SUBJECT: SCHOOL RESOURCE OFFICER
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to enter into a three year
agreement with the Palm Springs Unified School District to provide a full-time police officer on the
High School campus.
BACKGROUND:
For the past 24 year; the School District and City have entered into an agreement whereby the
School District pays a portion of the salary for a full-time police officer on the High School campus.
Both the School District and the Police Department wish to continue the program. The agreement
provides that the School District will pay the salary and benefits of an officer during the days school
is in session. The City then assumes the cost of the officer's salary and benefits when school is not
in session and services are not required.
The attached proposed 3 year agreement,commencing September 1, 1999,provides that the School
District will pay$75,624 annually for one police officer for the time school is in session. This
officer will be assigned to the High School campus and will work under the direction of the
Principal. The proposed agreement fiuther provides for 3 one-year extension options subject to
adjustment of the program cost acceptable to the parties.
No additional budget appropriation is necessary.

AGREEMENT FOR SCHOOL RESOURCE OFFICER SERVICES
BY AND BETWEEN THE CITY OF PALM SPRINGS
AND
THE PALM SPRINGS UNIFIED SCHOOL DISTRICT
WHEREAS, the Palm Springs Unified School District, hereinafter referred to as District,
pursuant to the provisions of the California Education Code,Section 12400,desires to continue to
cooperate with the City of Palm Springs, hereinafter referred to as City, and to continue its
Agreement with the City in order to insure the greater safety of students,the staff and the public at
the Palm Springs High School, and to improve and strengthen law enforcement on or about the
campus.
NOW,THEREFORE,it is agreed by and between the parties as follows:
1. The City shall provide to the District during the days school is in session one trained police
officer on a full-time basis with the equipment normally provided for his use by the Police
Department of the City for assignment to the District for the purpose of improving and
atrcnghtening law enforcement,particularly at Pahn Springs High School and inculcating
in the young an affection, respect and understanding of the role of law enforcement in
society.
2. The police officer shall work under the direction of the Palm Springs High School principal
under all normal circumstances for the purpose of enforcing school regulations and
protecting school property and persons thereon. The officer shall be on campus eight hours
per day,including his lunchtime,and will be subject to call,if necessary,during lunch. His
hours and site assignments shall be as designed by the High School principal. In instances
where crimes occur,the police officer shall not be prohibited from taking appropriate legal
law enforcement measures related thereto.
3. The police officer shall be expected to maintain radio contact with the high school
administration at all times. In the event the officer shall find it necessary to leave the
campus, the principal shall be notified in advance of the expected absence and the Police
Watch Commander shall be notified In such a circumstance,a patrol car shall be available
for immediate response to a school emergency.
4. The District will pay to the City annually for the initial three(3)year term of this agreement
for all services rendered under this agreement, the sum of$75,624 with payments to be
made upon billing by the City, calculated at the total rate of$6,302 for 12 months, to be
billed twice per year.
5. Neither District nor any officer or employee of District shall be responsible for any damage
or liability occurring by reason of any act or omission on the part of the City under or in
connection with any work, authority, or jurisdiction delegated to the City under this
Agreement. It is further understood and agreed that pursuant to Goverment Code§895.4,
City shall fully indemnify,defend,and hold District harmless from any liability imposed for
injury(as defined by Government Code §810.8)occurring by reason of any act or omission

on the part of the City under or in connection with any work, authority, or jurisdiction
delegated to the City under this Agreement.
6. Neither the City nor any officer or employee of the City shall be responsible for any damage
or liability occurring by reason of any act or omission on the part of the District under or in
connection with any work, authority, or jurisdiction delegated to the District under this
Agreement. it is further understood and agreed that pursuant to Government Code§895.4,
the District shall fully indemnify, defend, and hold the City harmless from any liability
imposed for injury (as defined by government Code §895.4, the District shall fully

of the District under or in connection with any work, authority,or jurisdiction delegated to
the District under this Agreement.
7. This agreement may be amended at any time by the mutual consent of the parties hereto and
may be terminated by either party upon 30 days written notice to the other of its intention
to do so. In the event this agreement is temtinated, the cost shall be prorated on the basis
on one-tenth per month of the actual services performed hereunder.
8. The initial term of this agreement shall be for three(3) years, commencing September 1,
1999 through August 1,2002. The agreement maybe extended for up to an additional three
(3)years, at one(1)year increments,by mutual consent of the City of Palm Springs Police
Chief and the District Superintendent. Prior to the extension hereof, the City of Palm
Springs Police Chief shall determine what adjustment shall be made to the compensation
set forth in Section 4 in order for the City to recover its costs and shall so inform the District
Superintendent. If agreeable to both parties, then the agreement may be extended as
provided herein.
IN WITNESS WHEREOF,the parties have executed and entered into this Agreement as
of the date first written above.

THREE YEAR AGREEMENT WITH THE PALM SPRINGS
UNIFIED SCHOOL DISTRICT, TO PROVIDE A FULL-TIME
POLICE OFFICER ON THE PALM SPRINGS HIGH SCHOOL
CAMPUS.
I HEREBY CERTIFY THAT this Minute Order,authorizing the City Manager to enter into a three
you agreement with the Palm Springs Unified School District to provide a full-time Police Officer
on the Palm Springs High School campus was adopted by the City Council of the City of Palm
Springs in a meeting thereof held on the 31 day of May,2000.
