REAL PROPERTY TRANSFER -TO THE UNITED STATES OF AMERICA IN
TRUST FOR THE AGUA CALIENTE BAND OF CAHUII.LA INDIANS
RECOMMENDATION:
That the City Council approve the transfer of real property in Tahquitz Regional
Park, and grant right-of-way and easement for road purposes to the United
States of America in Trust for the Agua Caliente Band of Cahuilla Indians.
BACKGROUND:
In 1987, the City Council,approved Agreement No. 2435 with the Agua
Caliente Band of Cahuilla Indians and the Riverside County Flood Control and
Water Conservation District. That agreement required the City to transfer
certain real property within the Tahquitz Regional Park to the United States of
America in Trust for the Agua Caliente Band of Cahuilla Indians.
In addition to the required transfer of real property, the tribe has requested a 60
foot wide easement for roadway purposes be granted to them for the purpose of
providing access between two of the parcels being transferred.
The easement is across property remaining in City ownership and used for flood
control purposes as identified in Addendum No. 1 of said Agreement No. 2435.

RESOLUTION NO. 19699
OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING THE
TRANSFER OF REAL PROPERTY IN TAHQUITZ
REGIONAL PARK, AND GRANT RIGHT-OF-WAY
AND EASEMENT FOR ROAD PURPOSES TO THE
UNITED STATES OF AMERICA IN TRUST FOR THE
AGUA CALIENTE BAND OF CAHUILLA INDIANS
WHEREAS, in 1987, the City Council approved Agreement No. 2435 with the Agua Caliente
Band of Indians and the Riverside County Flood Control and Water Conservation; and
WHEREAS, that the agreement required the City to transfer certain real property within the
Tahquitz Regional Park to the United States of America in Trust for the Agua Caliente Band of
Cahuilla Indians; and

NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs,
California, as follows:
Section 1. That the transfer of real property in Tahquitz Regional Park is approved,
and grant right-of-way and easement for road purposes to the United States
of America in Trust for the Agua Caliente Band of Cahuilla Indians.
Section 2. That the City Manager and City Clerk are hereby authorized to sign all
documents on behalf of the City necessary to consummate the transfer of
said property.
Section 3. That the City Clerk is hereby authorized to accept the Grant Deed and
arrange for it to be recorded in the County Recorder's office on behalf of
the City.
ADOPTED this 8th day of Decemb4rl999.
