HomeMy WebLinkAbout11/30/1999 - STAFF REPORTS DATE: November 30, 1999 TO: City Council FROM: City Clerk RESULTS OF 1999 CONSOLIDATED GENERAL & SPECIAL MUNICIPAL ELECTION RECOMMENDATION: That the Council declare the results of the 1999 Consolidated General & Special Municipal Elections; after which, newly elected officeholders will be sworn into office. BACKGROUND: In addition to the Municipal Election to elect the Mayor and two members of the City Council, each for a full four-year term, ending in 2003, the City Council called a special election to be consolidated with the Municipal Election for the purpose of placing on the ballot two alternative Charter Amendments concerning the WasteWater Treatment Plant and for advisory vote only, several measures relating to the continuance of the utility user tax. The results of the election have been certified by the Registrar of Voters, and are attached, showing that William G. Kleindienst was elected as Mayor and James Jones and Jeanne Reller-Spurgia were elected to the City Council; and that following measures were supported by the voters. MEASURE (U) Shall the citizen initiated charter amendment to prohibit leasing or selling the wastewater treatment plant to a private entity; to prohibit sewer fees and charges that exceed the cost of services, or are to pay administrative expenses of the city's general fund; and to prohibit borrowing by the city from the wastewater fund except for a declared emergency, be adopted? ADVISORY MEASURE (Y) Shall $400,000 of the revenue resulting from the continuance of the utility user tax at 5% be used for the purpose of funding parks, recreation and leisure activities, facilities and improvements in the city? Results 1A RESOLUTION NO. 19693 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, RECITING THE FACTS OF THE GENERAL AND SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON NOVEMBER 2, 1999, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW. WHEREAS a municipal election was held and conducted in the City of Palm Springs, California, on November 2, 1999, as required by law; and WHEREAS notice of said election was duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities; and WHEREAS on July 7, 1999, the City Council called a Special Municipal election to be consolidated with the November 2, 1999, general election for the purpose of placing advisory vote measures concerning continuation of the utility user tax; and WHEREAS on July 21, 1999, the City Council called a Special Municipal election to be consolidated with the November 2, 1999 general election, for the purpose of placing Charter amendments concerning the wastewater treatment plant; and WHEREAS pursuant to Resolution 19525 adopted June 2, 1999, the City Clerk of said City has caused the canvass of the returns of said election and has certified the results to this City Council, said results are received, attached and made a part hereof as Exhibit A, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as follows: Section 1. That there were 27 voting precincts established for the purpose of holding said election consisting of consolidations of the regular elections precincts in said City as established for the holding of state and county elections. Section 2. That said regular general municipal election was held for the purpose of electing the following officers of said City as required by laws relating to cities in the State of California, to-wit: ONE MAYOR AND TWO MEMBERS OF THE CITY COUNCIL, each for a full term of four years, Section 3. That said consolidated special election was held for the purpose of submitting the following measures to the electors of said City; to-wit: MEASURE U Shall the citizen initiated charter amendment to prohibit leasing or selling the wastewater treatment plant to a private entity; to prohibit sewer fees and charges that exceed the cost of services, or are to pay administrative expenses of the city's general fund; and to prohibit borrowing by the city from the wastewater fund except for a declared emergency, be adopted? MEASURE V Shall the city council initiated charter amendment to permit privatization of the wastewater treatment plant where the city sets rates; wherer rates can be decreased; where sewer fees and charges are limited consistent with State Law; and where borrbwning from enterprise funds is prohibited except in cases of a declared emergency or with a vote of the people, be adopted? Advisory Vote Only MEASURE W Shall the City Utility Tax on users of telephone services, electricity, gas and co- generated electricity be continued at a rate of 5%? MEASURE X Shall the City Utility Tax on users of telephone services , electricity, gas and co- generated electrricity be continued at a arte of 5% with no less than 50% to be used for Public Safety? MEASURE Y Shall $400,000 of the revenue resulting from the continuance of the utility user tax at 5% be used for the purpose of funding parks, recreation and leisure activities, facilities and improvements in the city? Section 5. That the number of votes given at each precinct and the number of votes given in the City to each of such persons above named for the respective offices for which said person was a candidate, are as listed in Exhibit A attached. Section 6. The City Council does hereby declare and determine that: William G. Kleindienst was elected to a full four-year term as Mayor; and James Jones and Jeanne Reller-Spurgin were elected to a full four-year term as a Members of the City Council. That as a result of said election, a majority of the qualified voters voting on Measure U relating to a citizen mitative concerning the wastewater treatment plant did vote in favor thereof, and that same measure was adopted; and Measure Y relating to the continuation of the utility user tax did vote in favor thereof, an advisory vote only. Section 8. The City Clerk shall enter on the records of the City Council of said City, a statement of result of said election, showing: (1) The measures voted upon and names of the persons voted for; (2) For what office each person was voted for; (3) The number of votes given at each precinct for and against each measure, and number of votes given to each person; (4) The number of votes given in the City for and against each measure, and the number of votes received by each person. Section 9. That the City Clerk shall immediately make and deliver to each of such persons so elected a Certificate of Election signed by the City Clerk and duly authenticated; that the City Clerk shall also administer to each person elected, the oath of Office prescribed in the State Constitution of the State of California and shall have them subscribe thereto and file the same in the Office of the City Clerk. Whereupon, each and all of said persons so elected shall be included into the respective office to which they have been elected. ADOPTED this 30th day of November , 1999 .
