RECOMMENDATION:
The Planning Commission recommends that the City Council approve the revision to the Desert Chapel
MasterPlan,CaseNo.5.0788,PD 59,as represented subject to the conditions in the attachedresolution.

BACKGROUND:
The Desert ChapelMasterPlanhasevolvedthroughasenesofdiscretionary land use reviews. The City
Council approved Planned Development District 59 allowing achurchinanR-1-C zone on January 7,
1976. Theori&dchurchplansicehrdedamainsanMmybi&diog,three(3)classroombuildiags,ano6ce
building,a fellowship hall and parking areas. The total square footagewas 13,600 square feet. Theproject
was to be built in two(2)phases with Phase I consisting of the Sanctuary,two(2)classroom buildings and
the required parking. In October of 1980 an application was submitted to construct Phase II,the
Fellowship Hall,a public meeting place.
In July of 1985 anapplicationwas submitted and approved fora classroombuilding. In November of
1987an application was submitted toconstnrctadditionalclassrooms. In Octoberof 1995,a 1440square
foot storage structure was requested and approved by the Planning Commission but was never built.
The applicant received Planning Commission approval of a five(5)year conditional use pean►it application
for the installation of three(3)temporary classrooms,a temporary sunshade structure,and for the relocation
ofepsdngplaygmundequhxnentattheAugust26,1998P1anningCommissionmeeting. Two(2)additional
temporary classrooms were approved to be located on the site at the November 12, 1999 Planning
Commission meeting. All of the temporary classrooms are 31'x 31'and nine(9)feet high.

On March 27,1996 Desert Chapel requested approval ofCaseNo.5.0710,PD 242 andTentative Tract
Map 28308 relative to the subdivision of 3.22 acres into three(3)single story professional office lots along
Sunrise Way and ten(10)single familyresidential lots along Sunny Dunes. Theproject was approvedby
the Planning Commission. Subsequent to this approval the application was withdrawn. The subject
property is zonedRMHP(MobilehomePark)along Sunrise Way andR 1-C along SumyDunesRoad.
ANALYSIS:
The current applicationrequestsa revision tothe existing Desert Chapel MasterPlan,(PD 59),to include
an expanded sanctuary,new multi purpose building,new hbrary/administrative building,expanding the
private school toK 12,changing the status ofall ofthe temporary classrooms to permanent classrooms,
expanding the parking facilities,expanding the day care operations,administrative services,additional
modular classrooms,street vacation and abandonment,relocation ofexisting bike trail,interim relocation
ofSumise Nursery and otheraccessory facilities and amenities. The projectis intended to be completed
in two(2)major phases. The completed project will total approximately 49,885 square feet of new
construction. Desert Chapel Churchhas purchased SunnseNurseryproperty which will be gradually
downsized and closedby August of2002. The architectural contextofthenewconst►uctionisconsistent
with the existing buildings on-site. The applicant's proposed construction schedule is as follows:
Phase IA:The existing 6,612 square foot existing Sanctuary will receive a 4,660 square foot addition
allowing foradditional seating andmulti purpose space.The Sanctuary will total 11,272 square feet upon
completion. Additionally,an 1,144 square foot storagebuilding and a fifty(50)parking space temporary
parkinglotwillbeconshucted. A temporary restminstructure of480 square feet will also be constructed
to service the classrooms in the southeast area ofthe site. When themuld purposebuilding is complete the
temporary restroom structure will be removed.
Phase 1B:A fourteen thousand(14,000)square footmulti-purpose building designed to accommodate
majorchurchfimctionsaswellas servingthe needs ofthejumorhighandhighschoolwculdbeconstructed
inthisphase. Theschoolusewouldi cludeagymnasiumandaudiWmmn.Themultipmposebwldmgwill
also provide restroom facilities for the classroom buildings in the southeast area of the site.
Phase 1C:Atwo(2)storymixedusebuildingofapproximately 8,093 square feethousingnursery/toddler
care areas,additional classrooms,and school and church administration;
Phase 1D:This phase would consist ofplacing six(6)960 square foot,foundation mounted,modular
classrooms on site.These structures would be similar to the existing modular classroom buildings.
AllofPhase 1 is intended to be constructed within two(2)years from the date ofthe Planned Development
District approval.
Phase2:Six(6)additional 960 square foot,foundationmountedmodulwclassrooms,similartotheexisting
buildings on permanent foundations, would be constructed during this phase along with an
administration/library building(4,300 square feet).The westernparking lot would be expanded and
converted to permanent status with all ofthe development criteria required by the zoning ordinance.
Sunrise Nursery,recently acquired by Desert Chapel,will be phased out over the next three(3)year
period as the plant inventory is reduced. The GenemiPlanmandatedbikepath will be relocated along
the eastern site perimeter and northern edge of Tahquitz Wash or the southern perimeter of the site
depending on easement availability. At the end ofthree(3)years all ofthe modularclassrooms,(seventeen
(17) for a total square footage of 17,280), will be in place and the Sunrise Nursery area will be
redeveloped into a permanent parking area complete with landscaping and lighting.
Phase 2 is intended to startwithinthree(3)to five(5)years ofPlannedDevelopmentDistrict approval.
It should be noted that the proj ect is also recommended to be conditioned to blend the modular buildings
into acompatible architectural style usmgparapets,arches,and otherdesign elements. A screenwall and
landscaping in front of all the classrooms is also recommended to be conditioned to reduce the profile of
the buildings from Sunrise Way.
At the completion ofthe masterplanned project the requiredparking wouldbe 272 spaces. Atotalof
367 parking spaces are proposed to be provided.
There are two(2)street abandonment issues that are necessary to facilitate the aboveproject. The first
abandonment is relative to the approximately690 foot lengthofSunny Dunes whichbisects the Desert
Chapelsite. ThisisadeadendportionofSwmyDunesRoadwithastreetwidthofapproxdmately fifty(50)
feet. The abandonment is recommended to be conditioned to include: 1)Easement access to the Desert
Water Agency. 2)Utility maintenance easement and relocated bike path per the General Plan. The
abandonment is consistent with the circulation element of the General Plan in that this portion of Sunny
Dunes Road hasno future intendeduse. The second stmetabandonment involves atwenty-sevce(27)foot
width of Sunrise Way running the approximately 875 foot frontage length ofthe Desert Chapel site.
Sunrise Waywillstillhaveahalfwidthstreetdimensionoffiflyfeet,whichisconsistentwiththerequired
dimensions ofamajorthoroughfarein the General Plan. Therefore,stafffeels this request is consistent with
the CirculationElement ofthe General Plan.Please referto the followingagendaitemstaffreportregarding
the above referenced street vacations for more information.
Desert Chapel's intention is to provide easement access to all prior users of the Sunny Dunes Road
subsequeattothsrecmmne rdedabandonment. The three(3)usexswho have historically accessedtheend
point ofSunny Dunes Road are the Mesquite Country Club GolfCourse,the Mesquite Country Club
Homeowners Association and the Desert Water Agency. All parties will have to agree to a specific
easemen4pleaserefertoConditionNo.34. Ahammerheadtumaroundis available forthelargertrucks,
reference attachmentno.3. The DesertWaterAgency will be provided with an easement overthe same
route to access an existing well. Theirabilityto use and service the well will beunchanged. Thelengthof
SunnyDunes Road has several utilities buried underneath. Theseutilitieswillbegrantedmaintenance
easements resulting in no change to their maintenance abilities prior to the recommended abandonment.
Thebiketrail isproposedtD match the dimensions and style ofthe one currentlyrunning through Mesquite
Country Club. The trail is recommended to traverse the eastemperimeterofthe Desert Chapel site and
thennm along the northern edge oftheTahgmtzWashwhichnms parallel tothesouthemperimeter. Staff
recommends that the southemportion ofthebike trail be routed within the adjacentRiverside County
Flood Control District easement ifpossible. ThiswillallowforanuMoveddesignwithameandenngtrad
and separationfromtheprivateschool. Abr7cetraileasementmustbeobtamedfromtheRiversideCounty
Flood Control District and Indian landowners to facilitate this bike trail location. If the easement cannot
be obtained for some reason the bike trail will run parallel to the southern boundary of the Desert Chapel
site.

