RECOMMENDATION: That the City Council approve the Grant ofEasement to Southern California Edison for electrical distribution facilities over that portion of the Palm Springs Airport property east of Civic Drive and south of Alejo Road. BACKGROUND: The Palm Springs Unified School District constructed a food service center on leased Airport property in 1998. Existing facilities servicing the area conflicted with the School District's proposed food service center, requiring relocation of various utilities. On June 17, 1998,the City Council approved a Grant ofEasement to GTE California, Inc.,for relocation of its facilities within the same Airport property as a result of the School District's food service center construction. The Southern California Edison easement will serve the same purpose as the GTE easement serves,providing an easement for the existing Edison facilities which were relocated to facilitate the District's food service center. The facilities were relocated along boundary lines and the west side of the old Bird Corporation road. Letters from Southern California Edison requesting the easement are on file in the City Clerk's office. Southern California Edison has prepared the attached Grant of Easement document to provide them the access rights they require for their facilities. APPROVED DAVID J. WHEREAS,the City ofPalm Springs,California,owns property located east of Civic Drive and south of Alejo Road in said Section 13; and WHEREAS, the Palm Springs Unified School District constructed a food service center on said property leased from the City ofPalm Springs;and WHEREAS,Southern CaliforniaEdison had electrical distribution facilities which conflicted with the School District's food service center site; and WHEREAS,Southern California Edison has requested a Grant ofEasement from the City to provide access to the relocated electrical distribution facilities; and WHEREAS, the electrical distribution facilities will continue to service the area; and WHEREAS, the location of the easement is planned in locations which will not potentially impact or conflict with the use of other City owned property. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Pahn Springs, as follows: Section 1. Grant of easement to Southern California Edison shall be on a form approved by the City Attorney for the purposes of providing access to existing electrical distribution facilities relocated due to the Palm Springs Unified School District's food service center. Section 2. The City Manager and City Clerk are hereby authorized to execute the Grant of Easement document on a form approved by the City Attorney on behalf of the City of Palm Springs. Section 3. The City Clerk is hereby authorized to record said Grant of Easement document in the Office ofthe County Recorder ofRiverside County. ADOPTED this 17th day of November 1999.
