RECOMMENDATION:
The Planning Commission recommends that the City Council approve Tentative Parcel Map
No. 28951, for a proposed two-lot subdivision as described above, subject to conditions
contained in the attached Resolution. The applicants are Maurice Monnig and Don Young
of Brentwood Retirement Communities, Inc.
BACKGROUND:
The proposed Tentative Parcel Map entails the subdivision of an 4.38 acre parcel for the
purpose of creating two parcels of approximately 2.19 acres each on vacant property located
on the north side of Baristo Road, on the south side of Arenas Road,approximately 330 feet
east of Avenida Caballeros. The purpose of the Tentative Parcel Map is described in the
applicant's letter, attached hereto.
On May 26, 1999, the Planning Commission unanimously approved a Type I Conditional
Use Permit(CUP No. 5.0785) subject to conditions. The approved Conditional Use Permit
included conceptual plans for the development of a senior citizen assisted living facility
consisting of five residential buildings totaling 85,220 square feet and a 4,644 square foot
community building on the 4.38 acre site. Each residential building contains 24 rooms, for
a total of 120 residential units, with a proposed maximum of 172 residents/beds within the
facility. Action of this type of Conditional Use Permit is final with the Plaiming
Commission.
ANALYSIS:
Early in the review process, staff expressed concerns to the applicant regarding the
subdivision and its potential impact to the integrated project if one of the lots were sold to
a different entity. The developer has responded to this concern by preparing a Declaration
of Covenants, Conditions, Restrictions and Easements (C, C & R's) for the Palm Springs
Gardens Retirement Community project that directly address this concern. In summary,the
C, C & R's will establish reciprocal access rights, requirements for property maintenance,
and provisions regarding future sales of parcels, specifically how each owner is bound to
operate and maintain the project as one entity. Also, the C, C, & R's reference that the
provisions included therein are binding,unless otherwise modified with City consent in the
future. The applicant has also worked with staff to adjust building footprint locations to
meet setback requirements from new property lines established in the Uniform Building
Code. These footprint modifications are very minor and substantially conforms to the
conceptual site plan approved during the Conditional Use Permit process. In staff s opinion,
with the assurances for an integrated development in perpetuity that are proposed by the
developer through the Covenants, Conditions, Restrictions and Easements for the project,

the proposed subdivision should not create any substandard development conditions as it
relates to the development ofthe assisted living facility. Vehicular and pedestrian access will
not be limited by the subdivision of land in the manner proposed with the Tentative Parcel
Map.
ENVIRONMENTAL ASSESSMENT AND NOTIFICATION:
This action is categorically exempt from the provisions of the California Environmental
Quality Act(CEQA)per Section 15315(Minor Land Divisions). A detailed Enviromnental
Assessment for Conditional Use Permit 5.0785 was considered by the Planning Commission
at the May 26, 1999 public hearing and issuance of a Mitigated Negative Declaration was
recommended by the Commission. No modifications are proposed in conjunction with the
Tentative Parcel Map that would alter this recommendation.
All property owners within a 400 foot radius of the parcel considered for subdivision have
been notified of this public hearing. As of the writing of this report,one letter opposition has
been received regarding this request, which has been attached for reference.
PLANNING COMMISSION ACTION:
On December 8, 1999, the Planning Commission held a public hearing regarding the
proposed Tentative Parcel Map and voted 5-1-1 (Caffery dissented)to recommend approval
of the subdivision map subject to conditions. There was considerable discussion regarding
the phasing of the development of the project, guarantees for maintenance of the lot that
would not be a part of the initial phase and assurances that the approved assisted living
project will be operated as one integrated entity in perpetuity. These issues have or will be
addressed through the recommended conditions of approval and/or the Covenants,
Conditions and Restrictions (C,C &R's) for the subdivision.

NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Palm Springs,
California, will hold a public hearing at its meeting of December 8, 1999. The Planning
Commission meeting begins at 1:30 p.m. (public hearings begin at 2:00 p.m.) in the Council
Chambers at City Hall, 3200 E. Tahquitz Canyon Way, Palm Springs.
The purpose of the hearing is to consider a Tentative Parcel Map application by Brentwood Homes,
Inc. for a proposed subdivision of a 4.38 acre parcel into two lots of 2.19 acres each. The purpose
of the Tentative Parcel Map is to allow the developer to phase the development of the project
consistent with the approved phasing plan for the project. The site is located at 1050 Baristo Road,
approximately 330 feet east of Avenida Caballeros on the north side of Baristo Road, R-4 Zone,
Section 14. The site is currently vacant with and covered with native scrub vegetation.
Related to the proposed subdivision is Conditional Use Permit 5.0785, which was approved
unanimously by the Planning Commission on May 26, 1999. The approved Conditional Use Permit
included conceptual plans for the development of a senior citizen assisted living facility consisting
of five residential buildings totaling 85,220 square feet and a 4,644 square foot community building
on the 4.38 acre site. Each residential building contains 24 rooms, for a total of 120 residential
units, with a proposed maximum of 172 residents/beds within the facility.
This action is categorically exempt from the provisions of the California Environmental Quality Act
(CEQA) per Section 15315 (Minor Land Divisions).
If any individual or group challenges the action in court, issues raised may be limited to only those
issues raised at the public hearing described in this notice or in written correspondence at or prior
to the Planning Commission hearing.
An opportunity will be given at said hearing for all interested persons to be heard. Questions

