WHITEWATER NPDES MUNICIPAL STORMWATER PERMIT RENEWAL
RECOMMENDATION:
That the City Council approve$18,500.00 maximum for the City's proportionate share
of the renewal of the Whitewater NPDES Municipal Stomhwater Permit in Fiscal Year
2000/2001.
BACKGROUND:
The City of Palm Springs is currently co-pernittee of the Whitewater NPDES Municipal
Stormwater Permit rPermitWth Riverside County Flood Control District, Coachella
Valley Water District County of Riverside and the other Incorporated Cities of Eastern
Riverside County.This permkwas required when,in 1972,the Federal Water Pollution
Control Act ((Clean Water Act (CWA)) was amended to provide that discharge of
pollutants to water of the United States from any point source is effectively prohibited,
unless the disdharge is in compliance with a National Pollutant Discharge Elimination
System (NPDES) Permit. Amendments to the CWA in 1987 added Section 402(p)
establishing a framework for regulating municipal and industrial storm water discharges
under the NPDES program.The U.S.Environmental Protection Agency published final
regulations establishing application requirements for storm water permits and the CA
Regional Water Quarity Control Board designated the Whitswater River Basin as an
area required to have a pemhit for municipal separate storm water systems.
Riverside County Flood Control and Water Conservation District(RCFC) is the lead
agency representing and advising the Coachella Valley Cites under this Permit The
Pemmit expires May 22,2001. RCFC has requested that the cD-pernitees participate
their proportionate share of the cost to retain a qualified consulting firth to assist in the
renewal process of the Permit The renewal process includes but is not limited to a)an
assessment ofthe Permitees'current municipal stormwater management program and
written recommendations for improvement, b)coordinate review of Permitees'current
municipal stormwater management program and development and preparation of the
Report of Waste Discharge(ROWD),and c)assist Pernittees'in negotiating provisions
of the new NPDES municipal stormwater permit with the Regional Board staff.
The formula used for cost sharing is in accordance with the currently effective NPDES
Pemmit Implementation Agreement The City share is based on population figures
obtained from the CA Department of Finance.The total population of the Whitewater
Permit Area divided into the City population produces the percentage the City pays.
RCFC and Coachella Valley Water District each pay 7% of the total cost and the
remainder co-pernittees pay their proportionate share of the balance.

Staff recommends that the City Council approve the$18,500.00 maximum expenditure.
The proposed 2000l01 Budget Includes these funds under the City CSA152 account
no. 124-4242-43200. If the City were to prepare and submit its own Permit the cost
would far exceed this.

CALIFORNIA, APPROVING $18,500.00 TO BE BUDGETED
FOR THE CIIY'S PROPORTIONATE SHARE OF THE
RENEWAL OF THE WHITEWATER NPDES MUNICIPAL
STORMWATER PERMIT.
WHEREAS, the City of Palm Springs is currently a co-permittee of the Whitewater NPDES
Municipal St mwmter Permit(°Permit);and
WHEREAS,on May 22,2001 the permit expires;and
WHEREAS,the Per itrenewal process is administered by Riverside County Flood Control and
Water Conservation District(RCFC) and they have advised the capermittees that it will be
necessary to retain the services of a qualified consulting firm to assist in said renewal process,
the cost of said consultant to be shared by all co-per ittees;and
WHEREAS, the formula used for cost sharing is in accordance with the currently effective
NPDES Permit Implementation Agreement. The City share is based on population figures
