RECOMMENDATION:
The Planning Commissionrecommends thatthe City Council approve Tentative Parcel Map 28631 to
create a one lot parcel and remainderparcel for the property located at 1500 South Gene Autry Trail,
between South Gene Autry Trail and Crossley Road,subject to the conditions outlined in the Resolution.
The subject new lot has frontage on Crossley Road. The property owner is Michael R.Mastro,Oasis
Water Park,Inc., and the lessee is Terry L. Durst.
BACKGROUND:
The subjectproperty is currently apart ofthe existing Oasis WaterPark. The proposed subdivision will
divide the site into two parcels. Parcel 1 contains 4.55 acres and is currently undeveloped land,and the
designated remainder parcel(Oasis Water Park)is approximately 17.28 acres. The purpose of the
subdivision is to subdivide the existing site and create aparcel which could be sold and/or developed
separately. There has been some interestby the applicant and others in developing a hotel or other type
of tourist facility on the property.
The subjectpropertyis zoned M-1(Service/Manufactunng)and has a General Plan designation ofIND
(Business/Industrial). In addition,Crossley Road is designated a secondary thoroughfare on the City's
GeneralPlan. Parcels within the M-1 zone which fioanton secondary thoroughfares require amiuimumlot
areaof40,000 square feet,a minimum lot width dimension of 150 feet,and minimum lot depthof200
feet. The proposed one lot parcel map exceeds all property development standards.
Allowable uses in the M-1 zone include manufacturing,industrial,service commercial,hotels,and
commercial recreation. The preferred land use should be either commercial recreation or hotel to
compliment Oasis Water Park or Tahquitz Creek Golf Resort. The(,ity Council could require the
developerto create aspecificplanpriorto subdivision oftheproperty. Thiscouldpre-approvecertain
land uses and ensure that complimentary land uses are developed. The specificplanwould take 6 to 8
months to develop. An alternative would be to amend the existing Planned Development District to
specifically show desired uses. Both of these processes would ensure that the subject property is
marketed and eventually developed to ensure compatibility and take advantage of it's unique location next
to two commercial recreation uses.
On the east side of Parcel I along Crossley Road,there is an existing seventy-five(75)foot access
easement. This easement was previously established for future access from the parcel to the north ofthe
subjectproperty,to the existingmunicipalgolfcourseto the south. This easementwill remain as part of
Parcel 1.

ENVIRONMENTAL ASSESSMENT AND NOTIFICATION:
The tentative parcel map application is categorically exempt from an environmental assessmentper Section
15315 ofthe California Environmental Quality Act(CEQA). Property owners within 400 feet of the
subject property were notified.
PLANNING COMMISSION ACTION:
On November 24 ,1999,the Planning Commission,by a 6-0-1(Juras1d absent)vote,recommended
approval to the City Council. There were no public comments at the public hearing.

PUBLIC HEARINGS:
TPM 28631 - Application by TERRY DURST for approval of a Tentative Parcel Map to
create a one-lot parcel of 4.55 acres, and a remainder parcel of 17.28 acres. Property
is located at 1500 So. Gene Autry Trail, M-1 Zone, Section 20. Continued from
meeting of November 10, 1999.
This project is categorically exempt from the California Environmental Quality Act
(CEQA) pursuant to Section 15315.
Director Evans stated that the overall property fronts on Crossley Road and Golf Club
Drive, opposite the Fairway Condominium project, with frontage on the remainder
parcel on Gene Autry Trail;that the bulk of the property is developed and used as the
Oasis Water Park; that subject parcels of undeveloped land would become available
for sale and/or lease; that staff has worked with applicant on two separate hotel
proposals that did not materialize;that a hotel is probably the highest and best use, as
it could benefit from the recreation amenity of the Oasis Water Park and Tahquitz
Creek Golf Resort;that subject property is zoned Service/Manufacturing as a General
Plan designation of industrial, and meets all of the requirements of depth and
dimension; that Public Hearing notices were sent to all property owners within 400
feet(one response inquired about the California Environmental Quality Act); and that
this is a land subdivision, with no direct development proposed at this time.
In response to questions by Commissioners, Director indicated the area of the bike
path, and stated that it would eventually have to be relocated, as it encroaches on this
parcel, and the City Engineer has been working with the property owner regarding
realignment; that the current bikeway alignment comes through the middle of the
property;that it is in the wrong location, and staff did not feel it is a reasonable request
to request an easement; and that there is sufficient easement on the Crossley Road
frontage to remedy the situation.
Public Hearing opened.
Terry Durst, stated that he is the owner of the Oasis Water Park and requested
clarification of Subdivision Map Act.
Director stated that under State law, all maps approved at this stage are valid for two
years, with the ability to apply for time extensions for a total of seven years; that
following Planning Commission and City Counci I approval of a map,there is an official
approved tentative map,which then has to be recorded to be effective; if not recorded,
the life span of the tentative map is seven years.
There being no further appearances, the Public Hearing was closed.