Responding to your letter of September 3, 1999:
You will recall that we discussed our intention to phase the construction of our senior care facility on the
subject property during the processing of the CUP.`his approach allows for market absorption,which was
a major concern expressed by the City during the processing of our application,and is consistent with our
business plan for development of senior facilities in other x in:unrties.flux plan is to complete the two
residential buildings and the office I administration building on the eastern lot as phase one. One residential
building will be dedicated to Alzheimer care and the other to Assisted Living.The remaining residential
buildings will be completed as they arc needed
A construction loan for the first phase,as described above,will be in place shortly.When completed the
first phase will be refmant:ed with a permanent loan using only those buildings on the first parcel and the.
land included in the first parcel as collateral.This will leave the second parcel unencumbered and available
for use as collateral for the construction loan to build-..,be next residential building.This would not be the
case if the property remains as one legal parcel.While it would be ideal to have each building on its own
separate lot, we understand this is impossible because of minimum lot size requirements.However splitting
the cxisiing parcel as we are proposing still makes it possible to finance the project as described above and
aids greatly in our ability to phase the project.
We propose to deal with the problems that may arise in the unlikely event of separate ownership by
recording CC&Rs concurrently with the new parcel map,This document will deal with the concerns
expressed in your letter as well as those of mortgage holders andproperty owners.Enclosed herewith is a
draft of a document we would propose to use for this purpose.
With regard to inconsistencies between the proposed lot lines and the approved phasing plain
The first phase as described above may include both one and two of the approved phasing plan,however
they are both on the eastern most lot.The site improvements included in these phases do involve both lots
but this;will not present a problem for our lenders and i am not aware of why this would be a problem for
the City. In any case we do intend to adhere to the phasing plan as approved by the Planning Commission.

staff will communicate specifics to Cathedral City staff.

citizen assisted living facility consisting of 4 residential buildings (24 rooms each-total of
85,220 square feet) and a community building (4,644 square feet)-Conditional Use Permit

This project is categorically exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15315 (Minor Land Divisions).
Steve Hayes gave an overview of the project, and stated that the application is for a
tentative parcel map to split a previously approved assisted living facility project into two
parcels,primarily for financing purposes;and that the parcels will consist of 2.19 acres each.
He stated that the site plan is consistent with the plan approved by the Commission on May
26, 1999,with the only changes being to meet the building setbacks from the new property
line as required by the Uniform Building Code. He stated that staff s primary concern was
that the project be operated as one entity in perpetuity;that the applicant has proposed a set
of CC&Rs to ensure its maintenance and operation as one integrated project for the life of
the project; and that staff recommends approval. Y9 7

In response to questions by Commissioners, Hayes stated that the phasing is not affected;
that the intent is to do the community building and two adjacent buildings as Phase I, when
the other three buildings as Phase II; that the CC&Rs will require reciprocal access and
parking agreements and will be operated as one entity; and that all site development items
will stay the same as they were on phasing.
Public Hearing opened; there being no appearances, the hearing was closed.
Commissioners' comments included: that the CC&Rs are critical and require careful
scrutiny; that this was approved as one project and there is a potential to get partially
through the project and leave a long,irregular lot;that there is the possibility of incomplete
on-site improvements; and that method of financing is out of the realm of Commission
responsibilities.
Don Young, applicant, stated that the phasing of this project will be completed as market
demand for additional beds occurs,and they do not want to encumber one large loan initially;
that the proposed lot split is for financing purposes only(they own the property and want to
keep one parcel free of financing),and they will tie it all together;and that the fire lanes,etc.,
have all been addressed. He further stated that if they sold one-half,that the CC&Rs would
require the buyer to proceed according to the original plan.
Commissioner Caffery stated that it would be more logical to have the pads available for the
other three buildings and not build them until later, and questions the need for the lot split
for financing purposes.
Discussion followed,and staff responded to comments and stated that sidewalks for Phases
I and II are now incorporated in Phase I; that the entire site is being graded and a
combination of soil sealant and hydroseed with irrigation system is being required, which
would become responsibility of the new owner if this parcel is sold separately.
Director said that it is the same as many shopping centers in town, which have similar a
situation as that being proposed; that this is not an unusual financing mechanism; that the
Commission could add conditions to ensure that parcels are connected and will be
maintained; that staff foresees a good market for this operation; that the majority of the

City's concerns have been addressed by the Conditional Use Permit; and that the
Commission can state that they want the CC&Rs completely resolved before the application
goes to City Council.

