RE: Filing of Nuisance Abatement Proceedings and Accounting Reports for forty-one
(41) Public Nuisances.
RECOMMENDATION:
It is recommended that the City Council adopt the attached Resolutions for the abatement
of forty-one(41)public nuisances located throughout the City and record liens against the
title of each property.
BACKGROUND:
The Community Preservation program includes a strong enforcement effort which may
result in the posing of public nuisances and, in some cases, abatement by the City.
Property owners are properly notified and, as a result of failure to comply,the City inflates
the public nuisance process.
This report includes the Proceedings and Accounting Reports and Resolutions for 41
properties where public nuisances have been abated and where the property owners have
not paid the City for the administrative and other abatementcosts. Each report states the
City's administrative cost which may include City Attorney and staff costs. Where the City
hired a contractor to perform abatements, that cost is also noted. In most cases, staff
solicited bids and awarded the contract to the lowest bidder. In several cases, emergency
abatements were performed and bids were not solicited. The total amount outstanding is
$151,682.07 This amount includes the abatement of 1532 N. Via Miraleste (Bel Air
Apartments), 517 E. Vista Chino, and 233 Tramview. These three abatements were
approved by City Council action and totaled $109,244.50
A map of the location of City-wide enforcement actions and the location of these specific
properties will be available at the City Council meeting.
Section 11.72.240 of the Palm Springs Municipal Code requires this report of Resolutions
and Proceedings and Accounting to be filed with the City Council. Following the filing of the
report,the City Clerk will deliver the Resolutions by certified mail to the Riverside County
Assessor's office

WHEREAS pursuant to said code, the City thereupon abated the public nuisance located on the
property described above; and
WHEREAS the City Council did receive and file the report of proceedings and accounting of the cost
of abatement on 5/18/00,
NOW THEREFORE BE IT RESOLVED as follows:
Section 1. That the City Council hereby approves the report of Proceedings and Accounting of
cost in the total amount of$ 302.00.
Section 2. That a special assessment lien In the amount of$ 302.00 is hereby Imposed upon
the property herein above described.
Section 3. That a certified copy of this Resolution and the report shall be filed with the Riverside
County Assessor.
Section 4. That the County Assessor Is respectfully requested to enter the amount of the
assessment on the County Tax Roll opposite the parcel of land referred to,and that
thereafter said amount shall be collected at the same time,and in the same manner
as ordinary municipal taxes.

OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, CONFIRMING THE REPORT OF PROCEEDINGS
AND ACCOUNTING FOR THE PUBLIC NUISANCE ABATEMENT
LIEN LOCATED AT 385 TRAMVIEW,
WHEREAS the City has instituted abatement proceedings concerning a public nuisance located on
the property described as 385 Tramvlew, Palm Springs, California; and
WHEREASsaid propertyls shown asAssessoesParcel No.669-382-003 on the CountyAssessor's
Map books as of 5/18100; and
WHEREAS the Director of Planning and Building has reported that notices required in accordance
with Chapter 11.72 of the Palm Springs Municipal Code have been given and that the owner has
refused to comply; and
WHEREAS pursuant to said code, the City thereupon abated the public nuisance located on the
property described above; and
WHEREAS the City Council did receive and file the report of proceedings and accounting of the cost
of abatement on 5/18/00,
NOW THEREFORE BE IT RESOLVED as follows:
Section 1. That the City Council hereby approves the report of Proceedings and Accounting of
cost in the total amount of$ 1,260.00.
Section 2. That a special assessment lien in the amount of$ 1,260.00 Is hereby imposed upon
the property herein above described.
Section 3. That a certified copy of this Resolution and the report shall be filed with the Riverside
County Assessor.
Section 4. That the County Assessor Is respectfully requested to enter the amount of the
assessment on the County Tax Roll opposite the parcel of land referred to,and that
thereafter said amount shall be collected at the same time,and in the same manner
as ordinary municipal taxes.

RESOLUTION NO.
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, CONFIRMING THE REPORT OF PROCEEDINGS
AND ACCOUNTING FOR THE PUBLIC NUISANCE ABATEMENT
LIEN LOCATED AT 448 E. COTTONWOOD ROAD,
WHEREAS the City has instituted abatement proceedings concerning a public nuisance located on
the property described as 448 E. Cottonwood Road, Palm Springs, California; and
WHEREAS said property is shown as Assessor's Parcel No.507-022-011 on the County Assessor's
Map books as of 5/18/00; and
WHEREAS the Director of Planning and Building has reported that notices required in accordance
with Chapter 11.72 of the Palm Springs Municipal Code have been given and that the owner has
refused to comply; and
WHEREAS pursuant to said code, the City thereupon abated the public nuisance located on the
property described above; and
WHEREAS the City Council did receive and file the report of proceedings and accounting of the cost
of abatement on 5118/00,
NOW THEREFORE BE IT RESOLVED as follows:
Section 1. That the City Council hereby approves the report of Proceedings and Accounting of
cost in the total amount of$ 1,385.84.
Section 2. That a special assessment lien in the amount of$ 1,385.84 is hereby imposed upon
the property herein above described.
Section 3. That a certified copy of this Resolution and the report shall be filed with the Riverside
County Assessor.
Section 4. That the County Assessor is respectfully requested to enter the amount of the
assessment on the County Tax Roll opposite the parcel of land referred to,and that
thereafter said amount shall be collected at the same time,and in the same manner
as ordinary municipal taxes.

