RECOMMENDATION:
The Planning Commission recommends thatthe City Council approve Tentative Tract Map
29659 and Planned Development District261,Case No.5.0831,allowing forthe seven(7)
lot residential subdivision of the 1.2 acre, R-2 zoned parcel as described above,subject
to conditions contained in the attached resolution.
BACKGROUND:
Dennis Cunningham/Electric Avenue has submitted an application forTentative Parcel Map
29659,Planned Development District261,Case No.5.0831 requesting the entitlement of
subdividing an existing 1.2 acre,R-2 zoned lot into seven(7)residential lots. The lots are
to be accessed by a private,twenty-six(26)to thirty-four(34)foot wide cul-de-sac road off
of Twin Palms Drive. There are also pedestrian gates at the rear of each lot on the Camino
Real frontage.
The subject properly is designated by the General Plan as M15(medium density)with fifteen
(15)units perac re and is currentlyzoned R-2(Limited Multiple-family Residential Zone)with
a minimum lot size of 20,000 square feet. The project proposes subdividing 1.2 acres into
seven (7)single family residential lots with lots ranging in size from 5,470 square feet to
5,715 square feet with a density of 5.8 units per acre. The application complies with the
General Plan and Zoning Ordinance density requirement, but not the Zoning Ordinance
designations for lot size and setbacks. The proposed project requires reduced front,side,
and rearyard setbacks as well as reduced lot sizes. The applicant has therefore submitted
a Planned Development District for the proposed project.
The existing lot of record is proposed to be developed with seven(7)single family residence
parcels. The depth of the lot is 332' and the width is 160'. The Planned Development
District is appropriate in this instance due to the fact that with the relief from lot sizes and
setbacks and single family residential use is more suitable in a neighborhood where the
proposed project property abuts a single family use.The R-2 zone allows up to eighteen
(18)multi-family units.Zoning Ordinance Section 9403, Planned Development Districts,
states that"Planned residential development districts may include a multiplicity of housing
types provided the density does not exceed the General Plan requirements. The form and
type of development on the PD site shall be compatible with the existing or potential
development of the surrounding neighborhoods."

The Zoning Ordinance provides for permanent,single family development in the R-2 zone
to be developed per the standards of the R-1-A zone. However, since this Planned
Development District is not consistent with the R-1-A zone development standards the
following chart has been prepared to demonstrate the development standards of the R-1-A
zone and the R-2 zone compared to the proposal. This will provide reference points for
purposes of PD 261 analysis.

The houses are one (1) story with a modem style of architecture and contain two (2)
bedrooms and a den orthree bedrooms and two(2)baths with approximately 1800 square
feet of floor area. An attached,two(2)car garage is located at the front of each residence.
The homes are separated by six (6) foot zinc-alum fencing. The project utilizes an
alternating combination of six(6)foot high painted concrete block and zinc-alum fencing
around the western, southern, and northern property perimeter. The entire style is very
similar to the popular Dunes Court development at the comer of Sunny Dunes Road and
Calle Amigos. The existing six(6)foot high block wall is intended to remain on the eastern
property line.

ENVIRONMENTAL ANALYSIS:
An environmental assessment was completed by staff on April 18, 2000 for the subject
project. Potential environmental impacts from the project include land use and planning,
water, air quality and noise issues. The hydrology study required by the Engineering
Department indicates that the storm water in excess of pre-existing conditions can be
retained on site in the northern,eastern and western perimeter landscaping areas. These
areas are to lie maintained by the homeowners association. Air quality issues will be
addressed by application of the standards of the City's Fugitive Dust Control and Erosion
Control Ordinance. Temporary construction noise Issues are addressed by limiting the
hours of construction and positioning recommendations relative to the construction
equipment.
With all environmental mitigation incorporated into the attached resolution staff feels that any
environmental Issues will be reduced to a level of insignificance. The environmental
documents are available for review in the Department of Planning and Building.
All property owners within a 400 foot radius of the parcel considered for subdivision were
notified.
PLANNING COMMISSION ACTION:
The Planning Commission at it's May 24,2000 meeting by a vote of 6-0, 1 recommended
approval of Tentative Tract Map 29659 and Planned Development261 subjectto conditions

The Planning Commission reviewed the proposed modifications to zoning ordinance
setback, building height, and lot size requirements and finds that the relief requested is
reasonable and justified finding that the proposed project is substantially below allowable
density and creates effective buffer to surrounding properties, the proposed 43'setback
along the east property line will protect existing views to the mountains, the proposed
access driveway along this property line will have limited use and will not create a hardship
upon the existing single family residences,and the project provides an appropriate land use
transition between the surrounding single family homes,the apartment uses and the mobile
home park.