CASE 5.0805 - PD 255 - Application by GARDEN SPRINGS APARTMENTS by CBM
GROUP, INC. for a Preliminary Plamied Development District for a 60-unit low and
moderate income residential apartment project on a 3.63-acre parcel located attlic southeast
corner of Indian Canyon Drive and San Rafael Drive, R-2 Zone, Section:
Commission response to written comments on Draft Negative Declaration; action.
Steve Hayes, Principal Planner, gave an overview of,tlie application for a Planned
Development District for a 60-unit very low and low income residential apartment project
at the southeast corner of Indian Canyon Drive and/San Rafael Drive, and stated that the
proposed unit sizes range from two to four bedrooms,with the smallest two bedroom traits
consisting of approximately 904 square feet,,and the largest four-bedroom unit consisting of
approximately 1,403 square feet. The project consists of 28,two-bedroom units; 24,three-
bedroom units; and 8, four-bedroom4nits, and the 60 units will be contained in four, two-
story buildings, with each building ranging from 12 to 16 units each. In conjunction with
the Architectural Review for/the project, a Preliminary Planned Development District
application has been submitted to specifically address three development standards within
the R-2 zone (per the staff report), and that the application contemplates a density bomis for
low and moderateiineome housing pursuant to the provisions of Section 65915 of the
California Govefmment Code and under California State Law, a density bonus must be
granted if the project is guaranteed to be used for low and moderate income housing for a
specified period of time. Final development plans will be required to be reviewed by the
Plaiming Commission if and after the Planned Development District is approved by City
Council (within two years of approval of the Preliminary Planned Development District);
and it is the intent of the developer to construct the entire project in one phase.

CONDITIONS OF APPROVAL
Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction
of the City Engineer, the Director of Planning, the Chief of Police, the Fire Chief or their designee,
depending on which department recommended the condition.
Any agreements, easements or covenants required to be entered into shall be in a form approved by
the City Attorney.
ENGINEERING:
The Engineering Division recommends that if this application is approved, such approval is subject to
the following conditions being completed in compliance with City standards and ordinances:
Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction
of the City Engineer.
STREETS
1. Any improvements within the street right-of-way require a City of Pahn Springs
Encroachment Permit. Work shall be allowed according to Resolution 17950 -
Restricting Street Work on Major and Secondary Thoroughfares.
2. Submit street improvement plans prepared by a Registered Civil Engineer to the
Engineering Division. The plan(s) shall be approved by the City Engineer prior to
issuance of any grading or building permits.
Minimum submittal shall include the following, IF applicable:
A. Copy of signed Conditions of Approval from Planning Department.
B. All agreements and improvement plans approved by City Engineer, IF
applicable.
C. Proof of processing dedications of right-of-way, easements, encroachment
agreements/licenses,covenants,reimbursement agreements,etc. required by
these conditions.
ARENAS ROAD EAST
3. Dedicate an additional right-of-way to provide the ultimate half street width of 40
feet along the entire frontage of the subject property in accordance with City of Palm
Springs Standard Drawing No. 105.
4. Construct a 6 inch curb and gutter, 32 feet SOUTH of centerline along the entire
frontage of the subject property per City of Palm Springs Standard Drawing No.
200.
5. Construct a minimum 8 foot wide sidewalk behind the curb along the entire frontage
in accordance with City of Palm Springs Standard Drawing No. 210.
6. The driveway approach shall be constructed in accordance with City of Palm
Springs Standard Drawing No. 201 and have minimum width of 24 feet.
7. Remove and replace existing pavement with a minimum pavement section of 3 inch
asphalt concrete pavement over 6 inch aggregate base with a minimum subgrade of
24 inches at 95% relative compaction, OR equal, from edge of proposed/existing
gutter to centerline along the entire frontage in accordance with City of Palm
Springs Standard Drawing No. 110 AND 325. The pavement section shall be
designed, using "R" values, by a licensed Soils Engineer and submitted to the City
Engineer for approval.
BARISTO ROAD EAST
8. Construct a 6 inch curb and gutter, 32 feet NORTH of centerline along the entire
frontage of the subject property per City of Palm Springs Standard Drawing No.
200.
9. The driveway approach shall be constructed in accordance with City of Palm
Springs Standard Drawing No. 201 and have minimum width of 24 feet.
10. Construct a minimum 12-foot wide meandering sidewalk/bikeway behind the curb
along the entire frontage in accordance with City of Palm Springs Standard Drawing
No. 210. The sidewalk at the west property line shall be designed to line up with
the curb adjacent sidewalk for the existing condominium project to the west.

