WASTEWATER TREATMENT CITY SERVICES DIRECT CHARGES CONTRACT
RECOMMENDATION:
Last November, the voters approved Measure "U" which, among other things,
prohibited the payment of an "Administrative Service Charge" to the City from the
Wastewater Treatment Plant Fund. The Measure did not regulate the ability for the
Wastewater Treatment Plant to contract for services that it needed for its safe and
efficient operation.
The Wastewater Treatment Plant Fund is in need of legal, financial, contract
administration, engineering design, billing and many other services which may be
procured from the City. Attached is a Direct Charges Contract proposed by the
Wastewater Treatment Plant Fund for use in procuring services from the City. The
contract specifies that the City will be compensated based upon the hourly rate of the
individual providing said services plus a 20% overhead factor. In addition, if City
equipment is utilized, it shall be charged based on hourly rates established in the
Green Book (An Engineering publication regularly utilized for this purpose.)
A Minute Order approving the contract is attached for City Council consideration.

DIRECT CHARGES CONTRACT
THIS DIRECT CHARGES CONTRACT(this`Contract')is made and entered into this
day of . 2000 ('Agreement Date"), by and between Palm Springs
Wastewater Treatment Plant Fund('Owner') and the City of Palm Springs (°Contractor").

WHEREAS Resolution No. 19794, adopted May 17, 2000, set sewer service fee rate base
component policy which included "Direct Contract Charges for Services"; and
WHEREAS Owner wishes to formalize a Direct Charges Contract with Contractor to acquire
needed services for the operation,maintenance and expansion of the Wastewater Treatment
Plant,
NOW THEREFORE the parties hereto agree as follows:
1. Purpose:The purpose of this contract document is to formalize the acquisition,from
the Contractor, of support services needed for the operation, maintenance and
expansion of the Palm Springs Wastewater Treatment Plant.
2. Term:The term of the Contract shall commence as of July 1,2000,and be on a year-
to-year basis with automatic renewal to occur so long as owner requires services.
3. Services:The services which may be requested by owner shall include the following:
a) Legal g) Facility Maintenance
b) Financial h) Printing
c) Contract Administration 1) Landscape Maintenance
d) Engineering Design j) Street Maintenance
e) Motor Vehicle Maintenance k) Risk Management
f) Billing/Collections 1) Other services for safe,
efficient operations of the Plant
4. Compensation:The Contractor shall be paid for services provided based upon the
hourly rate of the employee providing services plus an overhead factor of 20%. When
the City equipment is utilized, it shall be rented on an hourly rate based upon rates
listed in the Green Book.
5. Procedures: Contractor shall invoice Owner for services specifying time provided at
the applicable rate for the subject employee. Finance Director is authorized to pay
invoices from Wastewater Treatment Plant funds and deposit the payment in the
billing activities fund.
6. Termination:Either party may terminate this Contract by providing 180 days notice in
writing to the other party.

OF SERVICES FROM THE CITY BY THE
WASTEWATER TREATMENT PLANT FUND.
I HEREBY CERTIFY that this Minute Order, approving a Direct Charges
Contract between the Wastewater Treatment Plant Fund and the City of Palm
Springs for procurement of services from the City by the Wastewater
Treatment Plant Fund, was adopted by the City Council of the City of Palm
Springs, California, in a meeting thereof held on the 21"day of June 2000.