SUBJECT: Proposed Project at Twin PabnsDnve and Camino Real,Palm Springs
We are homeowners on Aquanetta Drive,adjacent to the above-named tract,and have some comments about the project.
While we are encouraged by the efforts put forth by the developer to change the current zoning from R-2 to R-1,we
question the density requested by them As we all know,Palm Springs has been positioning itself as a"village."Since we
and many other people have moved here for that very reason,we fail to understand how seven homes situated on a 1.2-acre
site fits with that concept.Aquanetta Drive has just six homes on the entice block.It would seem to us that four homes
would be far more appropriate and would avoid an ill-advised step toward"city-fying"our village.We recommend that you
get your priorities straight.
Beyond that,we have several specific,pertinent requests:
• We see nowhere in the developer's tract map of any indication about what is to be done with the unsightly utility wires,
both electrical and cable,that are hanging over the neighborhood.We would encourage their burial on that site,and
we would be willing(as are many of our neighbors)to pay to bury them underground,behind our own properties.That
would bring our village into the current century and would allow us to enjoy the mountain views without having to peer
between many more newly-added wires.
• Having observed the developer's previous project just off Sunny Dunes Road,we believe that the use of steel-topped
fencing is an inappropriate choice of materials.We would like to see them use adobe-textured concrete block.
• The bright yellows and blues which they have chosen to use as accent colors are totally out of character in this area of
Alexander-designed homes.The developer's colors ate more attuned to a commercial enterprise.We recommend that
they stick with desert colors(beige,browns,greens,etc.)
• To keep noise levels to a minimum during the summer months,we request that the air conditioning units be placed
behind the homes,closer to Camino Real.
We request that this letter be included in the proceedings of the Planning Department.

As a homeowner on Aquanetta and one of the property owners directly adjacent to
the proposed development r have some requests. First r would like to say that the
developer is to be congratulated on this development obviously a lot of effort has
gone into the project.
As requests r would like to see an &&w wa&be constructed adjacent to the existing
wall. I do not think the existing wall could sustain.and additional bricks. 2 walls
would be much better in case of vehicles hitlthng_ be wall when backing out our
turning. It would give a better chance of It not breaking through to our yards. With
the proposed driveway, thaiwffl-be Passing directly at our
backyards I feel that it would be not only a safety need but also to cut noise and
lights. While the dwellings are go1bgto.mah nn-n ttrp 4&foot setback the adZlltiogal
height on the wall Is necessary to mitigate the impact of the substandard size lots,

In this developers previous project on Sunny Dunes there was the use of bright blue

remain with the desert landscape of beige's, etc. I would not like to see 7 bright
eolorectchhnneys and yellow walli0istead-ottlie mountain.
I would further like to ask that the /ightigg be carefully considered and be kept at
groundbdWor designed*in someway as not to obstruct night sky viewing. This
neighborhood on Aquanetta keeps lighting at a minimal level and as such we have
magniffnear night views of the sky andi wouldii>m that to remain.
I have a concern about how the electric and phone/fines would be connected to 7
Houses. Lwould hope that you wound:consider underground. If that were not toe
case I would strongly object to the project. I would be happy to consider my part of
the expenses in putting existing lines undergmunrtas has several-of my neighbors.

PUBLIC HEARINGS:
Case 5.0831 (PO 261)and Tentative Tract Map 29669—Application by Mainlero,Smith, &
Associates for Dennis Cunningham/Electric Avenue, LLC for a Planned Development
District and subdivision map for a seven-unit single family, residential project on 1.2
acres located at the southwest corner of Camino Real, R-2 Zone, Section 26.
Commissioner Caffery abstained from this Issue due to a conflict of interest.
Associate Planner Dawson reviewed the application and plans for the Planning Commission.
He stated that each home is 1,800 square feet, leaving 51% open space on each lot. He
reported that adjacent uses include apartments, vacant land, and single family residences. He
also reported that the Planning Division has received two letters of concern from neighbors and
these are on file in the Department. The concerns cited Include privacy, lighting, utility
undergrounding, and architectural design. Planner stated that the developer has made a
considerable reduction in the density compared with the allowable density per current zoning

