DESERT WATER AGENCY FACILITIES RELOCATION COST FOR HERITAGE TRAIL
RECOMMENDATION:
That City Council approve issuance of a Purchase Order to Desert Water Agency
(DWA), in the amount of$25,000 for the cost of relocating water facilities, City
Project No. 93-49.
BACKGROUND:
On June 21, 2000, City Council approved an agreement to be approved by the
City Attorney in the amount of$25,000 for the relocation of DWA facilities for the
Heritage Trail project Previous to that meeting, relocation costs for DWA
facilities were paid for by Purchase Order or check requests. When the amount
exceeded$5,000, the issuance of a Purchase Order was submitted for Council
approval. In the case of Heritage Trail, the City Attorney was recommending that
a specific agreement be drafted and entered into with DWA. To date this
agreement has not been completed and Engineering staff has received a letter
from DWA Indicating that they will not enter into such an agreement.
Staff requests that Council consider this issue with DWA and authorize issuance
of a Purchase Order for the relocation of the facilities. The construction
contractor,to date, has had to skip the areas where DWA's facilities need to be
relocated which will result in having to return to those areas once the relocation is
completed to repour sidewalks and necessary improvements for completion of the
Heritage Trail. The contractor has indicated that this may result in additional
costs to him which he will claim as extra work, because he was not able to
proceed continuously with the work.
Sufficient funds are available in account no. 134-4498-50135 (Heritage Trail
Construction).

I HEREBY CERTIFY that this Minute Order approving issuance of a Purchase Order to
Desert Water Agency(DWA), in the amount of$25,000 for the cost of relocating water
facilities, City Project No. 93-49, was approved by the City Council of the City of Palm
Springs, California, in a meeting thereof held on the 19"'day of July 2000.
