HomeMy WebLinkAbout6/21/2000 - STAFF REPORTS (7) DATE: June 21, 2000 TO: City Council FROM: Assistant City Manager-Special Projects via Director of Aviation ARFF STATION EXPANSION ARCHITECTURAL CONTRACT RECOMMENDATION: The Airport Commission recommends City Council approval of a professional services agreementwith John R.Trueblood,Architect,for architectural design services related to the ARFF Facility Expansion in an amount not to exceed $66,000. BACKGROUND: This year's Airport Improvement Program(AIP)entitlement dollars have been proposed for a Master Plan update, a new ARFF truck, and an expansion of the ARFF facilityto house the new truck. The Airport conducted a public solicitation for architects to design the ARFF expansion and received only one response from John R. Trueblood. The limited response is typical of design professional RFP responses at this time as they are all too busy to take on time- sensitive design work. A standard form professional services agreement has been negotiated with Mr.Trueblood. The total design and field oversight fee is$60,215,plus a reimbursable allowance of$5785, bringing the total contact to $66,000. The estimated facility expansion budget is set at $430,000. The AIP grants to cover 90%of the cost are expected in the next 60 days and the Airport's 10% is budgeted in this year's budget. A Minute Order is attached for City Council consideration. a.". Minute Order O B1f CEPS OF fINM 1(/Y\ CITY OF PALM SPRINGS CONTRACT SERVICES AGREEMENT FOR PALM SPRINGS INTERNATIONAL AIRPORT ARFF Station Expansion Architectural Services THIS CONTRACT SERVICES AGREEMENT(herein "Agreement") is made and entered into this_day of , 2000, by and between the CITY OF PALM SPRINGS, a municipal corporation (herein "City") and JOHN R. TRUEBLOOD, ARCHITECT and CHRISTOPHER S. MU.I.S, ARCHITECT, a Joint Venture (herein "Contractor"). (The term Contractor includes professionals performing in a consulting capacity). NOW, THEREFORE, the parties hereto agree as follows: 1.0 SERVICES OF CONTRACTOR 1.1 Scope of Services. In compliance with all of the terms and conditions of this Agreement, the Contractor shall perform the work or services set forth in the "Scope of Services and Special Conditions" attached hereto as Exhibit "A" and incorporated herein by reference. Contractor warrants that all work and services set forth in the Scope of Services will be performed in a competent, professional and satisfactory manner. 1.2 CCQ pliai a With Law. All work and services rendered hereunder shall be provided in accordance with all ordinances,resolutions,statutes,rules,and regulations of the City and any Federal, State or local governmental agency of competent jurisdiction. 1.3 Licenses, Permits_Rem and Assessments. Contractor shall obtain at its Sole cost and expense such licenses, permits and approvals as may be required by law for the performance of the services required by this Agreement. 2.0 COMPENSATION 2.1 Contract Sum. For the services rendered pursuant to this Agreement, Contractor shall be compensated in accordance with the "Schedule of Compensation&Performance" attached hereto as Exhibit"B"and incorporated herein by this reference,but not exceeding the maximum contract amount of Sixty Six Thousand Dollars($66,000). 2.2 Method of Payment. Provided that Contractor is not in default under the terms of this Agreement, Contractor shall be paid as outlined in Exhibit "B", Schedule of Compensation. 3.0 COORDINATION OF WORK 3.1 Rgpresentative of Contractor. John R. Trueblood and Chrs her S. Mills are hereby designated as being the principal and representatives of Contractor authorized to act in its behalf with respect to the work and services specified herein and make all decisions in connection therewith. .z mW=W RwbW ONIM 1- EXHBIT "A' SCOPE OF SERVICES&SPECIAL REQUIREMENTS Contractor to provide full range of services necessary to complete bid documents for the expansion of the Palm Springs International Airport ARFF Building expansion project. The Airport Fire Station is need of expansion to its apparatus bays to accommodate new and larger aircraft rescue firefighting equipment. The expansion of the bays will be approximately 56' x 45' divided into four bays with roll-up doors. One bay s 1 be equipped with a mainterime/inspection ph. The doorways,as well as the roof structure,must be able to accommodate apparatus 14' tall and I I' wide. For Scope, see attached John R. Trueblood proposal dated April 28, 2000, and the following: Plan approval must be received from Planning Commission, Airport Commission and the Federal Aviation Administration. Approval processing, including all required submittal drawings,is within Scope of Services. TITLE VI ASSURANCES A. The Architect further agrees that: During the performance of this contract, the Architect, for itself, its assignees and successors in interest(hereinafter referred to as the"Architect')agrees as follows: 1. Compliance with Regulations. The Architect shall comply with the Regulations relative to nondiscrimination in federally assisted programs of the Department of Transportation (hereinafter, 'DOT') Title 49, Code of Federal Regulations, Part 21, as they may be amended from time to time(hereinafter referred to as the Regulations)which are herein incorporated by reference and made a part of this contract. 