ENVIRONMENTAL ANALYSIS AND NOTIFICATION: IN
An environmental assessment issued on September 1,1999 was prepared bystaffforthesubjectpmject.
Potential environmental impacts from the proj ect include short tern air quality during construction,and
traffic. Futureproject constructionandgrading activities may produce short-term dusterrussions from the
site. Asa mitigationmeasure the applicant will be required to submit a Fugitive DustMitigationPlan,
prepared in accordance with Chapter 8.50 ofthe Palm SpringsMunicipal Code regardingFugitiveDust
and Erosion Control. This document shall be submitted forreview andapproval to the Building Official
prior to the issuance of grading, excavation or building permits. In this manner the short term
environmental impacts will be mitigated to a level of insignificance.
The development ofprojects PD 59 andPD 242,ifreactivated,wouldgenerate an estimated 1,140new
weekday trips. Onatypical Sunday bothprojectswould generate 1,080 new trips. The Traffic Study
specifically addresses mtersectionLevels ofService(LOS) and all other details ofthe increased traffic
associated withtheprojects. The applicant's traffic study indicates that a signal will be required at the
intersection of Sunny Dunes Road and Sunrise Way by the year2004 with or without the Desert Chapel
expansion. The intersection will beat a LOS D when a signal is necessary. Tbeproject is conditioned to
provide a"fair share"contribution to the signal via the area wide Traffic Uniform Mitigation Fee,TUMF.
The lane improvements at the intersection of Sunrise Way and Ramon Road will also be addressed via
TUMF.Nootherroadwayimprovementsarerequiredtoprovide adequate levels ofserviceforprojected
year 2004 or 2010 traffic volumes.
With all environmental mitigation incorporated into the attached resolution the Planning Commission
determined that any environmental issues will be reduced to a level of insignificance. If the City Council
concurs then the issuance of a mitigated negative declaration would be appropriate.
All property owners within a four hundred(400)foot radius of the subject parcel were notified
PUBLIC NEIGHBORHOOD DISCUSSION:
A number of potential issues associated with the expansion ofthe Desert Chapel facility arose during the
PkmungCommissionpubhchemmgonSeptember22,1999. StaffmetwithrepresentativesofMesquito
Country Club Homeowners Association,Mesquite Country Club GolfCourse and Desert Chapel on
September 30,1999 and discussed these issues. The solutions belowwere discussed and endorsed by
all parties. The issues and recommendations are as follows:
1. Noiae
A) The noise of employees early morning arrivals at Mesquite Country Club Golf Course.
There is improvedcmulationwithturnamundareas inthenew paddng lot designs which
will facilitate the ingress and egress associated with the Mesquite Country Chub golf oomnse
mainterimcebuilding.Employeepaddng for employees ofthe golfcourse and otherlegal
easement users willbeprovidedby Desert Chapel. Ahedge maintained at aminimum of
seven(7)feetwillprovide screening forthe Mesquite Country Club Condominiums.New,
mature plants will be requiredto replace those dud have died.This hedge will grow into
and conceal the existing chain link fence ownedby Riverside County Flood ControL See
conditions nos. 34 and 38 and plans.
B) Basketball.night noise
All outdoornight activity is conditioned to stop at 10:00 PIVf,see conditionno.38. The
basketball play area will be relocated to the south approximately eighty feet as part ofthe
Master Plan. When the gymnasium is completed night basketball for Desert Chapel
students willoccurmdoorswithnodisturbancetothenmghborhood. All night activities
could occur in thenuiltiTugmebuildingdmbyminimizingordfininatingndoborhood
disturbances.
C) S gonsiteachvitiestothesouthoftheDesertgad site asapri =2gmnonentof
noisereduclion: SipificantsmmdmductionfortheMaW teCuuntryClubHomeowners
Association will occur through a shif ling ofthe focus of activities on-site to the southerly
portionofthe Desert Chapel site. The hardcourtplay area,student delivery,padmigareas
and associated traffic,administration facilities,classroom fircilities and mdoorplay facilities
will all make for a quieter environment in the neighborhood.
D) Ex�ansionofschooLmaximumnumberofchildren anticipated is596. Ona ten(10)acre
site with activities shifting away from the condos the noise level will be roughly the same
or less than the current situation.
2. Lights/Public Address System
A) All lighting will be in accordance with the City's non-glare standards. Allunpermitted
fighting willberequired toberemovedorpermittedin compliance withthe City ofPahn
Springs non-glare standards. See condition no. 17
B) Lights and future expansion of field-stadium.
At this point in time there are no plans to light or expand the playing field. It should be
noted that the field is a significant distance from the condominiums and that there is
insufficient room for large spectator groups. Lights on the playing field are specifically
prohibited in Condition of Approval no. 17 a.
C) Nopublic address system will be allowed otherthan forernaWncy service. Seecondition
no.40.
3. Easement
A) Terms of easement
1)The easementwillbereviewed and approvedbyall affectedparties. Seeconditionno.

B) 2)DesertChapelwillrecordamaintenanceand"holdharmless"agreementfortheusers
ofthe easement thereby shiftinga maintenance and insurance burden to Desert Chapel.
See condition no.34
C) School delivery and service vehicles
With an increase in the size ofthe church and school there will be an increase in the number
of service vehicles but it is important to note that when the Administration and classrooms
shift,(starting inPhase 1),into thenew building to the southeastthen all ofthe deliveries
wMamveviatheSunnyDunesRoadlocation. The vehicles will also exdtusingthepaddng
lot instead ofgoingby the condominiums. Theparking lot to the northwest ofthe site,
away from the condominiums,will be for teachers and other staff as they access their
offices.

D. Shy and surface durability of the easement
1)Tumarounddimensions are being designed per standard traffic turnaround dimensions
and Fire Department requirements.
2)Borings are scheduled to be done to analyze the load bearing capacity ofthe existing
easement surface. Any necessary reinforcement will be performed by Desert Chapel.
3)The access driveway is being widened to facilitate large trucks.
4)Sandbox is fencedproviding safety forthe children from easement traffic. Therewill
be no night use of the sandbox.
5)Traffic safety assessment ofusingparking lot as athoroughfare/easement,safety of
children. Items under consideration are signs directing bilce traffic to the bike path,speed
limit signs and no van or large vehicle parking for the distance from the storage facility to
Sunrise Way.
6)Desert Chapel will keep all trees along flee path of the easement trimmed to ensure clear
passage of all vehicles using the easement. See condition no. 34.
5) The City ofPalm Springs will address thenarrowness ofthe bicycle,pedestnanandgolf
cart bridge to facilitate the passage of all modes of transportation over the bridge.
Adequatewidthforagolfcartwouldnmimize the HOAmamtenancegolfcarttraffic on
the Desert Chapel easement. Grant money will be pursued to facilitate this goal.
PLANNING COMMISSION ACTION:
The Planning Commission,at it's October 13, 1999 meeting,by a 4-0-2-1 (Mills,Raya abstained,
Mathewsabsent), voterecommended approval oftheproposed PlannedDevelopment District subject
to conditions included in attachment 7.

Dear Mr. Dawson:
The Board of Directors of the Mesquite Country Club Condominium Homeowners' Association
would like to voice its concerns and objections regarding the proposed changes to the Master Plan
for the Desert Chapel.
In May of 1988 the Association pursued legal action against Temple Development and Monty,
Inc.,the then owners of Mesquite Golf&Country Club. As a result of this action,the
Association acquired a storage facility,which facility is located on the same piece of land and is
adjacent to the Mesquite Country Club Golf Course storage buildings. Therefore,the changes
which you are considering will impact us, as well as the Country Club.
The closure of Sunny Dunes Road would prevent access to our storage facility for our
maintenance personnel,as well as suppliers and other vendors. It has been rumored that we may
be allowed access through the church's parking lot. However,this would increase the
Association's exposure and liability,which is unacceptable.
Expansion of the.church's private school and day care facilities would generate increased noise
and activities and thereby adversely affect our property. Due to the size and location of our
condominiums,we attract and cater to retirees and couples who are seeking quiet enjoyment. The
noise from the school and day care would not only interfere with the peace and quiet of our
current residents,but would deter renters and potential buyers. As a result,our property values
would plummet.
Although we understand the Desert Chapel's need to expand,we are opposed to its being
accomplished to the detriment of Mesquite Country Club Condominium HOA. Therefore,we
would like to have satisfactory resolution of our concerns prior to receipt of Planning
Commission approval

with representatives from the City of Palm Springs Planning Department and Desert
Chapel to try to resolve Mesquite's concerns with the proposed Desert Chapel expansion.
I have enclosed a copy of my notes from that meeting,which accurately reflect our
conversation. Mesquite Country Club Condo HOA would be agreeable to the expansion
if the items discussed were resolved as stated. i