SANITARY SEWER
12. Connect all sanitary facilities to the City sewer system. Lateral shall not be
connected at manhole.
GRADING
13. A copy of a Title Report prepared/updated within the past 3 months and copies of
record documents shall be submitted to the City Engineer with the first submittal of
the Grading Plan.
14. Submit a Grading Plan prepared by a Registered Professional to the Engineering
Division for plan check. Grading plan shall be submitted to the Planning Department
for comments prior to submittal to the Engineering Division. The Grading Plan shall
be approved by the City Engineer prior to issuance of any grading or building
permits.
Minimum submittal includes the following:
A. Copy of final Planning Department comments.
B. Copy of signed Conditions of Approval from Planning Department.
C. Copy of Site Plan stamped approved and signed by the Planning Department.
D. Copy of Title Report prepared/updated within past 3 months.
E. Copy of Soils Report, IF required by these conditions.
F. Copy of Hydrology Study/Report, IF required by these conditions.
15. Drainage swales shall be provided adjacent to all curbs and sidewalks - 3' wide and
6" deep - to keep nuisance water from entering the public streets, roadways, or
gutters.
16. Developer shall obtain a General Construction Activity Storm Water Permit from
the State Water Resources Control Board (Phone No. (916)-657-0687) and provide
a copy of same, when executed, to the City Engineer prior to issuance of the grading
permit.
17. In accordance with City of Palm Springs Municipal Code, Section 8.50.00, the
developer shall post with the City a cash bond of two thousand dollars ($2,000.00)
per acre for mitigation measures of erosion/blowsand relating to his property and
development.
18. A soils report prepared by a licensed Soils Engineer shall be required for and
incorporated as an integral part of the grading plan for the proposed site. A copy of
the soils report shall be submitted to the Building Department and to the Engineering
Division along with plans, calculations and other information subject to approval by
the City Engineer prior to the issuance of the grading permit.
19. Contact the Building Department to get PM10 requirements prior to
request for grading permit.
DRAINAGE
20. The developer shall accept all flows impinging upon his land and conduct these
flows to an approved drainage structure. On-site retention/detention or other
measures approved by the City Engineer shall be required if off-site facilities are
determined to be unable to handle the increased flows generated by the development
of the site. Provide calculations to determine if the developed Q exceeds the capacity
of the approved drainage carriers.
21. The project is subject to flood control and drainage implementation fees. The
acreage drainage fee at the present time is $9,212.00 per acre per Resolution No.
15189. Fees shall be paid prior to issuance of a building permit.
ON-SITE
22. The minimum pavement section for all on-site streets/parking areas shall be 2-1/2
inch asphalt concrete pavement over 4-inch aggregate base with a minimum
subgrade of 24 inches at 95% relative compaction, OR equal. The pavement section
shall be designed, using "R" values, determined by a licensed Soils Engineer and

23. The on-site parking lot shall be constructed in accordance with City of Palm Springs
Zoning Ordinance, Section 9306.00.
GENERAL
24. Any utility cuts in the existing off-site pavement made by this development shall
receive trench replacement pavement to match existing pavement plus one additional

25. All proposed utility lines on/or adjacent to this project shall be undergrounded prior
to issuance of a Certificate of Occupancy.

proposed service laterals shall be shown from the main line to the property line. The
approved original grading/street plans shall be as-built and returned to the City of
Palm Springs Engineering Division prior to issuance of the certificate of occupancy.
27. The developer is advised to contact all utility purveyors for detailed requirements for
this project at the earliest possible date.
28. Nothing shall be constructed or planted in the corner cut-off area of any driveway
which does or will exceed the height required to maintain an appropriate sight
distance per City of Pahn Springs Standard Drawing No. 203.
29. In accordance with the Section 14 Master Plan, the developer is required to plant
trees as required by said Master Plan approximately 30 feet apart along the entire
frontage of Arenas Road and Baristo Road.
30. All proposed trees within the public right-of-way and within 10 feet of the public
sidewalk and/or curb shall have City approved deep root barriers installed per City
of Palm Springs Engineering specifications.
TRAFFIC
31. The developer shall provide a minimum of 48 inches of sidewalk clearance around
all street furniture, fire hydrants and other above-ground facilities for handicap
accessibility. The developer shall provide same through dedication of additional
right-of-way and widening of the sidewalk or shall be responsible for the relocation
of all existing traffic signal/safety light poles, conduit, pull boxes and all
appurtenances located on the ARENAS ROAD EAST and BARISTO ROAD EAST
frontages of the subject property.
32. Construction signing, lighting and barricading shall be provided for on all projects
as required by City Standards or as directed by the City Engineer. As a minimum,
all construction signing, lighting and barricading shall be in accordance with State of
California, Department of Transportation, "MANUAL OF TRAFFIC
CONTROLS FOR CONSTRUCTION AND MAINTENANCE WORK ZONES"
dated 1990, or subsequent additions in force at the time of construction.
33. This property is subject to the Transportation Uniform Mitigation Fee based on the
RESIDENTIAL- CONGREGATE CARE FACILITY ITE Code B land use.
PLANNING:
34. The proposed development of the premises shall conform to all applicable regulations of the
Palm Springs Zoning Ordinance, Municipal Code, or any other City Codes, ordinances and
resolutions which supplement the zoning district regulations.
34a. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents,
officers, and employees from any claim, action, or proceeding against the City of Palm
Springs or its agents, officers or employees to attach, set aside, void or annul, an approval
of the City of Palm Springs, its legislative body, advisory agencies, or administrative
officers concerning Case 5.0785. The City of Palm Springs will promptly notify the
applicant of any such claim, action, or proceeding against the City of Palm Springs and the
applicant will either undertake defense of the matter and pay the City's associated legal costs
or will advance funds to pay for defense of the matter by the City Attorney. If the City of
Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding
or fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible
to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the
foregoing, the City retains the right to settle or abandon the matter without the applicant's
consent but should it do so, the City shall waive the indemnification herein, except, the
City's decision to settle or abandon a matter following an adverse judgment or failure to
appeal, shall not cause a waiver of the indemnification rights herein.
35. Pursuant to Fish and Game Code Section 711.4 a filing fee of $78.00 is required. This
project has a de minimus impact on fish and wildlife, and a Certificate of Fee Exemption
shall be completed by the City and two copies filed with the County Clerk. This application
shall not be final until such fee is paid and the Certificate of Fee Exemption is filed. Fee
shall in the form of a money order or cashier's check payable to Riverside County.
36. The mitigation measures of the environmental assessment shall apply. The applicant shall
submit a signed agreement that the mitigation measures outlined as part of the negative
declaration or EIR will be included in the plans prior to Planning Commission consideration
of the environmental assessment.
37. Architectural approval shall be valid for a period of two (2)years. Extensions of time may
be granted by the Planning Commission upon demonstration of good cause.
38. Final landscaping, irrigation, exterior lighting, and fencing plans shall be submitted for
approval by the Department of Planning and Building prior to issuance of a building permit.
Landscape plans shall be approved by the Riverside County Agricultural Commissioner's
Office prior to submittal.
39. The project is subject to the City of Palm Springs Water Efficient Landscape Ordinance.
The applicant shall submit an application for Final Landscape Document Package to the

