, with no additional impact from this antenna; and that staff recommends approval, noting several letters attached to the staff report from the public in support of this project. (the "applicant") has filed an application with the City pursuant to Section 9402.00 of the Zoning Ordinance for the installation of a Commercial Communications Antenna on a 60-foot tall monopole and a 200 square foot equipment shelter on a 1.53 acre parcel located at 2050 Executive Way, W-M-1-P zone, Section 6; and WHEREAS, on March 19, 1997, the City Council approved Conditional Use Permit No. 5.0734 for a 60-foot tall commercial communications antenna on the property in question, approximately 130 feet south of the proposed antenna; and WHEREAS, on October 27, 1999, a public hearing on the application for Conditional Use PermitNo. 5.0800 was held by the Planning Commission in accordance with applicable law; and WHEREAS, at the October 27, 1999, public hearing, the Planning Commission recommended that the application be removed from the agenda and continued the item to allow for an Environmental Assessment to be completed for the project, with specific concerns related to the potential environmental impacts associated with aesthetics related to the proximity of two scenic corridors (Vista Chino and Gene Autry Trail) and hazards associated with the location of the proposed structure in relation to the flight patterns from the Palm Springs International Airport; and WHEREAS,the applicant has considered co-locating their communications facilities on the existing monopole on the property, but a height increase to a minimum height of 75 feet would be necessary for a co-location to be technically feasible; and WHEREAS,the Federal Aviation Administration(FAA)has detennined that,based on their criteria, the proposed commercial communications antenna structure is not an obstruction (i.e. that the tower does not penetrate airspace around the airport); and WHEREAS, the applicant is proposing to "cluster" the new commercial communications antenna approximately 130 feet from the previously approved and existing commercial communications antenna on the property; and WHEREAS, "clustering" the two antenna structures on the property would make the structures easier to identify on aeronautical charts; and WHEREAS,Vista Chino and Gene Autry Trail are designated as scenic corridors pursuant to the General Plan Land Use Map; and 3 R19723 Page 2 WHEREAS, objectives and policies set forth in the General Plan regarding Scenic Corridors include but are not limited to the enhancement of visual amenities of local and regional Xx highway travel; and WHEREAS, an electrical substation and numerous overhead power lines exist at a height very similar or slightly taller than the 60-foot tall structure proposed under this application in the immediate area of the site and impact the aesthetics of the immediate area; and WHEREAS, notice of public hearing of the Planning Commission of the City of Palm Springs to consider Applicant's application for Conditional Use PermitNo.5.0818 was given in accordance with applicable law; and WHEREAS,on December 22, 1999,a public hearing on the application for Conditional Use PermitNo.5.0818 was held by the Planning Commission in accordance with applicable law; and WHEREAS, on December 22, 1999,the Planning Commission voted 6-0-1 to recommend approval of the application subject to the findings and conditions stated in Resolution No. 4679; and WHEREAS, notice of public hearing of the City Council of the City of Palm Springs to consider Applicant's application for Conditional Use Permit No. 5.0818 was given in accordance with applicable law; and WHEREAS, on January 19, 2000, a public hearing on the application for Conditional Use Permit No. 5.0818 was held by the City Council in accordance with applicable law; and WHEREAS, the proposed Conditional Use Permit, (Case No. 5.0818), is considered a "project"pursuant to the terms of the California Environmental Quality Act("CEQA"),and a Negative Declaration has been prepared for this proj ect and has been distributed for public review and comment in accordance with CEQA; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project,including,but not limited to the staff report, and all written and oral testimony presented. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA,the City Council finds as follows: The final Mitigated Negative Declaration has been completed in compliance with CEQA, the State CEQA Guidelines, and the City's CEQA procedures contained in the City's CEQA Guidelines. The use applied for at the location set forth in the application is properly one for which a conditional use permit is authorized by the City Zoning Ordinance. Pursuant to the Zoning Ordinance, a commercial communications antenna is authorized in the C-1-AA zone pursuant to approval of a Type II Conditional Use Permit. b. The use applied for necessary or desirable for the development of the community, is in harmony with the various elements or objectives of the General Plan, and is not detrimental to existing uses or to future uses specifically permitted in the zone in which the proposed use is to be located. The proposed communications antennae is in harmony with the various elements and objectives of the City of Palm Springs General Plan and is not detrimental to existing uses specifically permitted in the zone in which the proposed use is to be located. c. The site for the intended use is adequate in size and shape to accommodate said use, including yards, setbacks, walls or fences, landscaping and other features required in order to adjust said use to those existing or permitted future uses of the land in the neighborhood. The site for the proposed communications antennae will not have a direct or indirect impact streets and highways and is properly designed in the subject area, with the recommended mitigation measures included in the Environmental Assessment. e. The conditions to be imposed and shown on the approved site plan are deemed necessary to protect the public health, safety and general welfare, including any minor modifications of the zone's property development standards. All proposed conditions of approval are necessary to ensure public health and safety including, but not limited to, the requirements for additional on-site parking and lighting and provision for additional street dedication and revisions to curbs,gutters and sidewalks via covenants recorded against the property. Section 3: Pursuant to Government Code Section 66473.5, the City Council finds that the proposed