CALIFORNIA,APPROVING TENTATIVE PARCEL MAP 28631
FOR THE SUBDIVISION OF A 21.83 ACRE PARCEL OF LAND
INTO TWO PARCELS FORTHE PROPERTYLOCATED AT 1500
SOUTH GENE AUTRY TRAIL,BETWEEN SOUTH GENE AUTRY
TRAIL AND CROSSLEY ROAD,M-1 ZONE SECTION 20.

WHEREAS,the TerryDurst(the"applicant")hasfiledauapplicationwith the Citypursuantto Section
9402.00 ofthe Zoning Ordinance and the Palm Springs Municipal Code Section9.62.010 for aTentative
Parcel Map to allow the subdivision of a single parcel of land into two parcels for a property located
between South Gene Autry Trail and Crossley Road,M-1 Zone,Section 20.
WHEREAS,Notice ofpublic hearing ofthe Planning Commission to consider the applicant's request for
Tentative Parcel Map 28631 was given in accordance with applicable law; and
WHEREAS,onNovember 24,1999,the Planning Commissionvoted 6-0-1 to recommend approval of
Tentative Parcel Map 28631 subject to conditions.
WHEREAS,Notice ofapublichearing oftheCity Council ofthe City ofPahn Springs to considerthe
applicant's request for Tentative Parcel Map 28631 was given in accordance with applicable law;and
WHEREAS,on December 15, 1999,a Public Hearing on the application for Tentative Parcel Map
28631 was held by the City Council in accordance with applicable law; and
WHEREAS,the City Council has carefully reviewed and considered all of the evidence presented in
connection with the hearing on the proj ect,including but not limited to the staff report,and all written and
oral testimony presented.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA,the City Council finds as follows:
The tentative parcel map application is categorically exempt from an environmental assessntemtper
Section 15315 ofthe California Environmental Quality Act(CEQA).Section 15315 states that
the subdivision of four or fewer parcels is exempt from CEQA.
Section 2: Pursuant to City ofPalm Springs Municipal Code 9.62.010 and Government
Code Section 66747,the City Council finds that with the incorporation of those
conditions attached as Exhibit A:
a. The proposed subdivision is consistent with the General Plan.
Pursuant to the General Plan,the proposed subdivision map is consistent with the policies
and objectives for the development of uses permitted under the industrial designation.
b. The design or improvements of the proposed subdivision are consistent with the
General Plan.

The site for the intended subdivision is adequate in size and shape required in order to
permit future:uses ofthelandintheneighborhood. Theproposed subdivision is consistent
with the General Plan.
C. The site is physically suitable for the type of development contemplated by the
proposed subdivision.
The proposed subdivisionwill divide the site into two parcels. Parcel 1 contains 4.55
acres and is currently undeveloped land,and the designated remainder parcel(Oasis
WaterPark)is approximately 17.28. The subdivision exceeds all applicable development
criteria specified for the M-1 zone in the Zoning Ordinance.
d. The design of the subdivision is not likely to cause substantial environmental
damage or substantially and unavoidably injure fish and wildlife or their habitat.
The proposed property is located within an urban area and is absent offish&wildlife
habitat.
Section 3: Pursuant to Government Code Section 66473.5,the City Council finds that the
proposed subdivision and the provisions for its design and improvement are
compatible with the objectives,policies and general land uses and programs
provided in the City's General Plan.
NOW,THEREFORE,BE IT RESOLVED that,based upon the foregoing,the City Council hereby
approves Tentative Parcel map 28631 subj ect to those conditions set forth in Exhibit A,which are which
are to be satisfied prior to the issuance of a Certificate of Occupancy unless otherwise specified.

