FOR AIPLEMENTATION OF THREE DOOR-TO-DOOR HOUSEHOLD HAZARDOUS WASTE COLLECTION PROGRAMS RECOMMENDATION: It is recommended that the City Council approve a contract with Curbside,Inc.to implement three Door-to-Door Household Hazardous Waste Collection programs for Palm Springs residents. BACKGROUND: On December 17, 1997,City Council approved a resolution authorizing the City to apply to the California Integrated Waste Management Board(CIWMB)for a Household Hazardous Waste(BRW)opportunity grant. The City applied unsuccessfully for such a grant in 1998. In January 1999,the City applied for a$15,000 grant to be used solely for a one-time-only, door-to-door collection from seniors and disabled residents, which was awarded in July. This will be used to supplement our Senior Home Repair Program and the Single-Family Rehabilitation Program. Seniors and disabled residents are likely to have larger stockpiles of Household Hazardous Waste in their homes for several reasons, and therefore,present a somewhat greater risk than the population at large. Seniors accounted for over 25%of the population in Palm Springs(1990 Census data)with many living below the poverty level and over 1,000 residents in Palm Springs over the age of 85. We are also requesting approval for this contract to include a"pay as you throw" program for all citizens ofPalm Springs,wherein they would pay for the collection service,as needed. The cost for this service would be$75 per collection,if recyclable materials are included. If not, the cost would be$150 per collection. Recyclable materials include: Used motor oil, antifreeze, oil filters, latex or water-based paints, used automotive batteries, pesticides, herbicides, gasoline and other fuels, solvents, thinners, disinfectants, aerosols and other approved materials. On both ofthese programs,the resident would call a toll-free munber,give their information and set up a collection pick up time. Curbside would then send a special HHW kit to the resident prior to their designated day. The third HHW collection program we are requesting approval for involves small businesses that generate not more than 220 pounds or about 27 gallons of hazardous waste per month. These entities are referred to as Conditionally Exempt Small Quantity Generators or CESQG's. Some CESQG's are one-time generators or very infrequent generators. A few examples might be the apartment owner who paints his building every ten years and has five gallons of paint left over. Another is a warehouse operator who has one fork lift, and changes the oil a few times per year leaving him with a five-gallon can of used oil; or a film developing studio disposing photographic waste. Most of these businesses are for-profit, which means they must pay the entire cost of transportation and disposal of the waste they generate. However, as a participant in this program, the cost is quite reasonable, because they are based on household hazardous waste disposal pricing and community sponsorship. /y _ 6. Council Report 1q,(4 or io Household Hazardous Waste 12/15/99 Also, it is not necessary in most states to prepare a uniform hazardous waste manifest with an EPA ID number for a CESQG, lowering the cost over a commercial firm. Palm Springs' program would be the first of its type in the Inland Empire, and one of a few (but growing number) in California. This, however, is the way the collection of HHW is heading because it is the most cost-effective strategy. The Scope of Work(Exhibit"A"of the Contract)describes how the program would operate in Palm Springs. There is no request for City funds for any of these programs. Contractor shall obtain at its sole cost and expense such licenses, permits and approvals as may be required by law for the performance of the services required by this Agreement. Contractor shall have the sole obligation to pay for any Sees, assesmmo and taxes,plus applicable penalties and interest,which may be imposed by law and arise from or are necessary for the Contracta'sperfomnance ofthe services required by this Agreement,and shall indemnify,defend and hold hamiless City against any such fees, assessments,taxes penalties or interest levied,assessed or imposed against City hereunder. 1.5 Familiarity with Work By executing this Contract, Contractor warrants that Contractor(a)has thoroughly im estigsted and considered the scope of services to be performed,(b) has carefully considered how the services should be performed,and(c)fully understands the fitci ities, difficulties and restrictions attending perfomrance ofthe services under this Agreement. Ifthe services involve work upon any site,Contractor warrants that Contractor has orwill investigate the site and is or will be filly acquainted with the conditions there existing, prior to commencernerit of services hereunder.