2. Nondiscrimination. The Architect, with regard to the work performed by it during the contract, shall not discriminate on the grounds of race, color, or national origin in the selection and retention of subcontractors,including procurement of materials and leases of nuipment. The Architect shall not participate either directly or indirectly in the discrimination prohibited by section 21.5 of the Regulations, including employment practices when the contract covers a program set forth in Appendix B of the Regulations. 3. Solicitation for Subcontracts,including Procurement of Materials and Equip ment. In all solicitations,either by competitive bidding or negotiations made by the Architect for work to be performed under a subcenhact, including procurement of materials or leases of equipment,each potential subcontractor or leer shall be notified by the Architect of the Architect's obligations under this contract and the Regulations relative to nondiscrimination on the grounds of race, color,or national origin. 4. Information and Reports The Architect shall provide all information and reports required by the regulations or directives issued pursuant thereto and shall permit access to its books, records,accounts,other sources of information and its facilities as may be determined by the City or the Federal Aviation Administration (FAA) to be to ascertain compliance with such Regulations, orders, and instructors. Where eaan information required of a contractor is in the exclusive possession of another who fails or refuses to furnish this information, the Architect shall so certify to the City or the FAA, as appropriate, and shall set forth what efforts it has made to obtain the information. 5. Sanctions for Noncompliance. In the event of the Architect's noncompliance with the nondiscrimination revisions of this Comm,the City shall impose such contract sanctions as it or the FAA may determine to be appropriate, including, but riot limited to: a. withholding of payments to the Architect under the contract until the Architect complies, and/or b. cancellation, termination, or suspension of the contract, in whole or in part. 6. Incorporation of Provisions. The Architect shall include the provisions of paragraphs 1 through 5 inevery subcontract including procurement of materials and leases of equipment, 10 3A3 unless exempt by the Regulations or directives issued pursuant thereto. The Architect shall take such action with respect to any subcontract or procurement as the City or the FAA may direct as a means of enforcing such provisions including sanctions for noncompliance. Provided, however that in the event a contractor becomes involved in, or is threatened with,litigation with a subcontractor or su hers as a result of such direction,the Architect may reQaest the City to enter into such 14hgation to protect the interests of the City and, in addition, the Architect may request the United States to enter into such litigation to protect the interests of the United States. B. Disadvantaged Business Enterprise(DBE)Assurances 1. Policy. It is the policy of the Depaztment of Transportation(DOT) that disadvantaged business enterprises as defined in 9 CPR Part 23 shall have the maximum oppo to participate in the performance of contracts financed in whole or in part whh federal funds under this agreement. Consequently, the DBE requirements of 49 CFR Part 23 apply to this agreement. 2. DBEIWBE Obligation. The Architect agrees to ensure that minority business enterprises as defined in 49 CPR Part 23 have the maximum opporumity to participate in the performance of contracts and subcontracts fma=in whole or in part with federal funds provided under this agreement. In this regard all contractors shall take all necessary and reasonable steps in accordance with 49 CFR to ensure that minority business enterprises have the maximum to compete for and perform contracts. Contractors shall not discriminate on the bee is of to national origin,or sex in the award and performance of DOT-assisted contracts. 11 13MIBIT "B" SCHEDULE OF COMPENSATION&PERFORMANCE Contractor shall be compensated monthly based upon the percentage of work completed in each of the areas(total contract not to exceed$60,215, listed on the attached"Proposed Fee Tabulation"matrix,plus reimbursables at cost plus 10% not to exceed$5785.