Director of Planning and Building for review and approval prior to the issuance of a
building permit. Refer to Chapter 8.60 of the Municipal Code for specific requirements.
40. Prior to issuance of a grading permit, a Fugitive Dust and Erosion Control Plan shall be
submitted and approved by the Building Official. Refer to Chapter 8.50 of the Municipal
Code for specific requirements.
41. The grading plan shall show the disposition of all cut and fill materials. Limits of site
disturbance shall be shown and all disturbed areas shall be fully restored or landscaped.
42. Drainage swales shall be provided adjacent to all curbs and sidewalks-3' wide and 6" deep.
The irrigation system shall be field tested prior to final approval of the project. Section
14.24.020 of the Municipal Code prohibits nuisance water from entering the public streets,
roadways or gutters.
43. Separate architectural approval and permits shall be required for all signs.
44. All mechanical equipment shall be screened from all possible vantage points both existing
and future per Section 9303.00 of the Zoning Ordinance. The screening shall be considered
as an element of the overall design and must blend with the architectural design of the
building(s).
45. No exterior downspouts shall be permitted on any facade on the proposed building(s) which
are visible from adjacent streets or residential and commercial areas.
46. The design, height, texture and color of building(s), fences and walls shall be submitted for
review and approval prior to issuance of building permits.
47. The street address numbering/lettering shall not exceed eight inches in height.
48. Construction of any residential unit shall meet minimum soundproofing requirements
prescribed pursuant to Section 1092 and related sections of Title 25 of the California
Administrative Code. Compliance shall be demonstrated to the satisfaction of the Director
of Building and Safety.
49. Submit plans meeting City standard for approval on the proposed trash and recyclable
materials enclosure prior to issuance of a building permit.
50. This project shall be subject to Chapters 2.24 and 3.37 of the Municipal Code regarding
public art. The project shall either provide public art or payment of an in lieu fee. In the
case of the in-lieu fee, the fee shall be based upon the total building permit valuation as
calculated pursuant to the valuation table in the Uniform Building Code, the fee being 1/4%
for the first$100,000 of total building permit valuation. Should the public art be located on
the project site, said location shall be reviewed and approved by the Director of Planning
and Building and the Public Arts Commission, and the property owner shall enter into a
recorded agreement to maintain the art work and protect the public rights of access and
viewing.
51. No sirens, outside paging or any type of signalization will be permitted, except approved
alarm systems.
52. No outside storage of any kind shall be permitted except as approved as a part of the
proposed plan.
53. Vehicles associated with the operation of the proposed development including company
vehicles or employees vehicles shall not be permitted to park off the proposed building site
unless a parking management plan has been approved per Section.
54. Prior to the issuance of building permits, locations of all telephone and electrical boxes must
be indicated on the building plans and must be completely screened and located in the
interior of the building. Electrical transformers must be located toward the interior of the
project maintaining a sufficient distance from the frontage(s) of the project. Said
transformer(s) must be adequately and decoratively screened.
55. Due to the nature of the proposed use, the amount of on-site parking shall be reduced to a
maximum of 71 spaces. All removed parking area shall be included into the overall
landscaped area for the site, to the satisfaction of the Director of Planning and Building.
56. Loading space facilities shall be provided in accordance with Section 9307.00 of the Zoning
Ordinance. Said facilities shall be indicated on the site plan and approved prior to issuance
of building permits.
57. Islands of not less than 9 feet in width with a minimum of 6 feet of planter shall be provided
every 10 parking spaces. Additional islands may be necessary to comply with shading
requirements in# 58 below.
58. Shading requirements for parking lot areas as set forth in Section 9306.00 of the Zoning
Ordinance shall be met. Details to be provided with final landscape plan.
59. An exterior lighting plan in accordance with the lighting ordinance in effect at the time shall
be submitted for review and approval by the Director of Planning and Building prior to the
issuance of building permits. A photometric study and manufacturer's cut sheets of all
exterior lighting on the building, in the landscaping, and in the parking lot shall be
submitted for approval prior to issuance of building permit. If lights are proposed to
mounted on buildings, down-lights shall be utilized.
60. Illumination levels in the parking area shall be an average of one-foot candle.
61. Parking lot light fixtures shall align with stall striping and shall be located two to three feet
from curb face.