Below is a fist of concerns raised by Mesquite Country Club and Mesquite Country Club
Condo HOA, as well as the responses offered to these concerns by Desert Chapel and the
City ofPalm Springs representatives:
- Large trucks would not have free clearance along the proposed easement due to the
placement of trees and low-hanging branches. Desert Chapel is aware of the trees'
interference and will take appropriate measures to alleviate the problem.
- The new grading on Sunrise Way near the entrance to the proposed easement may not
facilitate large vehicles. The appropriate tests will be conducted and corrective
measures taken by the City of Palm Springs.
- It was stated by Desert Chapel representatives that all noise-producing activities, such
as basketball, will be moved to the south side of the property, away from the
proposed easement and the Mesquite Country Club condos. The administration

made. Student parking, as well as student pick-up and drop-off areas will also be
away from the proposed easement. The only activity' which will be held near the
proposed easement and Mesquite condos is a sand play area However, this will not
generate evening noise and will be fenced for safety.
- The City of Palm Springs and Desert Chapel representatives agreed to a 10:00 P.M.
curfew for outside activities.
- Mesquite Country Club Condo HOA requested a hedge row, approximately 8-9 feet
in height,to block sound. Desert Chapel representatives accepted this as a reasonable
request.
Desert Chapel representatives stated that there will be no field lighting and that
security lighting will not affect Mesquite HOA.

- Desert Chapel representatives dated that there will be no public address system, or
exterior sound system. Should it become necessary to install such a system in the
future,speakers will not directly face Mesquite condos.
- It was suggested by Mesquite Country Club HOA representatives that the pedestrian
bridge on the east side of the property, near the Mesquite Country Club maintenance
yard,be widened for golf carts, which would reduce traffic(and HOA liability)
through the Desert Chapel's property by accommodating HOA golf carts used by
maintenance personnel. The City of Palm Springs representatives thought that this
was a reasonable request and stated that they would purge it through a grant.
- Mesquite Country Club representative stated that the country club would not be held
responsible for damage to asphalt and the driveway surface caused by the weight of
the large trucks which would need to use the proposed easement. It was stated by
Desert Chapel and City ofPahn Springs representatives that the proper test would be
.conducted and corrective measures taken to reinforce the street(driveway).
- Desert Chapel representatives stated that parking would be set aside for country club,
HOA and HOA vendor parking.
The City of Palm Springs and Desert Chapel representatives will review the current
parking along the proposed easement. If necessary,those parking areas will be
marked for compact vehicles only to allow the greatest width to accommodate large
trucks. Desert Chapel vans will use the parking area on the south side of the property.
- An easement will be drawn up, which includes Mesquite Country Club,Mesquite
Country Club Condo HOA,Desert Water Agency and the City of Palm Springs, for
access through the Desert Chapel parking lot.
- Desert Chapel's attorney will draw up an indemnifcationthold harmless agreement,
to be reviewed by the legal staff for American Golf(Mesquite Country Club)and the
attorney for Mesquite Country Club Condo HOA.

We own the property located at 2001 Camino Parocela D-25, a part of Mesquite Condominium,
Phase 3.
We request consideration when the Planning Commission deliberates on the subject case.
1) We generally agree with the idea of abandoning the"dead end portion of Sunny Dunes
Road`.
2) We request that the Planning Commission add as a condition to the abandonment the
development of a footpath for Ingress and egress from Mesquite Condominium, Phase 3 to
Sunrise Way either in the current location of Sunny Dunes Road or on the south end of the property
owned by Desert Chapel.
Rationale: We have seen a number residents of Mesquite Condominium, Phase 3 who leave the
condominium grounds headed west(along the current Sunny Dunes Road) then turn left(south) and
go to the floricultureist, businesses on East Palm Canyon or even to walk to town. We often walk
along the dead end portion of Sunny Dunes Road for each of the stated reasons.
We are not requesting anything elaborate only something that will allow us to keep the access to
Sunrise Way from the bridge over the Baristo Control Channel that leads out of and In to the
Mesquite Condominiums, Phase 3.

Please be advised that we received a notice relative to the Planning
Commission meeting that is scheduled to commence at 1:30 p.m. on September 22,
1999 relative to the above-referenced case.
My wife and I own a condominium at 955B Arlene in Palm Springs and, as
property-owners, wish that our comments be considered and be entered into the
record of the public hearing.
Ibis our understanding that the Desert Chapel at 630 South Sunrise Way has
requested an expansion of their facilities, which would require the closing and
vacation of a street, relocation of the existing bike trail, and interim relocation of
Sunrise Nursery and other accessory facilities and amenities.
Since my wife and I are ardent bicyclists and frequently use the existing bike
trail which goes through the property commonly known as Mesquite Golf Course,
which in part ends upon the street which is sought to be vacated adjacent to the
Desert Chapel, we are extremely interested in learning where the relocation of the
existing bike trail would be. The notice did not give any indication as to the
relocation. It is our understanding that trail is very heavily used by citizens of the
City of Palm Springs and also tourists and other persons who frequent the area.

We are also very concerned about the abandonment described in paragraph 4
of the notice and I quote. '7he second street abandonment is relative to an
abandonment of a 27 foot width of Sunrise Way running approximately the 875 foot
frontage length of the Desert Chapel site. Sunrise Way will still have a half width
street dimension of 50 feet and a total street width of 100 feet. This is consistent with
the required dimensions of a major thoroughfare of the general plan." This
description is either inadequate or would generally be considered to be unclear based
upon our understanding of notice requirements.
Sunrise Way is a major thoroughfare within the City of Pahn Springs and is
heavily traveled. If it is correct that the width of the street in general would remain
as it is today and only the easement to the east from the curb to the chapel would be
vacated, then such a possibility would still be objectionable to most individuals who
frequently traverse the sidewalk in front of the Desert Chapel. My wife and I wish to
go on record objecting to the elimination of any frontage right-of-way on Sunrise
Way which would impede pedestrian traffic on the sidewalk in front of 630 South
Sunrise Way. To reduce Sunrise Way in width in any form could impede traffic
and certainly impede and diminish the rights of adjoining property-owners and
members of the general public who traverse Sunrise Way in a north-south fashion
at that location and certainly would traverse and have constant use of the sidewalk
at that location.
Since sidewalks are at a premium along Sunrise Way, particularly on the west
side of the street, if the notice which is very difficult to understand is, as I
understand it, a general diminishment of a pedestrian right-of-way, as well as
possible interference with traffic on Sunrise, my wife and I wish to pose a strong
objection and ask that it be entered on the record.
To the extent that the notice fails to give any definitive answers as to where
the bike trail will be relocated and to the extent that the notice is unclear as to what
is the reality of the impact on Sunrise Way, both from a pedestrian point of view
and a traffic point of view, we believe that this hearing should be tabled and any
decision on the process be tabled until a thorough traffic study, both for pedestrian
and vehicular traffic, in the affected area along Sunrise Way is completed. If the
Department of Planning and Building has already performed such a study or the
petitioner has performed such a study, we are formally requesting a copy of such
study or the conclusions related thereto.

