Developer now plans to complete landscaping in mid of fiscal year 2000/01.When landscaping is complete and ready to be turned over to the City for maintenance(under PMD No.9),the City will obtain an annual maintenance cost from the new Padcway Maintenance Contractor.`The Groundskeeper"and those costs will be amounted for in next years Engineer's Report in June, 2001. OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA DECLARING ITS INTENTION TO LEVY AND COLLECT ASSESSMENTS FOR PARKWAYS MAINTENANCE DISTRICT NO. 9 "THE SPRINGS'- TRACT 26364-1 (A NEW 77 UNIT SUBDIVISION AT SUNRISE WAY AND RACQUET CLUB DRIVE) FOR FISCAL YEAR 2000/01, AND FIXING A TIME AND PLACE FOR HEARING THEREON. (PMD NO. 9-THE SPRINGS) The City Council of the City of Palm Springs, California, does hereby resolve as follows: Section 1. Declaration of Intent-The City Council does hereby declare its intent to levy and collect assessments within Parkway Maintenance No.9'The Springs"-Tract 26364- 1 (Sunrise Way& Racquet Club Drive)for fiscal year 2000/01. Section 2. Description of Work-The public interest, convenience and necessity require, and it is the intention of the City Council to order the following work to be done, to wit: A. Plant, replace, trim, water and generally maintain the trees and shrubs within Parkways Maintenance District No. 9 'The Springs" (Parkway on west side of Sunrise Way from Via Escuela to Racquet Club Dr.) Tract 26364-1. B. Repair, replace and maintain irrigation systems necessary for the growth of the vegetation with the District. Section 3. Description of Assessment District-The City Council hereby makes the expenses of said maintenance chargeable upon the District hereby declared to be the areas benefitted by said maintenance and to be assessed to pay the costs and expenses thereof,said assessments to be collected as a part of the property tax assessment by the County Tax Collector's Office. Section 4. Engineer's Report - All of the said work to be done shall be as shown on the Boundary Map of the District,on file in the office of the Contracts Administrator,and in accordance with the Engineer's Report on file in the office of the City Clerk. The City Council hereby approves the Engineer's Report and reference is hereby made to same for a more particular description of said work;and the same is incorporated herein and made a part hereof. (The developer was delayed and has not yet installed all of the required landscaping, but plans to install the remainder of the landscaping in 2000/01.(Note:$0 Assessment for the 77lots in PM No 9 for Year 2000/01 due to accrued surplus in 99/00 and 98/99 because developer delay). z:u%CD}zaoi 6-aam.xes. /� Resolution for PMD-9(The Springs)-Page 2 Section 5. Time and Place of Hearing-Notice is hereby given that on July 19,2000,at the hour of 7:00 p.m. in the City Council Chamber, 3200 E. Tahquitz Canyon Way, Palm Springs, California. Any and all persons having any objection to the proposed assessment,the extent of the assessment districts, may appear and show cause why said assessment should not be carried out in accordance with this Resolution. Protests must be in writing and delivered to the City Clerk prior to the time set forthe hearing. Section 6. Improvement Act-All of the work herein proposed shall be accomplished pursuant to the "Landscaping and Lighting Act of 1972 being Division 15, Part 2 of the California Streets& Highway Code. Section 7. Publication of Proceeding - The "Desert Sun" a daily newspaper, printed and circulated in the City of Palm Springs, is hereby designated as the newspaper in which this resolution and all other publications in the proceedings under this resolution shall be published by the City Clerk.
