RECOMMENDATION.
That tie City Council award contract to James IL Simon, Co., in the amount of
$169,751.00, for die Library Center Repainting and Monument Sign, Schedules
A, C, and D, City Project No. 98-28.

BACKGROUND:
Since its construction in 1975,the Palm Springs Library Carter has undergone two
interior renovations. The 1994 renovation included moving the front entrance
from the South side of the building to the Fast side,and in the intervening years
vanous
primarily two vandalism a of the te'water have been or repaired as ' duedamage.However,the exterior of the building has
now undergone any maintenance is its entirely.
The lamed portions of the stucco on the fiscia,exterior and garden walls,and&a
v{ood soilit on the lower and higher roofs are showing signs•of severe
deterioration, decay and diwolorahon ficah water damage and must be repaired
and/or replaced,repainted and restained.
Interactive Design Corporation was obtained as the City's consultant to prepare
speacations for the required library repair work, The work of this contract is
included in four schedules. Schedules Act C induced the following work on the
Library Center building:
1. Muor demolition and removal of damaged stucco v
2• Repair and installation of wood soft at Main Entry only;
3. Repair and repainting of plaster soffits at building and walls;
4. Prep and paint stucco at mssomy wads;
5. Repair and installation of wood soft at high root;
6. Investigation and repair of roof drain lines.
Schedule B is the demolition of the original wooden sign and the construction of a
ntw monument sign at the Badstd Road entrance.It is the Board's wish that the
Present sign be replaced with a more highly vable and readable precast concrete
monument sign,which will reflect the lines of the building and exterior walls. The
new sign would include the SUNRISE PLAZA location and VIRTUAL
UNIVERSITY in bronze finish metal letters.
The work on Schedule B includes:
1. Remove existing signage and related items;
2. Prepare foundation;
3. Install now monument siga,'Rlace letters and related work;
4. Install lightwg and landscape•area around sign

The work on Schedule D inchhdea:
1. Preparation and application of waterproof coating
The scope ofwork and cost include of all appurtenant material,equipment, and
labor.
Schedules A,B, C and D were put out to bid together in the hope and belief that
having one sole contractor would be more cost and time effective. It is essential
that the deadline of November 4! 1999 be met as the Library is expected to look
its best to the 25,00 delegates oftbe California Library Association Annual
Coherence to be held November 12-16, 1999.
On August 19 and 26, 1999, the project was advertised for bids and, at 2:30
p.m. on September 7, 19999 the Procurement Division received bids from the
following contractors:

The consulting engineer's estimate was$29,937.50 for Schedule A, $18,000 for
Schedule B. $66,250.00 for Schedule C. and$18,000.00 for Schedule D, a total
of$132,187.501 It is believed that the currant level of activity in the
construction marketplace have induced fewer bids with increased bid prices. In
light of the bids which were received in excess of the consulting engineer's
estimate, the work included in Schedule B has not been selected for award.
The low bid was submitted by James E. Simon, Co., from Indio, CA. The
Company is a corporation and the principals of the firm are: James E. Simon,
President; Jeffrey J. Herrington, Vice-President; and Jon M. Roessler, Vice-
President.
Sufficient funds are available from the Library Endowment Fund(151-2752).
Specific account mmnber to.be assigned. If necessary,some additional funding
money will be used from the Passport Revenue Fund(Account# 151-2752440401
and from gib funds ftm Friends of the Library. There will be no impact upon the
City's General Fiend

THE 1999-00 FISCAL YEAR.
WHEREAS Resolution 19541, approving the budget for the fiscal year
1999-00 was adopted on June 16, 1999; and
WHEREAS the City Manager has recommended, and the City Council
desires to approve, certain amendments to said budget;

NOTICE INVITING BIDS
PALM SPRINGS LIBRARY CENTER REPAINT AND MONUMENT SIGN
City Project No. 98-28 (Repainting)
N-1. NOTICE IS HEREBY GIVEN that sealed bids for the Palm Springs Library Center Repainting and
Monument Sign will be received at the office of the Procurement Manager of the City of Palm Springs,
California, until 2:30 pm on Tuesday, September 7,1999 at which time they will be opened and read
aloud.
N-2 DESCRIPTION OF THE WORK:The Work of this Contract comprises the repair and repainting
of the exterior of the Palm Springs Library Center and installation of a monument sign on Baristo
Road.
On the Library Center building:
1. Repair miscellaneous plaster and prepare for painting;
2. Paint all plaster soffits and garden walls;
3. Remove and install new wood soffit material over new drywall backing on existing
metal framing system.
At the Baristo Road entry;
1. Remove existing signage and related Items;
2. Construct new monument sign and related work.
All appurtenant material, equipment, labor and work.
N3 AWARD OF CONTRACT:
(a) The City reserves the right after opening bids to reject any or all bids, to waive any informality
(non-responsiveness) in a bid, or to make award to the lowest responsive, responsible bidder
on the basis of the sum of Bid Schedules A plus B plus C, and reject all other bids, as it may
best serve the interest of the City.
(b) As a condition of award, the successful bidder will be required to submit payment and
performance bonds and Insurance.
(c) Contractor shall bid on&I bid schedules.
N-4 BID SECURITY: Each bid shell be accompanied by a certified or cashier's check or Bid Bond in
the amount of 10 percent of the total bid price, the sum of Bid Schedules A plus B plus C, payable to
the City of Palm Springs.
N-6 BIDS TO REMAIN OPEN: The Bidder shall guarantee the Total Bid Price for a period of 60
calendar days from the date of bid opening.
N-6 CONTRACTOR'S LICENSE CLASSIFICATION: The Contractor shall possess a valid Class B
Contractor license at the time of submitting bids.
N-7 PREVAILING WAGE RATES NOT APPLICABLE: Funding for the Work is with all local funds
and, as provided under City Charter, will NOT require compliance with the prevailing wage
requirements of the State of California.
N-8 RETAINAGE FROM PAYMENTS: The Contractor may elect to receive 100 percent of
payments due under the Contract Documents from time to time, without retention of any portion of
the payment by the City, by depositing securities of equivalent value with the City in accordance with
the provisions of Section 22300 of the Public Contract Code.

N-9 PRE-BID VISIT TO WORK SITE: Prospective bidders are strongly recommended to attend a pre-
bid walk through of the proposed work site and existing facilities which will be conducted by the City
at 2:00 p.m. on Tuesday, August 31, 1999. Failure to participate in'the pre-bid walk through may
disqualify a bidder as non-responsive.
N-10 OBTAINING OR INSPECTING CONTRACT DOCUMENTS:
(a) Contract Documents may be inspected without charge at the office of the City Engineer,
3200 East Tahquitz Canyon Way, Palm Springs, CA 92262.
(b) Complete sets of said Contract Documents may be purchased at fifteen dollars per set and are
obtainable from the office of the City Engineer, 3200 East Tahquitz Canyon Way, Palm
Springs, CA 92262. No refund will be made of any charges for sets of Contract Documents.
(c) An additional fee of $15.00 will be charged for sets of documents sent by mail.
N-11 ADDRESS AND MARKING OF BIDS: The envelope enclosing the Bid shell be sealed and
addressed to the City of Palm Springs, and shall be delivered or mailed to the Procurement Manager at
3200 East Tahquitz Canyon Way, Palm Springs, CA 92262. The envelope shall be plainly marked in
the upper left hand comer with the name and address of the Bidder and shall bear the words "Bid
For..* followed by the title of the Project and the date and hour of opening Bids. The certified or
cashier's check or Bid Bond shall be enclosed in the same envelope with the Bid.
