HomeMy WebLinkAbout6/21/2000 - STAFF REPORTS (11) i DATE: June 21, 2000 TO: City Council FROM: City Engineer VACATION OF A PORTION OF THE RIGHT-OF-WAY DEDICATED FOR THE PUBLIC STREET NAMED PASEO DE ANZA, FROM VIA ESCUELA TO RACQUET CLUB ROAD, IN SECTION 2,T. 4 S., R. 4 E; FILE R-97-017. RECOMMENDATION: That the City Council adopt a resolution of intention to vacate the easterly five feet of the right-of-way dedicated for the public street named Paseo De Anza,from Via Escuela to Racquet Club Road, in Section 2, Township 4 South, Range 4 East, under the provisions of Chapter 3, Part 3, Division 9 of the Streets and Highways Code of the State of California. BACKGROUND: The City has been petitioned by Land Development Design Corporation, representatives of the owner of land adjacent to Paseo De Anza, to vacate the easterly five feet of Paseo De Anze dedicated to the City first as an easement for road purposes, Instrument#12980 recorded February 9, 1962,and as a portion of Lot"A",of Tract Map 26364-1,for public street and public utility purposes,recorded in Map Book 262, pages 45-47,April 14, 1997. Paseo De Anza is designated as a local residential street,which is required by the General Plan to have a right-of-waywidth of fifty feet The right-of-way dedications for the easterly half of Paseo De Anza provided thirty feet of right-of-way, leaving an excess of five feet that is not required for public use. The proposed right-of-way vacation was determined to be consistent with the General Plan,Case No. 10A26, and approved by the Planning Commission at its June 14, 2000, meeting. If the City Council desires to approve the proposed right-of-way vacation, it is recommended that the attached Resolution of Intention be adopted scheduling a Public Hearing for the proposed right-of-way vacation for July 19, 2000. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as follows: Section 1. Thatthe City Council does hereby signify and declare its intention to vacate the easterly five (5) feet of that portion of the public street named Paseo de Anza lying between Via Escuela and Racquet Club Road, in said City, as shown on Exhibit A and described in Exhibit B attached hereto and made a part hereof. Section 2. That the City Engineer of the said City is to hereby conspicuously post along the line of that part of Paseo de Anza proposed to be vacated at not more than 300 foot intervals, but not less than 3 in all on said portion of street, notices of street vacation. Such notices shall state passage of the Resolution of Intention,the time and place of hearing all persons interested in, or objecting to, the proposed vacation. Section 3. On the 19`h day of July 2000, at the hour of 7:p0 p.m. on said date, in the City Council Chambers at 3200 E. Tahquitz Canyon Way, Palm Springs, California, being, and the same is hereby, fixed as the time and place of hearing any and all persons interested in or objecting to the said proposed street vacation, said time being not less than 15 days from the date of adoption of this Resolution.