CONDITIONS OF APPROVAL
Before final acceptance ofthe project,all conditions listedbelow shall be completed to the satisfaction of
the City Engineer,the Director ofPlanning,the Chief ofPolice,the Fire Chief or their designee,depending
on which department recommended the condition.
Any agreements,easements orcovenants requiredto be enteredinto shall beinaformapproved bythe
City Attorney.
ENGINEERING DEPARTMENT:
STREETS
1. Dedicate a 60 foot wide easement for landscape,sidewalk and bicycle path purposes
along the entire Crossley Road frontage.
1A. Provide proof of dedication of additional right-of-way of 14 feet for a total half street
width of 44 feet along the Crossley Road frontage. If there has been no previous
dedication of said strip of land,then the dedication shall be a part of the Parcel Map.
MAP
2. The Title Report prepared for subdivision guarantee for the subject property,the traverse
closures for the existing parcel and all lots created therefrom, and copies of record
documents shall be submitted with the Parcel Map to the Engineering Division.
3. TheParcel Map shall bepreparedbyaliceusedLand Surveyor orqualifiedCivilEngmeer
and submitted to the Engineering Division for review.Submittal shall be made prior to
issuance of grading or building permits.
The following improvements shall be listed in the Certification for hnprovements on the Final Parcel Map
and clearly noted thatthe following improvements willbe the minimum developmentrequirements for
Parcel 1 of Tentative Parcel Map No.28631,but not required to be completed until such time that
development is contemplated on said Parcel 1.
STREETS
1. Any improvements within the street right-of-way require a City of Pahn Springs
EncroachmentPemut.Work shall be allowed according toResolution 17950-Restricting
Street Work on Major and Secondary Thoroughfares.
2. Submit street improvement plans prepared by a Registered Civil Engineer to the
EngineeringDivision.Theplan(s)shall be approved bythe CityEngineerpnorto issuance
ofanygradmg orbuildingpermits.The street improvementplans intheCitylingineering
Department shall be revised to show the proposed improvements.

EDGE OF PAVEMENT along the entire frontage in accordance with City ofpaim Springs
StandardDrawingNo.110 AND 330.Thepavement section shall be designed,using"R,
values,by a licensed Soils Engineer and submitted to the City Engineer for approval.
TRAFFIC
5. Construction signing,lighting and barricading shall be provided for on all projects as
required by City Standards or as directed by the City Engineer. As a minimum, all
conshuction signing,lighting and bamcading shall be in accordance with State ofCaldomia,
Department of Transportation, "MANUAL OF TRAFFIC CONTROLS FOR
CONSTRUCTION AND MAINTENANCE WORK ZONES" dated 1996, or
subsequent additions in force at the time of construction.
PLANNING DEPARTMENT:
6. Theproposed development ofthepremises shall conform to all applicableregulations of
the Palm Springs Zoning Ordinance,Municipal Code,or any other City Codes,ordinances
and resolutions which supplement the zoning district regulations.
7. The ownershall defend,indemnify,and hold harmless the City ofPalm Spnngs,its agents,
officers,and employees from any claim,action,orproceeding againstthe City ofPahn
Springs or its agents,officers oremployees to attach,set aside,void or annul,anapproval
ofthe City of Palm Springs,its legislative body,advisory agencies,or administrative
Officers concerning Tentative Parcel Map 28631. The City ofPalm Springs win promptly
notify the applicant of any such claim,action,or proceeding against the City of Palm
Springs and the applicant will either undertake defense ofthe matter and pay the City's
associated legal costs or will advance funds to pay for defense ofthe matter by the City
Attorney. Ifthe City ofPalm Springs fails to promptly notify the applicant ofany such
claim,action orproceeding or fails to cooperate my in the defense,the applicant"not,
thereafter,be responsible to defend,indemnify,or hold harmless the CityofPalm Springs.
Notwithstanding the foregoing,the City retains the right to settle or abandon the matter
without the applicant's consent but should it do so,the City shall waive the indemnification
herein,except,the City's decision to settle or abandon a matter following an adverse
judgment or failure to appeal,shall not cause a waiver ofthe indemnification rights herein.

8. The Tentative Parcel Map approval shall be valid for a period of two (2) years.
Extensions of time may be granted by the City upon demonstration of good cause,in
compliance with the provisions of the California State Subdivision Map Act.
9. Any future development of Parcel 1 shall be subject to review and approval by the City.
POLICE DEPARTMENT:
10. Developer shall comply with Section IlofChapter8.04ofthePalm Springs Municipal
Code.
BUILDING DEPARTMENT:
11. Prior to any construction on-site, all appropriate permits must be secured.