62. Parking stalls shall be delineated with a 4 to 6 inch double stripe -hairpin or elongated "U"
design. Individual wheel stops shall be prohibited; a continuous 6" barrier curb shall
provide wheel stops.
63. Concrete walks with a minimum width of two (2) feet shall be installed adjacent to end
parking spaces or end spaces shall be increased to eleven (It) feet wide.
64. Tree wells shall be provided within the parking lot and shall have a planting area of six feet
in diameter/width.
65. Standard parking spaces shall be 17 feet deep by 9 feet wide; compact sized spaces shall be
15 feet deep by 8 feet wide. Handicap parking spaces shall be 18 feet deep by 9 feet wide
plus a 5 foot walkway at the right side of the parking space; two (2) handicap spaces can
share a common walkway. One in every eight (8) handicap accessible spaces, but not less
than one (1), shall be served by an 8 foot walkway on the right side and shall be designated
as "van accessible".
66. Handicapped accessibility shall be indicated on the site plan to include the location of
handicapped parking spaces, the main entrance to the proposed structure and the path of
travel to the main entrance. Consideration shall be given to potential difficulties with the
handicapped accessibility to the building due to the future grading plans for the property.
67. Compact and handicapped spaces shall be appropriately marked per Section 9306.00C 10.
68. Curbs shall be installed at a minimum of five (5) feet from face of walls, fences, buildings,
or other structures. Areas that are not part of the maneuvering area shall have curbs placed
at a minimum of two (2) feet from the face of walls, fences or buildings adjoining
driveways.
69. The final design and location of the proposed fencing and pilasters along the perimeter
streets (Baristo Road and Arenas Road) shall be indicated on the detailed
landscape/irrigation plan and be subject to review and approval of the Director of Planning
and Building prior to the issuance of building permits. Pilasters within the fence shall be
designed to be architecturally compatible with the architecture of the buildings, be
substantial in size (24 inches square) and have a decorative cap treatment, to the satisfaction
of the Director of Planning and Building.
70. A 12-foot wide meandering sidewalk/bikeway shall be provided along the Baristo Road
project frontage, consistent with the draft Section 14 Specific Plan. The final design, finish
treatment and location of the sidewalk shall be reviewed and approved by the Director of
Planning and Building prior to the issuance of grading permits. An easement shall be
dedicated for the purpose of allowing the sidewalk/bikeway to meander and shall be
recorded in conjunction with this Conditional Use Permit, to the satisfaction of the City
Engineer.
71. Pursuant to Section 9402.00.H.7.c. of the City of Palm Springs Zoning Ordinance the
applicant shall submit, an annual basis, a copy of the facility's current State license to
determine continued compliance with the adopted conditions of approval for the project.
72. The existing perimeter wall along the west property line of the project area shall be finished
with a decorative treatment on the project side, such as stucco, to be architecturally
compatible with the new buildings, to the satisfaction of the Director of Planning and
Building.
73. A dense landscape palette shall be provided in the landscape areas immediately surrounding
the trash enclosure and loading area, to the satisfaction of the Director of Planning and
Building. In addition, the enclosure structure shall be upgraded architecturally and
structurally integrated with the Community Cottage building, to the satisfaction of the
Director of Planning and Building.
74. A two-piece Spanish Clay tile(random mudded between tiles) shall be used on all buildings.
A material sample of the proposed the shall be submitted for review and approval of the
Director of Planning and Building prior to the issuance of building permits.
75. If any modifications to the phasing of buildings is proposed, a revised phasing plan shall be
submitted for review and approval of the Planning Commission. The phasing plan shall
indicate the interim finish treatments for future building pad areas, which shall include a
dust suppressant, hydroseeding and an automatic irrigation system. Unless approved
otherwise, phasing shall be conducted as reviewed by the Planning Commission in
conjunction with the phasing plan provided by the applicant.
76. Washingtonia Filifera palms shall be used as the palm species in all areas of the site visible
from the perimeter streets, to the satisfaction of the Director of Planning and Building.
77. A material sample of the proposed special paving material shall be submitted for review and
approval of the Director of Planning and Building prior to the issuance of building permits.
78. Catalog cuts or similar details shall be submitted for all common area amenities (i.e.
benches, gazebos, trellises, fountains, etc.) for review and approval of the Director of
Planning and Building prior to the issuance of building permits.
79. The location and depth of the on-site retention basins shall be reviewed and approved by the
Director of Planning and Building and the City Engineer prior to the issuance of grading
permits.

