RATIFY AUTHORIZATION OF EXPENDITURES FOR EMERGENCY REPAIRS AND
CLEAN UP AT 538 NORTH PALM CANYON DRIVE.
RECOMMENDATION:
it is recommended that the City Council ratify the Acting City Managers approval of
$37,995.17 emergency dean up and repairs from fire at 538 North Palm Canyon Drive, plus
$12,000.00 to replace air conditioning unit, duct work and miscellaneous repairs, total cost
not to exceed$50,000. All costs will be reimbursed by insurance, less deductible of$5,000.
BACKGROUND:
The Palm Springs Municipal Code 3.12.270(3) authorizes the City Manager to approve the
emergency purchase of services to correct situations in which the public health, safety or
welfare would be interrupted if normal bidding procedures were followed. The code
requires all emergency purchases, which would otherwise require formal bidding, to be
brought to the City Council for ratification at the next regular meeting.
On Tuesday, June 6, 2000, at 11:28 p.m., a structure fire occurred at 538 North Palm
Canyon. This is the Palm Canyon Theatre. This structure is a designated historic building
dating from 1927. The fire damage was confined to the Southeast wing of the"U'shaped
structure. Firefighters were able to cut the fire off at the breezeway between the sculpture
hall and the costume rooms. However,the costume rooms, offices, lobby, and main theatre
suffered smoke and heat damage. The Northeast wing was not damaged. The building
was without electricity.
This City-owned building is leased to The Palm Canyon Theatre, Inc., a non-profit
corporation. According to the lease agreement, the City is to maintain fire and extended
coverage insurance. The Palm Canyon Theatre is responsible for its personal properly.
Due to the extent of the structural damage to the sculpture hall, this section was boarded
up, outside debris was removed and area was secured with chain link fence the following
day. A staff report will be brought back to the Council to address the structural damage of
the southeast wing at a later time.
The City obtained three quotes for structural cleaning and deodorization to the areas that
suffered smoke and heat damage. The scope of work was determined by the adjuster,who
was assigned by the insurance company and is working with the City Building Department
staff. The following quotes were submitted: American Restoration in the amount of
$29,750.00; Valentine Construction in the amount of $22,280.15; and Har-Bro, Inc. in the ��
amount of$16,880.60. The services were performed by Har-Bro, Inc.,the low bidder.
The following contractors were utilized to perform emergency services that were essential in
order to allow occupancy in the costume rooms, offices, lobby, and theatre.

NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm
Springs, ratifying authorization of expenditures for emergency repairs and dean up
at 538 North Palm Canyon Drive.

in order to allow occupancy in the costume rooms, offices, lobby, and theatre.