(16 units). Planner stated that the air conditioning units are planned for roof-top installation and
will be screened with perforated metal.
Chairman Mills opened the Public Hearing.
Mr. Marvin Roos, Mainiero, Smith, and Associates, addressed the Planning Commission. He
stated that his firm concurs with staffs recommendations and conditions. He stated that there
will be an association to provide project maintenance and landscaping—similar to a
condominium association. He stated that individual yards will be privately landscaped and
maintained. He reported that the ske has no direct access to Camino Real and that guest
parking will be accommodated within the project. He confirmed that southern and western
openings will have overhanging eaves for sun control.
Mr. Jim Showalter, homeowner on Aquanetta Drive, addressed the Planning Commission. He
stated that his home is adjacent to the proposed project and that there are only six homes on
the entire block at this time. He stated that he feels the project will compromise the "village
atmosphere". He stated that he would like the utilities to be undergrounded and that he, and
many of the neighbors, are willing to share the cost of this project. Mr. Showalter's letter to the
City regarding this issue is on file in the Planning Division.
Mr. James Alderson addressed the Planning Commission. He stated that he fell the colors of
the proposed project were inappropriate for the surrounding neighborhood and that the steel-
top fencing was more commerdallooking than residential. He asked that the Planning
Commission require the arc conditioning units be placed behind the homes (closer to Camino
Real).
There being no further appearances, the Public Hearing was dosed.
Director reported that an evaluation and report from Southern California Edison to the City
Engineer will be necessary to establish feasibility and cost. He also reported that all new utility
connections in the City are required to be undergrounded.
Planner explained that the fence is made of interchanging masonry block and Zinc-Alum. The
predominant external wall material is the Zlnc-Alum,which is a zinc-coated aluminum that will
not corrode or rust.
Planning Commissioners discussed design details and agreed that the Ws-60's look is
popular and the style is being market-driven. Planning Commission called the applicant to the
podium.
Mr. Dennis Cunningham, applicant, addressed the Planning Commission. He stated that he
was flexible on design features. He stated that he plans to have front gates, on-site guest
parking accommodation, large plant size to soften streetscape, and to cut down on glazing area
on building exteriors for sun control.
Director stated that working drawings and final development plans will come back to the
Planning Commission and that there may be options for architectural colors.

5.0827(PD 259)and TTM 29638—Application by Lundin Development Co. for a
Preliminary Planned Development District for a proposed integrated, single-phased
shopping center consisting of a 67,641 square foot supermarket,a 14,883 square foot
drug store with drive-through pharmacy,two quick-service restaurant pads consisting
of 3,589 and 3,000 square feet, respectively,various retail shop space consisting of
26,353 square feet and an automotive refueling station with drive-through car wash and
the subdivision of the 9.9 gross acre/8.29 net acre site into nine(9) parcels, ranging in
size from 0.13 acres to 2.82 acres, located at the northwest corner of Ramon Road and
Sunrise Way, C-1 Zone, Section 14.
Commissioner Rays abstained from this item due to a conflict of interest.
Principal Planner Hayes reviewed the application and exhibits for the Planning Commission.
He explained that there are currently eight vehicular entrances/exits on the property and that
the proposed project would reduce that to four. He also explained that a portion of the site can
not be bulk upon due to a Riverside County Flood Control District(RCFCD)easement.
Planner stated that the project is consistent with the spirit and intent of the General Plan. He
also stated that the conditions of approval for this project are inherent to those required by the
Master Development Plan for Section 14. He stated that the application for a Planned
Development District is due to the number of site plan issues where the project varies slightly
from zoning parameters and also to allow flexibility.
Planner reported that the site currently includes an existing Ralph's supermarket. He stated
that the Ralph's Company has communicated that there is no intention to dose the Ralph's
supermarket located in the SmokeTree Center at Surmise Way and Palm Canyon Drive.
Planner reported that within one mile of the project there are two other supermarkets.
Planner stated that site has some unique challenges and that the developer is currently
working on alternatives to open up area within the site. Planner reviewed street frontage
setbacks for other similar projects. He noted the proposed drive-thru facilities throughout the
project and stated that screening will be critical to keep those elements from the public view
and it is addressed in the conditions of approval. He stated that the applicant has asked for
acceptable screening to be walls in lieu of increasing landscape buffers along the perimeter
streets.
Planner stated that, at the Planning Commission Study Session and Design Review Committee
meetings, it was noted that the site plan appears to be too busy and that the circulation pattern
Is confusing.
Planner reviewed parking requirements. He stated that there are 381 spaces proposed and
418 required—applicant is asking for an 8.80A reduction in parking. In staffs analysis, it was
found that there is a substantial amount of high density residential properties in the area and

NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs,California,will hold a
public hearing at its meeting of July 19,2000.The City Council meeting begins at 7:00 p.m. (public
hearings begin at 2:00 p.m.)in the Council Chambers at City Hall,3200 E.Tahquitz Canyon Way,Palm
Springs.
The purpose of the hearing is to consider a Tentative Tract Map application and Plamied Development
District by Mainiero and Smith as an agent for Dennis Cunningham. The application proposes to
subdivide an existing 1.2 acre parcel into seven(7)residential lots. The proposal includes single story
houses with reduced lot sizes and building setbacks. Setbacks on the east property line are forty(40)to
forty-five(45)feet. The property is located at the southeast corner of Twin Palms Drive and Camino
Real. The subject property is zoned R-2, section 23.
An Environmental Assessment/Initial Study will be reviewed by the City Council at the meeting. Potential
impacts from the project are land use and hydrology. A draft Mitigated Negative Declaration of

WHEREAS, Dennis Cunningham, (the"Applicant")has filed an application with the City
pursuant to Section 9403.00 of the Zoning Code and the Palm Springs Municipal Code
Section 9.60 for Tentative Tract Map 29659 and PD 261 to subdivide 1.2 acres into seven
single family residential lots located at the southeast comer of Twin Palms Drive (the
"Project"), R-2 Zone, Section 26; and
WHEREAS, notice of a public hearing of the Planning Commission of the City of Palm
Springs tD considerApplicants application forTentative Tract Map 29659 and PD 261 were
given in accordance with applicable law;and
WHEREAS,on May 24,2000,a public hearing on the application forTentative Tract Map
29659 and PD 261 were held by the Planning Commission in accordance with applicable
law; and
WHEREAS,the Planning Commission considered the applicants requestforthe approval
of Tentative Tract Map 29659 and Planned Development 261 at its duly noticed meeting of
May 24,2000 and voted 6-0-1 to approve the request,subject to the original conditions of
approval consistent with the requirements of the ordinances of the City and State law per
Resolution No. 4694; and
WHEREAS, notice of public hearing of the City Council of the City of Palm Springs to
considerApplicants application forTentative Tract Map 29659 and Planned Development
District 261 and was given in accordance with applicable law; and
WHEREAS,on July 19,2000 a public hearing on the application for Tentative Tract Map
29659 and Planned Development District 261 was held by the City Council in accordance
with applicable law; and
WHEREAS,the City Council has independently reviewed all evidence provided including the
staff report dated July 19,2000 and all other written and oral testimony,and finds the project,
subject to the original conditions of approval,(as modified in Exhibit A),consistent with the
requirements of the ordinances of the City and State law; and

WHEREAS, pursuant to Goverment Code Section 66412.3, the City Council has
considered the effect of the proposed Subdivision,Tentative Tract Map 29659 and PD 261,
on the housing needs of the region in which Palm Springs is situated and has balanced
these needs against the public service needs of its residents and available fiscal and
environmental resources;the approval of the proposed Subdivision represents the balance
of these respective needs in a manner which is most consistent with the City's obligation
pursuant to its police powers to protect the public health, safety, and welfare; and
WHEREAS,the proposed Subdivision,Tentative Tract Map 29659,PD261/Case 5.0831,is
considered a "project'pursuant to the terms of the California Environmental Quality Act
("CEQA"),and a Mitigated Negative Declaration has been prepared for this project and has
been distributed for public review and comment in accordance with CEQA; and
WHEREAS, the City Council has carefully reviewed and considered all of the evidence
presented in connection with the hearing on the Project,including but not limited to the staff
report,all environmental data including the initial study,the proposed Mitigated Negative
Declaration and all written and oral testimony presented.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA,the City Council finds as follows:
The final Mitigated Negative Dedaration has been completed in compliance with
CEQA,the State CEQA Guidelines,and the City's CEQA procedures contained in
the City's CEQA Guidelines. The City Council has independently reviewed and
considered the information contained in the Mitigated Negative Declaration and finds
that it adequately discusses the significant environmental effects of the proposed
Project,and that,on the basis of the initial study and comments received during the
public review process, there is no substantial evidence that there will be any
significant adverse environmental effects as a result ofthe approval of this Project
The City Council further finds that the Mitigated Negative Declaration reflects Its
independent judgment
Section 2: Pursuant to Government Code Section 66473.5,the City Councl finds that
the proposed subdivision and the provisions for its design and improvement
are compatible with the objectives, policies and general land uses and
programs provided in the City's General Plan and any applicable specific
plan; and
Section 3: Pursuantto Goverment Code Section 65567,the City Council finds that the
proposed subdivision and the provisions for its design and improvements are
compatible with the objectives,policies and general land use provided in the
City's local open space plan; and