We do wish to note that we have always found Desert Chapel to be a "good
neighbor" and having such a neighbor that does not adversely impact significantly

Phase 1B:A fourteen thousand(14,000)square foot multi-purpose building
designed to accommodate major church functions as well as serving the
junior high and high school would be constructed in this phase. The school
use would include a gymnasium and auditorium.
Phase 1C: A two(2)story mixed use building of approximately 8,093
square feet housing nursery/toddler care areas,additional classrooms, and
school and church administration.
Phase 1D: This phase would consist of placing six(6)temporary,
transportable classrooms,similar to the existing buildings,on permanent
foundations.
All of Phase 1 is intended to be constructed within two(2)years from the
date of permit issuance.
Phase 2: Six(6)additional temporary,movable classrooms similar to the
existing buildings on permanent foundations would be constructed during
this phase along with a permanent administration/library building(3,600
square feet). The western parking lot would be expanded and converted to
permanent status.
Phase 2 is intended to start within three(3)years of permit approval. This
application requests keeping five(5)existing temporary classrooms,
currently allowed for 5 years under a Conditional Use Permit approved on
August 26, 1998. Extensions of time for the use of temporary classrooms
were to be allowed for good cause in the approved conditions dated August

at this time. Future project construction and grading activities may produce short-tern diesel fume pollution and dust. As a mitigation
measure the applicant will be required to submit a Fugitive Dust Mitigation Plan,prepared in accordance with Chapter 8.50 of the Palm

included in the TralTic Study dated July 1999 prepared by Endo Engineering. The report is available for public review at the Office
of Planning and Building. The first project incorporated into the Traffic Study statistics is the wgxmsion of the church and school
Iecatedat630 South Sunrise Way. This project ts being evaluated via the revised Master Plan and PD59. The secondproject is across
the street from 630 Sunrise Way and involves a residential and office subdivision. This project,known as Case#50710,PD 242,TTM
28308 was reviewed and approved by the Planning Commission on March 27,1999. Theproject was withdrawn prior to City Council
review. The project may be presented again for City Renew at a later point in time.
The above projects will hereafter be referred to as PD 59 and PD 242 for purposes of identification in the traffic impact analysis of this
environmental assessment.
The development of projects PD 59 and PD 242 would generate an eslimaled 1,140 new weekday trips. On a typical Sunday both
projects would generate 1,080 new trips.The Traffic Study dated July 1999 specifically addresses intersection Levels of Service(LOS)
and all other details of the increased traffic associated with the projects. The applicant's traffic study indicates that a signal will be
required at the intersection of Sunny Dunes Road and Sunrise Way by the year 2004 with orwithout the Desert Chapel expansion. The
project is conditioned to provide a'Yair share"contribution to the signal via the area wide Traffic Uniform Mitigation Fund.
MITIGATION:
1. The design ofthe proposed parking lot layouts,Ir'keways and site driveways shall be subject to the review and approval of the City
Traffic Engineer during the development review process to insure compliance with City access and design standards.
2. The project proponent shall implement any bikeway shipin&signaage or other improvements required by the City Traffic Engineer
along the bikeways passing through and adjacent to the project site.
3. A traffic signal should be installed at the intersection of Sunrise Way @ Sunny Dunes Road. (See recommended conditions of
approval for further details.)
4. The project proponent should coordinate with SunLine Transit Agency regarding the creed for on-site and off-site transit facilities.
5. The project proponent shall contribute traffic impact mitigation fees,as specified by the Transportation Uniform Mitigation Fee
(TUMF).

16. NO IMPACT. There are potential concerns with two(2)issues. These concerns include a possible objection from the Mesquite
Country Club Management regarding the abandonment of the 690 foot length ofthe dead endportion of Sonny Dunes Road. Thisissue
has been dealt with by continuing to provide Mesquite Country Club access to their maintenance facility via an easement through the
Desert Chapel northern paddng lot. The second issue,neighborhood noise concerns,are addressed by locating theplaying field ofthis
ten(10)acre site to the rear(or eastern)boundary of the property.

CASE 5.0788-PD 59 - Application to revise existing DESERT CHAPEL Master Plan to
include an expanded sanctuary, new multi-purpose and library/administrative
buildings, expanding the private school to kindergarten thru twelfth grade,expanding
parking facilities,day care operations,administrative services and modular classrooms;
street vacation and abandonment, relocation of existing bike trail; and interim
relocation of Sunrise Nursery and other accessory facilities and amenities. Property is
located at 630 South Sunrise, R-1-C Zone, Section 24.
Chairman Mills abstained,as he is the architect for the project;Vice Chairman Fontana
presided.
David Dawson, Associate Planner, gave an overview of the staff report for this revised
master plan with exhibits, describing the phasing and additions for expanding the
church and school facilities and stated that the bike path is to be moved in Phase 2 as
indicated, and described the 27-foot abandonment, which would leave Sunrise Way
in tact with a 50-foot one-half street width as required by the General Plan. He
responded to questions by Commissioners,
Commissioners' concerns included: location of the bike path and maintaining its
current character, proximity of condominiums to current and proposed activities,
reason for excess parking in lieu of additional landscape, safety/traffic concerns,
objection to use of temporary classrooms, on-site circulation, and the need to
accommodate trucks used for maintenance by the Mesquite Country Club.
Staff responded to questions by Commissioners and stated that this application does
not include any lighting, nor could it be added without amending their Planned
Development District(requiring a public hearing); that there is an easement for a flood
control facility which goes through the middle and covers the approximately 100-foot
strip; that possibly the bikeway could run closer to the wash-there is a possibility of
getting a bikeway grant to make this part of the Tahquitz Regional Bikeway System;
that parking spaces exceed requirements by almost 100 additional parking spaces,and
explained the need for the excess parking due to the services with large congregations.
He further stated that this is a Preliminary Planned Development District and the
church will phase the project, monitoring the activity level and refining the needs;that
the proposed site plan is a substantial improvement over present conditions, and
described ingress/egress and circulation onsite.
In response to comments and concerns regarding the use of temporary classrooms,staff
stated that the existing,as well as additional classroom structures,will be mounted on
foundations and are not temporary buildings per code, and will have architectural
features added and be screened with landscaping; that there is a condition that if the

modular classrooms do not represent the same quality and overall appearance as new
classrooms,that these portable classrooms purchased from the school district will not
be allowed; and that per the traffic study,the intersection of Sunrise and Sunny Dunes
will be signalized when it reaches level of service "B" (by 2004).
Public Hearing opened:
Dr. Diane Ross, resident of Mesquite Country Club, stated her concerns about noise
related to functions of an elementary school and anticipated problems relating to the
high school (additional traffic and proposed football field).
Wayne Guralnick(?),attorney for Mesquite Country Club Condominium Homeowners
Association (Association), 600 units to the east of subject project, stated that the golf
course is owned by American Golf and is a separate entity and unrelated to the
Association; that they share the maintenance yard; that they have no information
regarding an easement; and that they are opposed to vacation of Sunny Dunes Lane.
Mr.Guralnick addressed the General Plan issues that he feels have not been addressed
appropriately as follows: 1) 7.2 -feels that the issue of safety has not been addressed;
2) 7.1.12 - that there is no parking shown for employees of American Golf or
employees of the landscape crew for the Association; 3) 5.21 - that there is no
consideration of impact visually, traffic or noise basis between the school and
condominiums -feels more study is necessary; 4) 6.22 -that this proposed use is as
intense (or more so) than commercial use; and that hours of operation are not
appropriate with the proximity of the residential neighborhood. Additionally,he stated
that there are serious General Plan aesthetic issues, i.e., use of temporary classroom
buildings, safety,visual impact, noise, and excessive lighting so close to a residential
neighborhood.
John Fitzpatrick, 500 So.Palm Canyon Drive, stated that he represents American Golf,
who is the management entity that leases the golf course; that American Golf, dba
Mesquite Country Club is the name of the club; that the owner is National Golf
Properties who leases the golf course from National Golf, and manages it on their
behalf(and "we" refers to all of these entities); that the easement in favor of National
Golf Properties was recorded without their knowledge or consent and has not been
accepted;that the terms of the easement are inadequate and will be vacated by them
-a letter will be sent to the church regarding this issue,that their concern is running an
established business that serves the community and visitors and thatthe church's plans
are detrimental to their ability to do this; that the proposed plan puts the children at

risk; that maintaining the golf course requires moving equipment and supplies to the
site and closing Sunny Dunes Road would severely impact this ability, as well as
jeopardizing the safety of the children;and described circulation of their maintenance
and delivery vehicles. He further stated that the area is not adequate for the proposed
usage which would impact their ability to operate the golf course; that Sunny Dunes
Road was constructed to withstand traffic and heavy equipment; and that they would
not be willing to pay for damage caused to a parking lot by their heavy equipment.
Reggie Cox, Acting General Manager of Mesquite Golf and Country Club, stated that
his primary concern is getting trucks through to the maintenance yard; that they
currently use Sunny Dunes Road,and there are a lot of blind spots when going through
the parking lot jeopardizing the children's safety.
Ron Novy, resident of Mesquite Country Club, stated he is a member of the Board of
Directors for the homeowners association; that the noise level at Desert Chapel has
increased in the last couple of years; that he is not opposed to the daytime activities,
but is opposed to the nighttime activities; that the church has not been a good
neighbor,citing all night parties and remodeling work done after hours, and that if the
project is approved there should be a restriction prohibiting outdoor activities after 10
p.m.; that court documentation indicates that they are part of the country club area in
the back with access for their gardening crew and delivery trucks, and he is concerned
with the children's safety related to these activities.
Terry Arnold,president ofthe Mesquite Country Club Homeowners Association,stated
that their complex consists primarily of retired people; that they are opposed due to
noise levels, especially with the proposed football field, and restricted access to their
maintenance shed.
Arthur MacMillan, resident of Mesquite Country Club, read from a prepared letter,
copy of which is on file in the Planning Department,which stated his objections to this
proposal due to proximity of his unit to the subject site, noise, light, access for
maintenance vehicles, traffic, elimination of the access road, safety of the children in
the sand play area, and an unsightly 6-foot cyclone fence which should be replaced
with a masonry wall. He further stated that historically the church has stored items
near this fence which created an eyesore and the church was unresponsive to their
complaints; and that construction of the proposed gymnasium will obstruct their
mountain view. He further that he has reviewed the draft mitigated negative
declaration environmental impact prepared by staff and commented on areas of
disagreement(description of surrounding properties,noise,light,aesthetics, and traffic
impact).