RESOLUTION NO.
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, CONFIRMING THE REPORT OF PROCEEDINGS
AND ACCOUNTING FOR THE PUBLIC NUISANCE ABATEMENT
LIEN LOCATED AT 400 AVENIDA CERCA,
WHEREAS the City has Instituted abatement proceedings concerning a public nuisance located on
the property described as 400 Avenida Cerca, Palm Springs, California; and
WHEREAS said property is shown as Assessor's Parcel No.669-393-023 on the County Assessor's
Map books as of 5/18/00; and
WHEREAS the Director of Planning and Building has reported that notices required in accordance
with Chapter 11.72 of the Palm Springs Municipal Code have been given and that the owner has
refused to comply; and
WHEREAS pursuant to said code, the City thereupon abated the public nuisance located on the
property described above; and
WHEREAS the City Council did receive and file the report of proceedings and accounting of the cost
of abatement on 5/18100,
NOW THEREFORE BE IT RESOLVED as follows:
Section 1. That the City Council hereby approves the report of Proceedings and Accounting of
cost in the total amount of$424.00.
Section 2. That a special assessment lien In the amount of$424.00 is hereby imposed upon
the property herein above described.
Section 3. That a certified copy of this Resolution and the report shall be filed with the Riverside
County Assessor.
Section 4. That the County Assessor is respectfully requested to enter the amount of the
assessment on the County Tax Roll opposite the parcel of land referred to,and that
thereafter said amount shall be collected at the same time,and in the same manner
as ordinary municipal taxes.
Section 5. That a certified copy of this resolution and the report shall be recorded with the
Riverside County Recorder's Office.

Please be advised that this effice represents Lawrence L. Sofonio, owner of real property
with a common address of 2277 North Palm Canyon,Palm Springs, California, in the above
reforcticed manner.
On June 22,2000 my client received a certified cotrospondence from the City of Palm
Springs advising him of a bill in the amount of$576.14 for administrative costs regarding a
public nuisance abatement. The letter indicates that an invoice was submitted on 12/20/00 (sic),
and was delinquent as of May 10, 2000.
My client did not receive notice of any fee for"administrative costs"prior to June 22,
2000. In addition, the public nuisance abatement pertains to a signage issue regarding one of the
tenants of the property. The singe issue was rectified to the City's satisfaction aotve time ago.
According to the tenant there was some delay in resolving this matter because the City lost
documents provided by him.
I have contacted Nadine with the City Planning Department regardutg the outstanding
balance. l have asked that she provide a copy of the City's entire file regarding this issue,
including but not limited to, a break done of the fees associated with the"administrative costs",
Of course we will reimburse the City for all reasonable costs associated with the reproduction of
the file.

RESOLUTION NO.
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, CONFIRMING THE REPORT OF PROCEEDINGS
AND ACCOUNTING FOR THE PUBLIC NUISANCE ABATEMENT
LIEN LOCATED AT 2277 N. PALM CANYON ,
WHEREAS the City has instituted abatement proceedings concerning a public nuisance located on
the property described as 2277 N. Palm Canyon, Palm Springs, California; and
WHEREAS said property is shown as Assessor's Parcel No. 504-242-008 County Assessor's Map
books as of 5/18/00; and
WHEREAS the Director of Planning and Building has reported that notices required in accordance
with Chapter 11.72 of the Palm Springs Municipal Code have been given and that the owner has
refused to comply; and
WHEREAS pursuant to said code, the City thereupon abated the public nuisance located on the
property described above; and
WHEREAS the City Council did receive and file the report of proceedings and accounting of the cost
of abatement on 5/18/00,
NOW THEREFORE BE IT RESOLVED as follows:
Section 1. That the City Council hereby approves the report of Proceedings and Accounting of
cost in the total amount of$ 576.14.
Section 2. That a special assessment lien in the amount of$ 576.14 is hereby imposed upon
the property herein above described.
Section 3. That a certified copy of this Resolution and the report shall be filed with the Riverside
County Assessor.
Section 4. That the County Assessor is respectfully requested to enter the amount of the
assessment on the County Tax Roll opposite the parcel of land referred to, and that
thereafter said amount shall be collected at the same time, and in the same manner
as ordinary municipal taxes.
Section 5. That a certified copy of this resolution and the report shall be recorded with the
Riverside County Recorder's Office.