Section 4: Pursuantto Government Code Section 66474,the City Council finds that with
the incorporation of those conditions attached in Exhibit A:
a. The proposed map and planned development district are consistent with the
applicable general and specific plans.
The subject property is designated as M-15(Medium Residential)with 15 units per
acre and is zoned PD 261.The application entails subdividing 1.2 acres into seven
single family residential lots. The project complies with the General Plan
specifications as to density, goals, policies, and objectives for medium density
residential developments. Thus,the proposed project should not be a significant
Impact to the surrounding neighborhood.
b. The design or improvements of the proposed subdivision are consistent with the
General Plan.
The subject site is designated as M-15(Medium Residential-15 units peracre).The
project will be compatible with the General Plan and with existing land use
designations to the north. There is an existing six foot wall along the eastern
perimeter of the project site which will provide an adequate buffer for the existing
single family residences as specified In the Zoning Ordinance. In addition,Twin
Palms Drive and Camino Real will provide a bufferforthe properties to the west and
north.Thus, the project should be compatible with the surrounding neighborhood.
c. The site is physically suitable for the type of development contemplated by the
proposed subdivision.
The project will comply with all R-2 property development standards with the
exception of lot sizes, front, rear and side yard setbacks. Twin Palms Drive and
Camino Real will provide a bufferfor the properties to the west and north.(With the
recommended land use approvals and conditions of approval the subdivision meets
all applicable development criteria specified for the R-2 zone.) Thus,the project
should be compatible with the surrounding neighborhood.
d. The site is physically suitable for the proposed density of development
contemplated by the proposed subdivision.
The proposed subdivision is within an R-2 zoning classification and designated M-15
by the City of Palm Springs General Plan. According to the General Plan,a medium
density development to exceed fifteen units per acre could be provided on the
property. The proposed subdivision has a density of 5.8 units peracre. Surrounding
land uses include vacant land to the North,R-2,(Limited Multiple Family Residential),
South,apartments,R-2,(Limited Multiple Family Residential),East,R-1-C,(Single
Family Residential), West, vacant and mobile home park, R-2 and RMHP
(Residential Mobile Home Park). The seven unit development is an appropriate mix
between the single family residential use,the mobile home park and the apartment
uses.

e. The design of the subdivision or improvements is not likely to cause substantial
environmental damage or substantially and unavoidably injure fish orwildlife ortheir
habitat.
An environmental assessment has been conducted in regards to the proposed
subdivision and it was determined,with the recommended mitigations incorporated
into the attached conditions of approval, that the subdivision will not have a
detrimental impact on the environment.
f. The design of the subdivision or improvements is not likely to cause serious public
health problems.
The conditions of this project will require an additional four feet of right of way on
Camino Real and the addition of five foot wide sidewalks along Camino Real and
Twin Palms Drive.The subdivision has been designed to minimize potential safety
Issues by not allowing individual driveways on the perimeter streets,Twin Palms
Drive and Camino Real. The proposed single family residential is compatible with
the surrounding neighborhood and is not a use typical of causing serious public
health problems.
g.The design of the subdivision or the type of improvements will not conflict with
easements acquired at by the public at large, for access through or use of the
property within the proposed subdivision.
The project will not conflict with the existing traffic flow adjacent to the property or
access to utilities required to serve the subdivision and the immediate area.
h. The use applied for at the location set forth in the application is properly one for
which a Planned Development District is authorized by the Citys Zoning Ordinance.
The proposed Planned Development District will allow for a seven(7)lot subdivision
on a 1.2 acre site with reduced lot sizes and setbacks. This use is permitted
pursuant to Section 9403 (Planned Development District).
1. A nexus and rough proportionality have been established for requirement-of
dedication ofthe additional right-of-wayto the City and the off-site improvements as
related to the tentative parcel map.
The offsite improvements,which are required by the Zoning Ordinance,are related
to the project since the property owners must use Camino Real and Twin Palms
Drive to access the site.Currently,the subject property is vacant and therefore little
or no usage of the roads,sidewalks and utilities is due to the subject property at this
time. However,the future property owners will benefit from any improvements made
to Camino Real and Twin Palms Drive such as dedication of easements,sidewalks
and future widening. The required dedication of right-of-way and improvements will
provide safety benefits to the property owners and will aesthetically enhance the
neighborhood.