]ill Martin, Morongo Valley, stated that she works at Desert Chapel and has a child
attending the school, and has concerns regarding the safety of the children.
Kathy Wood stated that she is a concerned parent, and stated her concerns about the
children's safety.
Dawn Mills stated that she is a parent of two high school students who previously
attended Desert Chapel and spoke in support of the proposal. She clarified issues
regarding parking, circulation, proposed change of entrance to the church and school
and its impact. She further stated that the church and school were constructed prior
to the condominiums; that most activities are over by 8 or 9 pm, the church tries to
prevent outdoor activities after 10 p.m.(with the exception of an annual all-night, end-
of-school event for high school students), and urged approval.
Chris Mills, architect for the project, responded to statements made and stated that the
parking is based on current usage and traffic counts(that City requirement for this use
is not adequate);that they do not propose to alter the bike path until the second phase
and he is in agreement with Director's suggestion regarding use of the Riverside
County Flood Control easementAndian-owned property if possible, that Phase 2
indicates a "hammerhead" which will accommodate a 60-foot truck and emergency
vehicles; that trucks servicing the golf course now use Desert Chapel parking lot for
maneuvering, with the church's approval, rather than using Sunny Dunes Road; that
their objective is to move traffic from the middle of the school and feels that the
proposed plan creates a safe situation; that the church has been willing to allow
Mesquite employees to park in their parking lot, as they have been doing for many
years and the church will extend this usage, that the "football field" is an inaccurate
term, as it is a field on which football will be played as well as other outdoor activities
(he same as for the past five years) with no lights or grandstands; that the church has
granted an easement to Desert Water Agency for access to their well site, that they
recorded an easement to the golf course, and are willing adapt to their needs if
necessary, that they desire an abandonment of Sunny Dunes from a traffidsafety
standpoint,that uses by the school and church are being moved farther away from the
condominium area which would lessen the impact, and that the fence along the north
property line is owned and maintained by Riverside County Flood Control District.
Frank Marshall, stated that he is on the pastoral staff at Desert Chapel and his principle
duties include administration of the church and school facilities; that their goal is
creating bonds of unity and improving the community, that there have been some
communication problems among the parties and he has not been aware of some of the

stated concerns of the condominium owners; that there may be some confusion
regarding location of activities, and indicated areas of activities on the exhibits. He
further stated that the church desires to be a good neighbor and they are committed to
working things out.
Peggy Macy stated that she has worked part-time as a receptionist at Desert Chapel for
the church and the school for nine years;that she has observed many changes over the
years; that she supports the proposal, and urged everyone to keep an open mind.
There being no further appearances, public hearing was closed.
Extensive discussion followed. Staff responded to questions by Commissioners and
gave background information and brief history of the development of the church and
school.
Commissioner Matthews' concerns were primarily the placement of Sunny Dunes
Road, safety of proposed road access and possible mitigation, use of temporary
buildings, and mitigation of impact to neighbors. He encouraged homeowners to
meet with applicant, and stated that this proposed use is a good one for this location,
and that they must find a compromise.
Commissioner Caffery expressed concern about possible relocation of parking to create
more of a buffer. Staff presented options available, and stated that there has been
difficulty in getting all parties to communicate regarding their concerns; that the
proposed site plan is superior to the existing conditions, and urged applicants to make
adjustments to resolve these issues prior to presentation to City Council; and that staff
is required to respond in writing to issues that are environmentally based.
Commissioner Klatchko stated that he felt this application should be continued to allow
parties and staff an opportunity to resolve the issues;that he feels this is an appropriate
land use;that the same use will continue,with issues raised being mitigated; that the
use of temporary buildings has been a concern, but he feels that condition no. 37
should satisfy those issues. He further stated that the vacation of Sunny Dunes is the
most serious condition, possibly creating an unsafe condition,forcing vehicles to have
access over private property instead of a public street, and that further communication
is needed among the parties.
Commissioner Raya stated his preference that the item be continued to allow further
negotiation.

and the homeowners for their input, and stated that both sides have the same issues,

CASE 5.0788-PD 59 - Application to revise existing DESERT CHAPEL Master Plan to
include an expanded sanctuary, new multi-purpose and library/administrative
buildings, expanding the private school to kindergarten thru twelfth grade, expanding
parking facilities,day care operations,administrative services and modular classrooms;
street vacation and abandonment, relocation of existing bike trail; and interim
relocation of Sunrise Nursery and other accessory facilities and amenities. Property is
located at 630 South Sunrise, R-1-C Zone, Section 24. (Continued from meeting of

Commission response to written comments on Draft Negative Declaration; action.
Chairman Mills abstained, as he is the architect for the project; Commissioner Raya
abstained due to a business association; Vice Chairman Fontana presided.
David Dawson,Associate Planner, presented an addendum to the report of September
22, 1999, which addressed issues brought up via correspondence and during the
public hearing of that date, and stated that staff has met with representatives of the
Mesquite Country Club Homeowners Association,Mesquite Country Club Golf Course,
and Desert Chapel; and that all parties are to be commended for their cooperative
effort. The issues and recommendations are as follows:
Noise
A) The noise of ern IlQ=early morning arrivals at Mesquite Country Club Golf
Course.
There is improved circulation with turnaround areas in the new parking lot
designs which will facilitate the ingress and egress associated with the Mesquite
Country Club golf course maintenance building. Employee parking for
employees of the golf course and other legal easement users will be provided
by Desert Chapel. A hedge maintained at a minimum of seven (7) feet will
provide screening forthe Mesquite Country Club Condominiums. New,mature
plants will be required to replace those that have died. This hedge will grow
into and conceal the existing chain link fence owned by Riverside County Flood
Control. See conditions nos. 34 and 38 and plans.
B) Basketball. night noise
All outdoor night activity is conditioned to stop at 10:00 P.M,see condition no.
38. The basketball play area will be relocated to the south approximately
eighty feet as part of the Master Plan. When the gymnasium is completed night
basketball for Desert Chapel students wil I occur indoors with no disturbance to
the neighborhood. All night activities could occur in the multi-purpose building
thereby minimizing or eliminating neighborhood disturbances.