or other like facility, regularly maintained by the Government of the United States in

the Council Chambers at City Hall, 3200 E. Tahquitz Canyon Way, Palm Springs.
The purpose of the hearing is to consider a Tentative Parcel Map application by Brentwood Homes,
Inc. for a proposed subdivision of a 4.38 acre parcel into two lots of 2.19 acres each. The purpose of
the Tentative Parcel Map is to allow the developer to phase the development of the project consistent
with the approved phasing plan for the project. The site is located at 1050 Batiste Road,
approximately 330 feet east of Avenida Caballeros on the north side of Baristo Road, R-4 Zone,
Section 14. The site is currently vacant with and covered with native scrub vegetation.
Related to the proposed subdivision is Conditional Use Permit 5.0785, which was approved
unanimously by the Planning Commission on May 26, 1999. The approved Conditional Use Permit
included conceptual plans for the development of a senior citizen assisted living facility consisting of
five residential buildings totaling 85,220 square feet and a 4,644 square foot community building on
the 4.38 acre site. Each residential building contains 24 rooms, for a total of 120 residential units,
with a proposed maximum of 172 residents/beds within the facility.
This action is categorically exempt from the provisions of the California Environmental Quality Act

ZONE, SECTION 14, AND MAKING FINDINGS IN SUPPORT
THEREOF.

WHEREAS,Mr.Maurice Monnig and Mr.Don Young of Brentwood Retirement Communities (the
"applicant") have filed an application with the City pursuant to Palm Springs Municipal Code
Section 9.60 for a Tentative Parcel Map to subdivide 4.38 acres into two lots of approximately 2.19
acres each located at 1050 Baristo Road, approximately 330 feet east of Avenida Caballeros on the
north side of Baristo Road[, R-4 zone, Section 14;
WHEREAS, the purpose of the tentative parcel map is to facilitate financing for the development
of Phase One of a new residential senior citizen assisted living facility, which consists of five
residential buildings totaling 95,220 square feet and a 4,644 square foot coimnunity building on the
4.38 acre site. Each residential building contains 24 rooms, for a total of 120 residential units,with
a proposed maximum of 172 residents/beds within the facility; and
WHEREAS, the proposed tentative parcel map was submitted to appropriate agencies as required
by the subdivision requirements of the Palm Springs Municipal Code, with the request for their
review, comments and requirements; and
WHEREAS, on December 8, 1999, a public hearing on the application for Tentative Parcel Map
28951 was held by the Planning Commission in accordance with applicable law; and
WHEREAS,on December. 8, 1999,the Planning Commission voted 5-1-1 to recommend approval
of the application to the City Council subject to the findings and conditions stated in Resolution No.
4674; and
WHEREAS,notice of a public hearing of the City Council of the City of Palm Springs to consider
Applicant's application for Tentative Parcel Map No.28951 was given in accordance with applicable
law; and
WHEREAS, on January 19,2000,a public hearing on the application for Tentative Parcel Map No.
28951 was held by the City Council in accordance with applicable law; and
WHEREAS,pursuant to G overmnent Code Section 66452.3,City staff has prepared a written report
with the Planning Commission recommendation that the proposed subdivision,Tentative Parcel Map
No. 28951 be approved, and that a copy of that report was served upon the subdivider at least three
(3) days prior to the aforementioned meeting; and
WHEREAS, pursuant to Government Code Section 66412.3, the City Council has considered the
effect of the proposed Subdivision,Tentative Parcel Map 28951,on the needs of the region in which
Palm Springs is situated and has balanced these needs against the proposed public service needs of

its residents and business.-s and available fiscal and environmental resources; the approval of the
proposed subdivision represents the balance of these respective needs in a manner which is most
consistent with the City's obligation pursuant to its police powers to protect the public health,safety,
and welfare; and
WHEREAS,the proposed subdivision,Tentative Parcel Map No.28951,was reviewed for potential
environmental impacts in conjunction with Conditional Use Permit No. 5.0785, a proposal to
construct a new residential senior citizen assisted living facility,which consists of five residential
buildings totaling 85,220 square feet and a 4,644 square foot community building on the 4.38 acre
site. The related Conditional Use Permit(CUP) is considered a"project" pursuant to the terms of
the California Environmental Quality Act(CEQA);a combined Mitigated Negative Declaration has
been prepared for the applications and has been distributed for public review and comment in
accordance with CEQA; and
WHEREAS,the Planning,Commission has previously reviewed and the City Council has carefully
reviewed and considered all of the evidence presented in connection with the hearing on the project,
including, but not limited to the staff report and all written and oral testimony presented.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA,the City Council finds as follows:
The final combined Mitigated Negative Declaration has been completed in
compliance with CEQA, the State CEQA Guidelines, and the City's CEQA
procedures contained in the City's CEQA Guidelines. The Planning Commission has
previously reviewed and considered the information contained in the Mitigated
Negative Declaration and finds that it adequately discusses any significant
environmental effects of the proposed project,and that,on the basis of the combined
initial study and comments received during the public review process, there is no
substantial evidence that there will be any adverse environmental effects as a result
of the approval of this project. The Planning Commission further found that the
Mitigated Negative Declaration reflects its independent judgment.
Section 2: Pursuant to Government Code Section 66473.5, the City Council finds that the
proposed subdivision and the provisions for its design and improvement are
compatible with the objectives, policies, and general land uses and programs
provided nn the City's General Plan and any applicable specific plan.
The proposed tentative parcel map contemplates a subdivision for financing purposes
to expedite the development of phase one of a residential senior citizen assisted
living facility, which is conditionally permitted in the R-4 zone, per the Zoning
Ordinance. This Conditional Use Permit application was approved by the Planning
Commission on May 26, 1999 on the property contemplated under the proposed
Tentative Parcel Map.
Section 3: Pursuant to Government Code Section 65567, the City Council finds that the
proposed subdivision and the provisions for its design and improvements are
compatib le with the objectives,policies and general land use provided in the City's
local open space plan.
The proposed subdivision and related development of the senior citizen assisted
living facility are in compliance with the open space policies in the General Plan.
Any future development contemplated on the remainder parcel will also be reviewed
for compliance with the General Plan open space objectives and policies.