NOW,THEREFORE,BE IT RESOLVED that,based upon the foregoing,the City Council
hereby recommends approval Tentative Tract Map 29659 and PD 261 subject to those
conditions set forth in Exhibit on file in the Department of Planning&Building,which are
to be satisfied prior to the issuance of a Certificate of Occupancy unless otherwise
specified.

CONDITIONS OF APPROVAL
Before final acceptance of the project,all conditions listed below shall be completed to the
satisfaction of the City Engineer,the Director of Planning and Building, the Chief of Police,
the Fire Chief or their designee, depending on which department recommended the
condition.
Any agreements, easements or covenants required to be entered into shall be in a form
approved by the City Attorney.
1. The proposed development of the premises shall conform to all applicable
regulations of the Palm Springs Zoning Ordinance,Municipal Code,orany otherCity
Codes,ordinances and resolutions which supplementthezoning district regulations.
1 a. The owner shall defend,indemnify,and hold harmless the City of Palm Springs,its
agents,officers,and employees from any claim,action,or proceeding against the
City of Palm Springs or its agents,officers or employees to attach,set aside,void
or annul, an approval of the City of Palm Springs, its legislative body, advisory
agencies, or administrative officers concerning Case TTM 29659 and Case No.
5.0831/PD 261. The City of Palm Springs will promptly notify the applicant of any
such claim,action,or proceeding againstthe City of Palm Springs and the applicant
will either undertake defense of the matterand pay the CIVs associated legal costs
orwill advance funds to pay fordefense of the matter by the City Attorney. Ifthe City
of Palm Springs fails to promptly notify the applicant of any such claim, action or
proceeding or fails to cooperate fully in the defense, the applicant shall not,
thereafter, be responsible to defend, indemnify,or hold harmless the City of Palm
Springs. Notwithstanding the foregoing,the City retains the right to settle or abandon
the matterwithoutthe applicants consent but should it do so,the City shall waive the
indemnification herein, except, the City's decision to settle or abandon a matter
following an adverse judgement or failure to appeal,shall not cause a waiver of the
indemnification rights herein.
2. The mitigation measures of the environmental assessment shall apply. The
applicant shall submit signed agreement that the mitigation measures outlined as
part of the negative declaration or EIR will be included in the plans prior to Planning
Commission consideration of the environmental assessment.