C) Shifting on-site activities to the south of the Desert Chapel site as a rim r
component of noise reduction: Significant sound reduction for the Mesquite
Country Club Homeowners Association will occur through a shifting of the
focus of activities on-site to the southerly portion of the Desert Chapel site. The
hardcourt play area, student delivery, parking areas and associated traffic,
administration facilities, classroom facilities and indoor play facilities will all
make for a quieter environment in the neighborhood.
D) Expansion of school, maximum number of children anticipated is 596. On a
ten (10) acre site with activities shifting away from the condos the noise level
will be roughly the same or less than the current situation.
Lights/Public Address System
A) All lighting will be in accordance with the City's non-glare standards. All
unpermitted lighting will be required to be removed or permitted in
compliance with the City of Palm Springs non-glare standards. See condition
no. 17
B) Lights and future expansion of field-stadium.
At this point in time there are no plans to light or expand the playing field. It
should be noted that the field is a significant distance from the condominiums
and that there is insufficient room for large spectator groups. Lights on the
playing field are specifically prohibited in Condition of Approval no. 17 a.
C) No public address system will be allowed other than for emergency service.
See condition no. 40.
Easement
A) Terms of easement
1) The easement will be reviewed and approved by all affected parties. See
condition no. 34.
B) 2) Desert Chapel will record a maintenance and "hold harmless"agreement for
the users of the easement thereby shifting a maintenance and insurance burden
to Desert Chapel. See condition no. 34

C) School delivery and service vehicles
With an increase in the size of the church and school there will be an increase
in the number of service vehicles but it is important to note that when the
Administration and classrooms shift, (starting in Phase 1), into the new building
to the southeast then all of the deliveries will arrive via the Sunny Dunes Road
location. The vehicles will also exit using the parking lot instead of going by
the condominiums. The parking lot to the northwest of the site, away from the
condominiums,will be for teachers and other staff as they access their offices.
D. Safety and surface durability of the easement
1) Turnaround dimensions are being designed per standard traffic turnaround
dimensions and Fire Department requirements.
2) Borings are scheduled to be done to analyze the load bearing capacity of the
existing easement surface. Any necessary reinforcement will be performed by
Desert Chapel.
3) The access driveway is being widened to facilitate large trucks.
4) Sand box is fenced providing safety for the children from easement traffic.
There will be no night use of the sandbox.
5) Traffic safety assessment of using parking lot as a thoroughfarefeasement,
safety of children. Items under consideration are signs directing bike traffic to
the bike path, speed limit signs and no van or large vehicle parking for the
distance from the storage facility to Sunrise Way.
6) Desert Chapel will keep all trees along the path of the easement trimmed to
ensure clear passage of all vehicles using the easement. See condition no.
34.
The City of Palm Springs will address the narrowness of the bicycle, pedestrian
and golf cart bridge to facilitate the passage of all modes of transportation over
the bridge. Adequate width for a golf cart would minimize the HOA
maintenance golf cart traffic on the Desert Chapel easement. Grant money will
be pursued to facilitate this goal.

Director itemized the three considerations before the Planning Commission, i.e., 1)
filing of a Negative Declaration of the Environmental Impact Report-staff feels that all
of the environmental impacts have been mitigated to an acceptable level; 2)
determination that the vacation of Sunny Dunes Road is consistent with the General
Plan-when Mesquite Country Club was proposed and subsequently approved the
Planning Commission and City Council removed Sunny Dunes Road from the General
Plan from Sunrise Way to El Cielo Road; and 3) approval of the Preliminary Planned
Development District, which is the Land Use Permit for the operation of this facility.
He further stated that the Preliminary Development District is the hearing and
entitlement phase,and that the Final Development District includes the detailed plans
for each phase which will be looked at in detail, and the safety issues will be explored
further.
Staff responded to questions of clarification and stated that the project is not
conditioned to restrict field lighting, as applicant has indicated there is no plan for
nighttime activity.
Public Hearing reopened:
Ron Novy, resident of Mesquite Country Club and member of the Board of Directors
of the Homeowners Association, expressed appreciation for the continuance to allow
for further negotiations and stated that they reached concurrence on various items;and
that in Item 34, Exhibit A (regarding maintenance easement), Mesquite Homeowners
Association should be added to the Resolution.
Reggie Cox, representing Mesquite Country Club and American Golf Corporation,
stated that he attended the referenced meeting of September 30, 1999, and that an
acceptable framework was developed among the parties. He read from a prepared
letter, and stated that they have not waived any of their rights; that in the event a
satisfactory arrangement is not finalized with Desert Chapel,that all of their objections
to the vacation of Sunny Dunes will stand and they will pursue all remedies available
to them by law; that they value their relationships with Desert Chapel and are
committed to working with them during the expansion, and look forward to a
successful project.
Chris Mills,architect for the project,responded to a question raised by Commissioners
and stated that the current trash enclosure serves the existing facility adequately, that
when the school expands there will be a secondary enclosure in Phase 11 to service the

school only. He further stated that he attended the meeting on September 3&and felt
that it was productive, with agreement being reached on all issues, and that applicant
agrees to all of the terms in the conditions of approval.

There are two(2)street abandonment issues that are necessary to facilitate the above project. The first
abandonment is relative to the approximately 690 foot length of Sunny Dunes which bisects the Desert
Chapelsite. This is a dead endportion of Sunny Dunes Road with a street width ofapproximately fifty
(50)feet. The abandonment is to be conditioned to include: I)Easement access to the Desert Water
Agency. 2)Maintenance easement to Mesquite Country Club Golf Course. 3)Utility maintenance
easement and relocated bike path per the General Plan. The abandonment is consistent with the
circulation element of the General Plan.
The second street abandonment is relative to an abandonment of a twenty-seven(27)foot width of
Sunrise Way running the approximately 875 foot frontage length ofthe Desert Chapel site. Sunrise Way
will still have a halfwidth street dimension of fifty feet and a total street width of 100 feet.This is consistent
with the required dimensions of a major thoroughfare in the General Plan.
An Environmental Assessment/luitial Study will be reviewed by the City Council at the meeting.Potential
impacts from the project include circulation,bikeway,land use and traffic.A draft Mitigated Negative
Declaration ofEnviromnental Impact has been prepared for the subject proposal and members ofthe-

NOTICE IS HEREBYGIVEN thatthePlanningCommission oftheCityofPalmSprings,California,will
hold apublic hearing at its meeting of September22,1999.The Planning Commission meeting begins at
1:30 p.m.(public bearings begin at 2:00 p.m.)in the Council Chambers at City Hall,3200 E.Tahquitz
Canyon Way, Palm Springs.
The purpose ofthe hearing is to consider an application to revise the existing Desert Chapel Master Plan,
(PD 59),to include an expanded sanctuary,new multi purpose building,new library/administrative building
expanding the private school to K-12,expanding the parking facilities,expanding the day care operations,
administrative services,modular classrooms,street vacation and abandonment,relocation ofexis6ngbike
trail,interim relocation of Sunrise Nursery and other accessory facilities and amenities.The subject
properly is zoned R-1-C, Section 24.
There are two(2)street abandonment issues that are necessary to facilitate the above project. The first
abandonment is relative to the approximately 690 foot length ofSunny Dunes which bisects the Desert
Chapel site. This is a dead end portion ofSunny Dunes Road with a street width ofapproximatelyfifty
(50)feet. The abandonment is to be conditioned to include: 1)Easement access to the Desert Water
Agency. 2)Maintenance easement to Mesquite Country Club Golf Course. 3)Utility maintenance
easement and relocated bike path per the General Plan. The abandonment is consistent with the
circulation element of the General Plan.
The second street abandonment is relative to an abandonment of a twenty-seven(27)foot width of
Sunrise Way running the approximately 875 foot frontage length ofthe Desert Chapel site. Sunrise Way
will still have halfwidth street dimension offifty feet and a total street width of 100feet.This is consistent
with the required dimensions of a major thoroughfare in the General Plan.
An EnvironmentalAssessment/Initial Study will be reviewedby the Commission at themeeting.Potential
impacts from the project include circulation,bikeway,land use andxraffic.A draft Mitigated Negative
Declaration of Environmental Impact has been prepared for the subject proposal and members of the
public may view this document in the Department ofPlanning&Building,City Hall,and submit written
comments to the Planning Commission at or prior to the public hearing.

