AGREEMENT: CEMENT UNLIMITED;BASE, SEATING AREA AND INSTALLATION OF
CHARLIE FARRELL MEMORIAL
RECOMMENDATION:
That the City Council approve the agreement between the City and Cement Unlimited for
creation of an ardMectur*designed base and seating area and installation of the Charlie
Farrell Memorial bronze statue in an amount not to exceed $16,000 to be located at the
northeast comer of Tahquitz and El Cielo.
BACKGROUND:
To fulfill the Public Arts Commission's charge to enhance the environment and the unique
character of Palm5prings by providing forthe acquisition of quality works of art in pubic places,
the Commission worked together with a volunteer citizen fund-raising committee to create a
memorial to actor and former palm Springs Mayor,Charlie Farrel.
The citizen's group called The Friends of Charlie Farrell'hired ador/artist George Montgomery
to create the larger-than-ft bronze statue and raised sufficient funds required by the Arts
Commission to show community support of the protect prior to Arts Commission commitment
to participate. After several years of planning and fund-raising,the piece is now complete and
ready to be installed.
The Arts Commission has chosen the berm on El CJelo dust North of the fountain for placement
of the Memorial. The Airport location,directly across from City Hall,was chosen as the most
appropriate site,reflecting Charlie's connections to Palm Springs. Not only was Charlie Mayor
of Palm Springs from 1948 to 1953,and founder of the Racquet dub,he was Instrumental in the
efforts to release control of the Airport from the Federal Government after World War fi and
return It to the City of Palm Springs.
The 'Friends of Ctarlie Forrelr raised $30,000 to fund the statue. The Arts Commission
contributed$20,000 toward the cost of fabrication and agreed to provide additional funds for
site preparation and installation. Dr.Rceenson,new owner of the Racquet Club,is donating an
additional $10,000 toward construction of the base. The Arts Commission Is funding the
remaining $6,000 (account t 150-4408-500151 of the total $16,000 cost for the base and
installation. No General fund nxxW will be used for this project.Installation is expected to be
complete by mkt-September.

CEMENT UNLIMITED, IN A FORM ACCEPTABLE TO THE CRY
ATTORNEY, FOR CREATION OF AN ARCHITECTURALLY
DESIGNED BASE AND SEATING AREA AND INSTALLATION OF
THE CHARLE FARRELL MEMORIAL BRONZE STATUE IN AN
AMOUNT NOT TO EXCEED$16,000.00 TO BE LOCATED AT
THE NORTHEAST CORNER OF TAHOILM AND EL CIELO.
I HEREBY CERTIFY that the Minute Order approving the agreement between the City and Cement
Unlimited,In a form acceptable to the City Attorney,for creation of an arcs tecluraly designed base
and seating area and installation of the Chafe Farrell memorial bronze statute in an amount not
to exceed $16,000.00 to be located at the northeast caner of Tahquitz and El Cielo was adopted by
the City Council of the City of Palm Springs,California in a meeting thereof held on the 21st day of
July,1999.

CONTRACT SERVICES AGREEMENT FOR
Charlie Farrell Sculpture base, seating area. sidewalk and
sculpture installation.
THIS CONTRACT SERVICES AGREEMENT (herein "Agreement") , is made
and entered into this "o day of , 199 by and
between the CITY OF PALM SPRINGS, a un pal corporation (herein
"City") and CEMENT UNLIMITED (herein "Contractor") . The parties
hereto agree as follows:
1.0 SERVICES OF CONTRACTOR
1.1 Scope of Services. In compliance with all terms and
conditions of this Agreement, the Contractor shall provide those
services specified in the "Scope of Services" attached hereto as
Exhibit "A" and incorporated herein by this reference, which
services may be referred to herein as the "services" or "work"
hereunder. As a material inducement to the City entering into this
Agreement, Contractor represents and warrants that Contractor is a
provider of first class work and services and Contractor is
experienced in performing the work and services contemplated herein
and, in light of such status and experience, Contractor covenants
that it shall follow the highest professional standards in
performing the work and services required hereunder and that all
materials will be of good quality,. fit for the purpose intended.
1.2 Contractor's Proposal. The Scope of Services shall
include the Contractor's proposal or bid which shall be incorporated
herein by this reference as though fully set forth herein. In the
event of any inconsistency between the terms of such proposal and
this Agreement, the terms of this Agreement shall govern.
1.3 Compliance with Law. All services rendered hereunder
shall be provided in accordance with all ordinances, resolutions,
statutes, rules, and regulations of the City and any Federal, State
or local governmental agency having jurisdiction in effect at the
time service is rendered.
1.4 Licenses, Permits. Fees and Assessments. Contractor
shall obtain at its sole cost and expense such licenses, permits and
approvals as may be required by law for the performance of the
services required by this Agreement. Contractor shall have the sole
obligation to pay for any fees, assessments and taxes, plus
applicable penalties and interest, which may be imposed by law and