3. Architectural approval shall be valid fora period of two(2)years. Extensions oftime
may be granted by the Planning Commission upon demonstration of good cause.
4. The appeal period for Case No. 5.0831/PD 261 and TTM 29659 application is 15
calendar days from the data of project approval.Permits will not be issued until the
appeal period has concluded.
5. The final development plans shall be submitted in accordance with Section 9403.00
of the Zoning Ordinance. Final development plans shall include site plans,building
elevations,floor plans,roof plans,grading plans,landscape plans,irrigation plans,
exterior lighting plans, sign program, mitigation monitoring program, site cross
sections,property development standards and other such documents as required
bythe Planning Commission.Final development plans shall be submitted within two
(2)years of the City Council approval of preliminary planned development district
6. Final landscaping,irrigation,exterior lighting,and fencing plans shall be submitted
for approval by the Department of Planning and Building prior to issuance of a
building permit
7. Priorto issuance of a grading permit,a Fugitive Dust and Erosion Control Plan shall
be submitted and approved by the Building Official. Refer to Chapter 8.50 of the
Municipal Code for specific requirements.
8. The grading plan shall showthe disposition of all cut and fill materials. Limitsofsite
disturbance shall be shown and all disturbed areas shall be fully restored or
landscaped.
9. Drainage swalles shall be provided adjacent to all curbs and sidewalks-T wide and
6" deep. The irrigation system shall be field tested prior to final approval of the
project. Section 14.24.020 of the Municipal Code prohibits nuisance water from
entering the public streets, roadways or gutters.
10. All proposed trees within the public right-of-way and within 10 feet of the public
sidewalk and/or curb shall have City approved deep root barriers installed per City
of Palm Springs Engineering specifications.
11. The applicant priorto issuance of building permits shall submit a draft declaration of
covenants,conditions and restrictions("CC&R's")to the Director of Planning and
Building for approval in a form to be approved by the City Attorney,to be recorded
prior to issuance of occupancy permits. The CC&R's shall be enforceable by the
City,shall not be amended without City approval,shall require maintenance of all
property in a good condition and in accordance with all ordinances and conditions
of approval stated herein.
The applicant shall submit to the City of Palm Springs,a deposit in the amount of
$2000 for the review of the CC&R's by the City Attorney.

12. An encroachment agreement shall be secured in conjunction with the approval of
this project for the four (4) foot of landscaping and retention basin area on the
Camino Real frontage.
The encroachment agreement shall be reviewed in conjunction with the CC&R's by

13. Separate architectural approval and permits shall be required forall signs. A detailed
sign program shall be submitted for review and approval by the Planning
Commission prior to issuance of building permits.

15. All roof mounted mechanical equipment shall be screened from all possible vantage
points both existing and future per Section 9303.00 of the Zoning Ordinance. The

23. This project shall be subject to Chapters 2.24 and 3.37 of the Municipal Code
regarding public art.The project shall either provide public art or payment of an in lieu
fee. In the case of the in-lieu fee,the fee shall be based upon the total building permit
valuation as calculated pursuant to the valuation table in the Uniform Building Code,
the feeing being 112%for commercial projects or 1/4%for residential projects with
first $100,000 of total building permit valuation for individual single-family units
exempt. Should the public art be located on the project site,said location shall be
reviewed and approved bythe Directorof Planning and Building and the Public Arts
Commission, and the property owner shall enter Into a recorded agreement to
maintain the art work and protect the public rights of access and viewing.
24. Prior to the issuance of building permits, locations of all telephone and electrical
boxes must be indicated on the building plans and must be completely screened and

50. A copy of a Title Report prepared/updated within the past 3 months and
copies of record documents shall be submitted to the City Engineer with the
first submittal of the Grading Plan.
51. Submit a Grading Plan prepared by a Registered Professional to the

shall receive trench replacement pavementto match existing pavement plus

NOTICE OF PLANNING COMMISSION MEETING
Tentative Parcel Map Application No. 29659 and Planned Development District 261
NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Palm Springs,California,
will hold a public hearing at its meeting of May 24, 2000. The Planning Cormnission meeting begins
at 1:30 p.m. (public hearings begin at 2:00 p.m.) in the Council Chambers at City Hall, 3200 E.
Tahquitz Canyon Way,Palm Springs.
The purpose of the hearing is to consider a Tentative Parcel Map application and Planned
Development District by Mainiero and Smith as an agent for Dennis Cumiingham. The application
proposes to subdivide an existing 1.2 acre parcel into seven(7)residential lots. The proposal includes
single story houses with reduced lot sizes and building setbacks. Setbacks on the east property line are
forty(40)to forty-five (45) feet. The property is located at the southeast corner of Twin Palms Drive
and Camino Real. The subject properly is zoned R-2, section 23.
An Environmental Assessment/Initial Study will be reviewed by the Commission at the meeting.
Potential impacts from the project are land use and hydrology. A draft Mitigated Negative Declaration
of Environmental Impact has been prepared for the subject proposal and members of the public may
view this document in the Department of Planning and Building, City Hall, and submit written
comments to the Planning Commission at or prior to the public hearing.
If any individual or group challenges the action in court, issues raised may be limited to only those
issues raised at the public hearing described in this notice or in written correspondence at or prior to
the Planning Commission hearing.
An opportunity will be given at said hearing for all interested persons to be heard. Questions