WHEREAS,Desert Chapel,(the"Applicant")has Sled an application with the City pursuant to Section
9403.00(PlannedDevelopmentDistnct)oftheZoningOrdmance relative to a MasterPlanRevisionas
represented in Case No. 5.0788, PD 59 on a 10.16 acre parcel at 630 South Sunrise Way,R-1-C
Zone,Section 24; and
WHEREAS,notice of a public hearing of the Planning Commission of the City of Palm Springs to
consider Applicant's application fora Master Plan Revision as represented in Case No.5.0788-PD 59
was given in accordance with applicable law;and
WHEREAS,on January 7,1976 the City Council approvedPlannedDevelopmentDistrict 59providing
for a church and school use in an R-1-C zone,and
WHEREAS,the church and school have been in continuous operation and have received Planning
Commission approval for numerous additions,and
WHEREAS,on September 22, 1999 and October 13, 1999 public hearings on the application for a
Master Plan Revision,Case No.5.0788-PD 59 were held by the Planning Commission in accordance
with applicable law; and
WHEREAS,the Planning Commission considered the applicant's request fora Master Plan Revision in
Case No.5.0788,PD 59,at its duly noticed meeting held on October 13,1999 and voted unanimously
to approve the Master Plan Revision subject to the original conditions ofapproval(and as modified in
Exhibit A),consistent with the requirements of the ordinances of the City and State Law;and

WHEREAS,notice of a public hearing of the City Council of the City of Palm Springs to consider
Applicant's application for a Master Plan Revision as represented in Case No.5.0788-PD 59 were
given in accordance with applicable law, and
WFEREAS,the City Council has independently reviewed all evidence provided including the staffreport
datedNovember 17, 1999 and all otherwritten and oral testimony,and finds the project,subject to the
original conditions of approval(as modified in Exhibit A),consistent with the requirements of the
ordinances of the City and State Law;and
WHEREAS,the proposed Master Plan Revision,Case No.5.0788,PD 59 is considered a"project"
pursuant to the terms ofthe California Environmental Quality Act("CEQA"),and a Mitigated Negative
Declaration has been prepared for this proj ect and has been distributed forpublic review and comment in
accordance with CEQA;and
WHEREAS,the City Council has carefully reviewed and considered all ofthe evidence presented in
connection with the hearing on the Project,including but not limited to thestaffreport,all environmental
data including the initial study,the proposed Mitigated Negative Declaration and all written and oral
testimony presented.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA,the City Council finds as follows:
The final Mitigated Negative Declaration has been completed in compliance with CEQA,the
State CEQA Guidelines, and the City's CEQA procedures contained in the City's CEQA
Guidelines. The City Council has independently reviewed and considered the information
contained in the Mitigated Negative Declaration and finds that it adequately discusses the
significant environmental effects of the proposed Proj ect,and that,on the basis ofthe initial study
and comments received during the public review process,there is no substantial evidence that
there will be any significant adverse environmental effects as a result ofthe approval of this
Project. The City Council further finds that the Mitigated Negative Declaration reflects its
independent judgment.
Section 2•
The City Council finds that with the incorporation of those conditions attached in Exhibit A
a. The use applied for at the location set forth in the application is properly one for which a
Planted Development Master Plan Revision is authorized by this ordinance.
In that the Zoning Ordinance specifically provides for the creation of Planned
Development Districts and Planned Development 59 was legally created per these
standards the proposed revisions are in compliance with these standards and the
expansion ofthe church and school is an appropriate development for the site and the
community.
b. The use is necessary and desirable for the development ofthe Community,is in harmony
with the various elements and objectives ofthe General Plan and is not detrimental to
existing uses or to future uses specifically permitted in the zone.

The existing Church/School use is provided for in the R-1-C zone with a Planned
DevelopmentDistnctinthe City ofPahn Springs Zoning Ordinance.Theprojectdesign
parameters and conditions provide for land use compatibility in the zone. Access and
maintenance easements havebeenprovided to address theabandanmentofSrmnyDanes
Road and the bike path has been re-located
C. The site for the intended use is adequate in size and shape to accommodate said use
including yards,setbacks,walls or fences,landscaping and other features required in
order to adjust said use to those existing or permitted future uses of land in the
neighborhood
The 10.16 acre site is appropriate forthe scale ofthe expansion ofthe existing school and
church. The school expansionisoccurringpredommantlyin the centerandsoutheastern
comer ofthe site where the contiguous land uses are a golfcourse and a dry wash. This
location also gives the greatest distance fiom the residences across the street from Sunrise
Way and from the Mesquite Country Club Condominiums.
d. The site for the proposed use relates to streets and highways properly designed and
improved to carry the type and quantity of traffic to be generated by the proposed use.
Atrafficstudyandenviromnentalassessmenthasbcenperfonned. Specific traffic impact
mitigation conditions are being applied to this project including contributions to the
signalizationofSunrise Way and Sunny Dunes Road and intersection improvements at
Ramon Road and Sunrise Way.
e. The conditions imposed are deemednecessarytoprotectthepublic health,safetyand
general welfare,including any minor modifications of the zone's property development
standards.
The conditions address environmental concerns including traffic,planning standards and
construction standards,thereby creating improvements that are beneficial to thepublic
health,safety and general welfare.
f. A nexus and rough proportionality have been established for requirement of dedication of
the additional easement access,bikeway relocation and traffic improvements.
The proposed on-site improvements,which include the addition of a hard court play area,
fountain,and parking access in the area of the existing bike path,will necessitate the
relocation ofthe General Plan mandated bike path and access easements. In addition,the
increased traffic associated with the expansion will require Desert Chapel to contribute a
fair share amount towards traffic signal improvements at the sunrise way and sunny
Dunes Road intersection and to contribute to the necessary intersection improvements at
Sunrise Way and Ramon Road,including left hand tam lane,from westbound Ramon
Road to southbound Sunrise Way. Therefore, the public benefit is appropriate in
relationship to the scope of the project.

CONDITIONS OF APPROVAL
Before final acceptance ofthe project,all conditions listed below shall be completed to the satisfaction of
the City Engineer,the Director ofPlaM=&the ChiefofPolice,the Fire Chieforthwdesignee,depending
on which department recommended the condition.
Any agreements,easements or covenants required to be entered into shallbe in form approved by the
City Attorney.
APPLICATION FORARCHITECTURAL APPROVAL OF DESERT CHAPEL MASTER PLAN
LOCATED AT 630 AND 710 SUNRISE WAY SOUTH, (APN 502-560-004,006),SECTION 24,
T 4 S,R 4 E, S.B.B.M.,CASE NO.PD-59,ENG.FILE NO.E-2527
1. The proposed developmentofthepremisesshallconformtoallapplicableregulationsofthePalm
Springs Zoning Ordinance,Municipal Code,or any other City Codes,ordinances and resolutions
which supplement the zoning district regulations.
Ia. The owner shall defend,indemnify,and hold harmless the City of Palm Springs,its agents,
officers,and employees from any claim,action,orproceeding against the City of Palm Springs or
its agents,officers or employees to attach,set aside,void or annul,an approval ofthe City of
Patin Springs,its legislative body,advisory agencies,or administrative officers concerning Case
No.5.0788,PD 59. The City ofPahn Springs will promptly notify the applicant of any such
claim,action,or proceeding against the City of Patin Springs and the applicant will either
undertake defense ofthe matter and pay the City's associated legal costs or will advance fiords to
pay fordefenseofthematterby the City Attorney. Ifthe City ofPalm Springs fails to promptly
notify the applicant of any such claim,action or proceeding or fails to cooperate fully in the
defense,the applicant shall not,thereafter,be responsible to defend,indemnify,or hold harmless
the City ofPalmSprings.Notwithstanding the foregoing,the City retains the right to settle or
abandon the matter without the applicant's consent but should it do so,the City shall waive the
indemnification herein,except,the City's decision to settle or abandon a matter following an
adverse judgement or failure to appeal,shall not cause a waiver of the indemnification rights
herein.
2. The mitigation measures ofthe environmental assessment shall apply. The applicant shall submit
a signedagreementthat the mitigationn usures outlined aspartofthenegative declaration orEIR
will be included in the plans prior to Planning Commission consideration of the environmental
assessment.
3. The appeal period for the Master Plan Revision,Case No. 5.0788-PD 59 application is 15
calendar days from the date ofproject approval.Permits will not be issued until the appeal period
has concluded

