DATE: November 3, 1999 TO: City Council FROM: Director of Planning&Building TENTATIVE TRACT MAP 29284 - APPLICATION BY JACK HERUSKA, REPRESENTING THE PAROCELA GROUP LLC , TO CONVERT AN EXISTING FOURTEEN(14)UNrr APARTMENT COMPLEX,COMMONLY KNOW N AS THE LAS CASITAS GARDEN APARTMENTS,INTO A THIRTEEN(13)UNIT CONDOMINIUM COMPLEX LOCATED AT 955 EAST PAROCELA PLACE. ZONE:R-2,SECTION 23. RECOMMENDATION: The Planning Commission recommends approval to the City Council ofTentative Tract Map 29284 thereby allowing the conversion of a fourteen(14)unit apartment complex into a thirteen (13)unit condominium complex subject to conditions contained in the attached resolution. BACKGROUND: Jack Hemska of the Parocela Group has submitted an application for Tentative Tract Map 29284 to facilitate the conversion of the fourteen(14)apartments commonly known as Las Casitas GardenApartments to thirteen(13)condominiumunits. Theparcel size is39,479 square feet There is approximately 12,000 square feet ofapartments which accounts for 30.41/6oftotal lot area. in an R-2 zone. The property was developed in 1978 and demonstrates a modern southwestern styleofarchitectae. Existmgrmmt onalamenitiesinchuleajacuzraandswimming pool which are included in the proposed common area totaling 11,344 square feet or 28.7%of the totalarea. Therewill be fourteen(14)carports;in thenorthwestem.comer oftheproperty and a total of six(6)open parking spaces. The landscaped area ofthe projec4 totaling front,side,and interiorplantersis7,984 square feetor202%oftbetotalarea. Patios comprise 9,435 square feet ofthe project or23%ofthe total area. The total square footage ofthe recreation/common area, patios and landscaping area exceed the R-2 performance standard requiring that at least 50%of the project be developed as usable landscaped open space,and outdoor living and recreation areas. Over the years some landscaping has been removed as plants have died so the site could benefit fromsomeinfillplaoting. As a recommmdedconditionofapprovaltheapplicantmustsubmit the landscaping plan prior to submittal of the Final Map for plan check. The R 2 zone allows a maximum of 3,000 square feet of lot area for each dwelling unit(MC 9203.03(C)). To meet current density andparking requirements the applicantis proposing to reduce the numberofunits from Nuteen(14)to thirteen(13). Three(3)existing one(1)bedroom units will be convertedto two(2)two(2)bedroom units. Intotal there will be eight(8)two(2) bedroom units ranging in size from 988 square feet to 1,074 square feet and five(5)one(1) bedroom units at approximately 746 sq.ft. /OP Q /too The Zoning Ordinancerequiresatotalof22paddng spaces forthisproject. This includes one(1) guest space for each four(4)units. There are currently twenty(2 1)parking spaces on-site. One (1)existingpaddng space willbe eliminated withthe installation ofanAmmicanswithDisabilities (ADA)compliantparkingspace. Therefore,the project is two(2)parking spaces short ofthe required parking. In view ofthis,the condominium conversion is conditioned to apply for an Administrative Minor Modification to address the parking deficiency should the project be approved. The four(4)bay parking spaces in the front ofthe property are conditioned to be decoratively paved. Theprojectisin compliance with lotsize,and dimensionrequirementsfor then 2zoneaswellas all development standards ofthe City ofPshn Springs ZoningOrdinance. A small exception is that the perimeter wall will not be required to be raised from 4.5 feet to six(6)feet where abutting R-1 properties in view of the difficulty in matching the existing wall. The project contains two(2)registered rent control units. These units can be converted to condominimnstatus. The rent controlledtenancies are still subjectto the standards ofMeasure KK,the current rent control ordinance for the City of Palm Springs,refer condition no.2. The City of Palm Springs rental housing stock will be analyzed in anew study just contracted for withDavidPaulRosen and Associates. This reportwill contain infomiationregardingtheCity's housingstocl5 availability ofaffordablehousingunits,rentstructures,and otherhousing information. The mostrecentinformationon the housing market is from a 1992 estimate based on census data andBuildingDepartmentstatistics. This informationindicatesthatthere are 33,376umtsintheCity ofPalmSpdngs. Because about 8,331dwelling units are vacationorseasonalhomestheavailable totalhousingstockisestimatedat25,045.Approximately41%or 10,268 oftheseunits are rental units.The housing stock in Palm Springs is quite varied;halfofthe units we single familydetached or attached housing and many units are contained in rental properties of five(5)to fifty(50)units. The Fiscal Year 1995 Consolidated Plan of the City of Palm Springs draws a number of conclusions regarding the City's housing stock. On a numerical basis,the City appears to have enough housing units to satisfy current demand and still provide the elasticity needed to absorb normalmovement and growth.However,many oftheunits inthe City arenot available to low and moderate income families because they arevacationhomes. Still otherhomes are priced well beyond the reach of low and moderate income households. The applicant has complied with the noticing requirements ofthe Subdivision Map Act relative to the noticing ofthe tenants sixty(60)days in advance ofthe intentto convert to condominiums and has submittedproofofservice and copies ofthe letters to all tenants. Additionally,the applicant has submitted copies ofthe correspondence that will give the tenants notice that the condominium projecthas been approved,(ifitis approved),and advising them oftheirrightoffirstref isalaswell as the 180 day written notice that the tenancy may be Wiminated due to the pending condominium conversion. ZONING/LAND USES: North: R 2,multi-family dwellings and hotels ZONING/LAND USES: North: R-2,multi-family dwellings and hotels South: R 1-C,single family dwellings East: R 2,R 1-C,multi-family dwellings and single family dwellings West: R 2, single family dwellings ENVIRONMENTAL ANALYSIS AND NOTIFICATION: In that this condominium conversion creates no new land use impact the proj ect is eligible fora categoricalexemptionperthestandardsofCahf =EmmomnenWQualityAct,(CEQA),Section 15301,existing facilities. All property ownm within a400footmdius ofthepawel considered forsubdivisionwerenotified as well as all tenants within the proj ect,pursuant to the requirements of the Subdivision Map Act. PLANNING ACTION In response to the Planning Commission's concerns associated with tenant displacement swmas provided a condition,with the applicant's endorsement,providing for a$1,000 amount to assist in relocating any tenants that may be displaced in the condominium conversion process. Additionally,the project is conditioned with an option for tenants to purcbaw thwmut for$10,000 less than the market rate fora one(1)bedroom unit and for$12,500 less than the marketrate for atwo(2)bedroomunit. The projectisfinther conditioned to provide an additional discountto current resident buyers in the form of a three percent(3%)purchase price reduction if no real estate agents or brokers are used. All Subdivision Map Act noticing requirements have been incorporated in the conditions of approval and in the findings.