project and the provisions for its design and improvement are compatible with the objectives,policies,and general land uses and programs provided in the City's General Plan and any applicable specific plan; and Section 4: Pursuant to Government Code Section 65567,the City Council finds that the proposed project and the provisions for its design and improvements are compatible with the objectives,policies and general land use provided in the City's local open space plan; and 30 R19724 3cy Page 4 Section 5: Pursuant to Government Code Section 66474, the City Council finds that with the incorporation of these conditions attached in Exhibit A: a. EXHIBIT A Conditional Use Permit No. 5.0818 Nextel Communications, Inc. 2050 Executive Way January 19, 2000 CONDITIONS OF APPROVAL Before final acceptance of the project,all conditions listed below shall be completed to the satisfaction of the City Engineer, the Director of Planning, the Chief of Police, the Fire Chief or their designee, depending on which department recommended the condition. Any agreements,easements or covenants required to be entered into shall be in a form approved by the City Attorney. 1. The proposed development of the premises shall conform to all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other City Codes, ordinances and resolutions which supplement the zoning district regulations. Ia. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers,and employees from any claim,action,or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside,void or amnxl, an approval of the City of Palm Springs,its legislative body, advisory agencies,or administrative officers concerning Case 5.0818. The City of Palm Springs will promptly notify the applicant of any such claim, action, or proceeding against the City of Palm Springs and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance fiunds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim,action or proceeding or fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Pursuant to Fish and Game Code Section 711.4 a filing fee of $78.00 is required. This project has a de minimus impact on fish and wildlife, and a Certificate of Fee Exemption shall be completed by the City and two copies filed with the County Clerk. This application shall not be final until such fee is paid and the Certificate of Fee Exemption is filed. Fee shall in the form of a money order or cashier's check payable to Riverside County. 3. The mitigation measures of the environmental assessment shall apply. The applicant shall submit a signed agreement that the mitigation measures outlined as part of the negative declaration or EIR will be included in the plans prior to Planning Commission consideration of the environmental assessment. Extensions of time may be granted by the Planning Commission upon demonstration of good cause. 5. If the communications antennae or monopole are ever proposed to be modified in any manner such as the inclusion of other antennae, satellite dishes and/or other support equipment, the proposed modifications shall be submitted to the Director of Planning and Building for review and approval prior to installation. 6. If the technology regarding the communications antennae changes in where the antemiae as approved become obsolete,then the antennae shall be removed. 7. If the use of the subject property is ever changed, the City reserves the right to modify or revoke this Conditional Use Permit application. 8. The maximum height of the commercial communications antenna and monopole structure shall be 60 feet, as indicated on the conceptually approved plans, as measured from finished grade to the highest point of the antenna. 9. If the antemiae and/or monopole are ever abandoned or if this application ever expires, the monopole and antennae shall be removed within 30 days. 10. Manufacturer's cut sheets of the proposed antennae shall be submitted to the Director of Planning and Building prior to the issuance of permits for installation of the commercial communications antennae. 11. The final color and finish treatment of the monopole and antennae shall be submitted for review and approval of the Director of Planning and Building prior to the issuance of building permits. A light gray matte paint or light gray matte final finish treatment shall be used,unless an alternative treatment is required by the Federal Aviation Administration. The color shall blend and disappear into the sky and natural surroundings as much as possible to reduce the visual impacts of the structures. The color shall be used on the monopole and antermae. A color sample meeting this criteria shall be submitted for review and approval of the Director of Planning and Building prior to installation of the antennae and monopole. 12. This project shall be subject to Chapters 2.24 and 3.37 of the Municipal Code regarding public art. The project shall either provide public art or payment of an in lieu fee. In the case of the in-lieu fee, the fee shall be based upon the total building permit valuation as calculated pursuant to the valuation table in the Uniform Building Code, the feeing being 1/2% for commercial projects or 1/4% for residential projects with first $100,000 of total building permit valuation for individual single-family units exempt. Should the public art be located on the project site, said location shall be reviewed and approved by the Director of Planning and Building and the Public Arts Commission,and the property owner shall enter into a recorded agreement to maintain the art work and protect the public rights of access and viewing. 13. The applicant shall comply with the recommendations of the Federal Aviation Administration. Proof of compliance shall be provided from the Director of Aviation to the Director of Planning and Building prior to the issuance of building permits. 14. Additional landscaping at key visual locations where transmission would not be impacted shall be provided to further screen the communications antemiae, to the satisfaction of the Director of Planning and Building. 15. The applicant shall work with the property owner, the lessee of the adjacent commercial communications antenna and staff to determine if the antenna can be clustered to a greater extent within the applicants leased area and marked to the satisfaction of the Director of Aviation and the Director of Planning and Building. 17. An alternative screening material, such as wrought iron with attached perforated metal or a solid decorative block wall shall be provided. Barbed wire shall be eliminated around the perimeter of the facility.