4. The final developmentplans shall be submitted inaccordancewith Section 9403.00oftheZoning
Ordinance. Final developmentplans shall include siteplans,building elevations,floorplans,roof
plans,grading plans,landscape plans,irrigation plans,exterior lighting plans,sign program,
mitigation monitoring program, site cross sections,bikeway plans,property development
standards and other such documents as required by the Planning Commission.Final development
plans shall be submitted within two(2)years of the City Council approval ofthe preliminary
planned development district.
5. Final landscaping,irrigation,exteriorfighting,andfeucingplansshallbesubmittedforapprovalby
the Department ofPbmung and Building prior to issuance ofa building permit Landscape plans
shall be approved by the Riverside County Agricultural Commissioner's Office prior to submittal.
6. The project is subject to the City ofPalm Springs Water Efficient Landscape Ordinance.The
applicant shall submit an application for Final Landscape Document Package to the Director of
PlamungandBuildmgforreviewandapprovalpriorto the issuance ofabuildingpermit. Referto
Chapter 8.60 of the Municipal Code for specific requirements.
7. Priorto issuance ofagradirigpermit a Fugitive Dust and ErosionControl Plan shall be subirutted
andapproved by theBuilding Official. Refer to Chapter 8.50 oftheMunicipal Code for specific
requirements.
8. The gradingplanshall showthe dispositionofall cutand fill materials. Limitsofsitedisturbance
shall be shown and all disturbed areas shall be filly restored or landscaped.
9. Drainage swales shallbeprovided adjacent to all curbs and sidewalks-3'wide and 6"deep. The
irrigation system shall be field testedpriorto final approval oftheprojecL Section14.24.020of
the Municipal Code probibits nuisance water from entering the public streets,roadways or gutters.
10. Allproposed trees withinthepublicright-of-wayand within 10 feet ofthepublic sidewalk and/or
curb shall have City approved deep root barriers installed per City of Palm Springs Engineering
specifications.
11. Separate architectural approval and permits shall be required for all signs. A detailed sign
program shall be submitted for review and approval by the Planning Commission prior to issuance
of building permits.
12. All materials on the flat portions of the roof shall be earthtone colors.
13. All roofmomtedmechanical equiptnent shall be screened from all possible vantagepoints both
existing and future per Section 9303.00 of the Zoning Ordinance. The screening shall be
considered as an element of the overall design and must blend with the architectural design of the
building(s). The exteriorelevations androofplans ofthe buildings shall indicate any fixtures or
equipment to be located on the roofofthebuilding,the equipmentheights,and typeofscreening.
Parapets shall be at least 6" above the equipment for the purpose of screening.
14. No exterior downspouts shall be permitted on any facade on the proposed building(s)which are
visible from adjacent streets or residential and commercial areas.
15. The design,height,texture and color ofbuildmg(s),fences and walls shall be submitted for review
and approval prior to issuance of building permits.

16. The street address numbering/lettering shall not exceed eight inches in height.
17. An exterior lightingplan in accordance with the lighting ordinance in effect atthe time shall be
submittedforreviewandapprovalbytheDirectorofPlanning&Buildingpriorto the issuance of
building permits.Aphotometric study and manufactnrer's cut sheets ofall exterior lighting onthe
building,in the landscaping,and in the parking lot shall be submitted for approval prior to issuance
of a building permit.If lights are proposed to be mounted on buildings,down-lights shall be

30. Handicapped accessibility shall be indicated on the siteplan to include the location ofhandicapped
parking spaces,the main entrance to the proposed structure and the path of travel to the main
entrance. Consideration shall begiventopoldifficultieswith the handicappedaccessibility
to the building due to the future grading plans for the property.
31. Compact and handicapped spaces shall be appropriately marked per Section 9306.000 10.
32. Curbs shallbeinstalledataminimumoffive(5)feetfiomfaceofwalls,fences,buildings,orother
structures. Areas that are notpartofthe maneuvering area shall have curbsplacedat a minimum

33. The project shall comply with the City ofPahn Springs Transportation Demand Management
(TDM)Ordinance which establishes transportation demand management requirements for the City
of Palm Springs. Refer to Chapter 8.4 of the Municipal Code for specific requirements.
34. Access and utility maintenance easements shall be provided relative to the Sunny Dunes Road
abandonment in a manner consistent with the demonstrated needs of the historical use by the
Desert Water Agency,Mesquite Country Club Golf Chub,Mesquite Country Club Homeowners
Associahonandanyafl'ectedutihties. These easements are subject to the approval ofthe City of
Palm Springs and shall be submitted to the City Attorney for examination as to form and content
prior to the issuance of any building permits.
a. Employee parking shall be provided by Desert Chapel for all legal users of the
easement.
b. The applicant shall record a maintenance and"holdharmless"agreement for the users of
the easement thereby shifting a maintenance and insurance burden to the benefit of the
users.
C. The applicant shall dedicate to the City an easement forpedestrian andbikepath purposes
across that portion of Sunrise Way right-of-way vacated to the applicant.
d. The applicant shall dedicate to the City an easement for pedestrian and bikepath
purposes,and construct abikepath across the applicant's property in alocation,width
and alignment approvedbytbe City Engineeapriorto vacation ofpedestrian andbikepath
rights from Sunny Dunes Road.
e. The applicant shall provide and enter into reciprocal access agreements across the
applicant'spropertywiththe Cityandall affectedparties that use SunnyDunes Road as
legal access ins formapprovedbythe City Attorneypriorto vacation ofSunny Dunes
right-of-way.
35. The design ofthe parking lot layouts,b&eways,and site driveways shall be subject to the review
oftheCityEngineerandDirectorofPlanning and Building duringtheFinal PlarmedDevelopment
District and construction document review process to ensure compliance with City access and
design standards.

a. Bikewayplans,including fencing,barriers and signing shall be submitted for
review and approval of the Director of Planning and Building with proposed
Phase I improvements installed prior to completion of Phase I.
b. The bikeway alignment shall be subject to final approval by the Director of
Planning and Building and the City Engineer. The applicant shall seek an
easement from the Riverside County Flood Control District and any Indian land
owners along the northern edge of the Tahquitz Wash to locate a meandering bike
path. Shouldthis be unsuccessful,the bike path will be located on the southern
perimeter of the Desert Chapel site as indicated on preliminary plans.
c. A new bike path ramp shall be installed over the curb where the Mesquite
Country Club bike path intercepts the brilce path on Desert Chapel property to the
satisfaction of the Director of Planning and Building.
d. A solid screen shallbe installed between the school and the bikeway when the
bikeway is relocated.
e. The area adjacentto the bikeway,(either at the Tahquitz Wash oratthe southern
perimeter of the Desert Chapel site)shall be cleaned and landscaped subject to
the approval of the Director of Planning and Building.
36. The proj ect proponent should coordinate with SunLine Transit agency regarding the need for
transit facilities prior to plan submittal for Phase I.
37. An architectural embellisbmentplan shall be submitted for the proposed modularbuildings. The
plan should include exterior finish materials,screening of mechanical equipment,and a screen wall
with landscaping in frontof all modular classrooms. Theplan shall be submittedforreview and
approval by the Director ofPlanning and Building with Phase I final development plans and
implemented in conjunction with the addition ofany additional modularumts. The Planning
Commission reserves the right to require permanent buildings for all classrooms if it is determined
that the existing and proposed modular classrooms cannot meet community design standards
comparable to new structures.
38. The oleander screening along the northern property line shall be maintained to die satisfaction of
theDirectorofPlanningandBuilding. Tbemimmumheightattrimmingshallbeseven(7)feet All
deadplantsshallberep)acedwithmaturehedgematerWwith amimmmumheightofseven(7)feet.
39. Evening outdoor activities at the subject site shall cease at 10:00 P.M.unless special time
extensions are granted by the Director of Planning and Building and/or the Chief of Police.
40. No public address system shall be allowed other than for emergency service.
POLICE DEPARTMENT:
41. Developer shall comply with Section II of Chapter 8.04 of the Palm Springs Municipal Code.
WASTE DISPOSAL SERVICES:
42. The location of the trash enclosure is acceptable subject to approved construction details
approved by the Director of Building and Safety consistent with approved City details.

44: Construction shall be in accordance with the 1994 Uniform Fire Code with 1995

Palm Springs Ordinance 1523,NFPA 13,NFPA 72 and Desert Water Agency requirements.
45: Subnutdetailedplansforreview. Plans forbothphasestobe submitted separately. Plansmust
show type of construction and total square footage for each existing building with new
construction square footage.
46. Fire Department Access Roads shall be provided andmaintained in accordance with the 1994
Uniform Fire Code,Article 9, Sections 902.1.
47. Construction site fencing required per City of Palm Springs Ordinance 1523 combustible
constructionis 5,000 Sq.Ft.ormore or ifthe Fire Marshal deems necessary. A construction site
guard is required for combustible construction is over 10,000 Sq.Ft.orifthe Fire Marshal deems
necessary.
48. Fire apparatus access gates)are required and shall bea minimum of 14'inwidth. Gate(s)shall
be equipped with a KNOX locking device or key box per Uniform Fire Code,Article 9,Sec.

49. Provide a garden hose or hoses on construction site equipped with an adjustable spray nozzle
capable of reaching all combustible construction.
