Dear Sara:
Thank you for your follow-up to the meeting we had with the Attorney Genexai and
Mayor of Palm Springs concerning the above-referenced litigation.
After our meeting, I began to discuss the matter with Art Bunce, and his position was
still as you have summarized in your letter. This matter will be taken up with the City Council
at a future closed session, and we also have a joint meeting with the Tribal Council scheduled
within the next month where this will be a subject on the agenda. It is my hope that through
these meetings, this issue can be resolved.
I will forward your letter on to the entire City Council as well as Art Bunce himself.
We very much appreciate the time which the Attorney General took with us to hear our
perspectives on the litigation. I could tell that he sincerely wanted the litigation matter to be
resolved, and he is very understanding of the long and mutually-supportive relationship which
the City of Palm Springs has had with the Agua Caliente Band.

Dear W. Aleshire:
Attorney General Lockyer has requested that I follow up on our meeting of May 26 1999.
While the Attorney General appreciates your current situation,we do not believe that our
settlement of the above-referenced litigation is related to the City's dispute with the Agua
Caliente Band of Cahuilla Indians regarding their suggestion that the Disposition and
Development Agreement(DDA)at issue be rescinded.
As we have previously informed you,we are prepared to recommend settlement of this
litigation on the condition the Redevelopment Agency receives a letter from the Tribal Council
stating that nothing in the DDA prevents the Agency from objecting to the Band's proposal to
have the United States take the property it purchased from the City of Palm Springs into trust.
When I discussed this issue with Art Bunce in the past,he informed me that such a letter should
not be a problem,because he does not believe the DDA restricts the Agency's right to object to
the proposed trust conveyance. In addition, I interpret the DDA to require the Band to pay the
Agency's attorneys' fees for this litigation, which could be quite costly if not settled. For these
reasons,it would seem to me that the Band would not be adverse to sending the requested letter.
