RESOLUTION NO.
OF THE COMMUNITY REDEVELOPMENT AGENCY
OF THE CITY OF PALM SPRINGS, CALIFORNIA,
APPROVING A MUTUAL RECISSION OF A
DISPOSITION AND DEVELOPMENT AGREEMENT,
AS AMENDED, BETWEEN THE COMMUNITY
REDEVELOPMENT AGENCY OF THE CITY OF PALM
SPRINGS AND THE AGUA CALIENTE BAND OF
CAHUILLA INDIANS.
WHEREAS, effective October 24, 1994, the Community Redevelopment Agency of the
City of Palm Springs ("Agency")entered into a Disposition and Development Agreement
("DDA") with the Agua Caliente Band of Cahuilla Indians ("Tribe") relative to the
development of a Casino in Section 14 in Palm Springs; and
WHEREAS two Amendments to said DDA, effective.1996 and 1997, were approved by
the Tribe and the Agency; and
WHEREAS the Tribe has determined that events have changed, wherein they no longer
wish to proceed under the DDA, as amended; and
WHEREAS the parties may mutually rescind said DDA, as amended, in all respects; and
WHEREAS the parties may wish to retain any benefits or performance already received
or rendered under the DDA, as amended, but that no further action will be taken or
executed by either party pursuant to the DDA, as amended, effective upon execution of
the rescission.
NOW THEREFORE BE IT RESOLVED by the Community Redevelopment Agency of
of the City of Palm Springs, that the Disposition and Development Agreement entered into
between the Community Redevelopment Agency of the City of Palm Springs and the Agua
Caliente Band of Cahuilla Indians, effective October 24, 1994, as subsequently amended,
is hereby rescinded with the understanding that each party will retain any benefits or
performance already received or rendered under said agreement.