Section 4: Pursuant to Government Code Section 66474, the City Council finds that with the
incorporation of these conditions attached in Exhibit A:
a. The proposed map is consistent with the applicable general and
specific phis.
b. The design or improvements of the proposed subdivision are
consistent with the General Plan.
c. The site is physically suitable for the type of development
contemplated by the proposed subdivision.
d. The site is physically suitable for the proposed density of
development contemplated by the proposed subdivision.
e. The design of the subdivision or improvements is not likely to
cause substantial environmental damage or substantially and unavoidably injure fish
or wildlife or the habitat.
f. The design of the subdivision or improvements is not likely to
cause serieus public health problems.
g. The design of the subdivision or the type of improvements will not
conflict with easements,acquired by the public at large,for access through or use of
the properly within the proposed subdivision.
Section 5: Pursuant to Government Code Section 66474.6,the City Council has determined that
the discharge of waste from the proposed subdivision into the existing sewer system
will not result in a violation of existing requirements prescribed by the Regional
Water Quality Control Board; and
Section 6: A nexus and rough proportionality have been established for the requirement of the
dedication of the additional right-of-way to the City and the off-site improvements
as related to the tentative parcel map.
The off-site improvements, including, but not limited to, the installation of curb,
gutter and sidewalk on the street frontages of the project,which are required by City
Ordinances, are related to the subdivision and proposed or future contemplated
project thereon. The off-site improvements to be installed adjacent to the
development of the senior citizen assisted living facility will benefit the owners,
residents and surrounding residents in the area such that curbs, gutter and sidewalk
will provide for their safety and aesthetically enhance their property as well as the
surrounding neighborhood.

NOW,THEREFORE,BE IT RESOLVED that,based upon the foregoing,the City Council hereby
approves Tentative Parcel Map No. 28951, subject to those conditions set forth in the Exhibit A,
which are to be satisfied pprior to the issuance of a Certificate of Occupancy unless other specified.

CONDITIONS OF APPROVAL
Before final acceptance of the project,all conditions listed below shall be completed to the satisfaction
of the City Engineer, the Director of Planning, the Chief of Police, the Fire Chief or their designee,
depending on which department recommended the condition.
Any agreements,easements or covenants required to be entered into shall be in a form approved by the
City Attorney.
ENGINEERING:
The Engineering Division recommends that if this application is approved, such approval is subject to
the following conditions being completed in compliance with City standards and ordinances:

1. The Title Report prepared for subdivision guarantee for the subject property, the traverse

PLANNING:
4. The proposed subdivision shall conform to all applicable regulations of the Palm Springs
Zoning Ordinance,Municipal Code,or any other City Codes,ordinances and resolutions which
supplement the zoning district regulations.
4a. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents,
officers, and employees from any claim,action,or proceeding against the City of Palm Springs

Tentative Parcel Map No. 28951 The City of Pahn Springs will promptly notify the applicant
of any such claim, action,or proceeding against the City of Palm Springs and the applicant will
either undertake defense of the matter and pay the City's associated legal costs or will advance
fiords to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to
promptly notify the applicant of any such claim,action or proceeding or fails to cooperate fully
in the defense, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold
harmless the City of Palm Springs. Notwithstanding the foregoing,the City retains the right to
settle or abandon the matter without the applicant's consent but should it do so, the City shall
waive the indemnification herein, except, the City's decision to settle or abandon a matter
following an adverse judgment or failure to appeal, shall not cause a waiver of the
indemnification rights herein.
5. The applicant prior to recordation of the final map and issuance of building permits shall submit
a draft declaration of covenants, conditions and restrictions ("CC&R's") to the Director of
Planning and Building for approval in a form to be approved by the City Attorney, to be
recorded prior to issuance of occupancy permits. The CC&R's shall address the maintenance
and construction of areas outside of the first and second phases of development (i.e. fugitive
dust,landscaping an d irrigation,emergency access,maintenance of unimproved lands within the
project area by Lot 1 owner)and the maintenance of the overall project as one integrated project
in perpetuity and be enforceable by the City, shall not be amended without City approval, and
shall require maintenance of all property in a good condition and in accordance with all
ordinances.
The applicant shall submit to the City of Palm Springs, a deposit in the amount of$ 2,000.00,
for the review of the CC&R's by the City Attorney.
6. All Conditions of Approval from Resolution No.4646 from Conditional Use Permit No.5.0785
are still in full force and effect and all applicable conditions that relate to the subdivision of the
property shall be considered attached by reference to the approval of this Tentative Parcel Map.
