CONSTRUCTION CHANGE ORDER NO. 1 TO 4-CON ENGINEERING, INC.
RECOMMENDATION:
That the City Council approve Construction Change Order No. 1 to 4-Con
Engineering, Inc., in the amount of$26,435.20 for a total contract cost of
$212,898.20,for Indian Avenue Overhead Seismic Retrofit project, City Project
No. 96-43.
BACKGROUND:
On October 6, 1999, City Council awarded 4-Con Engineering, Inc.the
contract for Indian Ave. Overhead Seismic Retrofit. The project consisted of
Me construction of reinforced concrete, manufacturing and installation of
structural steel, blast cleaning and painting , in order to seismically retrofit
Indian Ave. Bridge No. 56C-0026 which crosses over the Union Pacific
Railroad now the Palm Springs Train Station.
After construction had begun,the contractor was notified by the design
engineer of Moffatt&Nichol Engineers, that the structural steel members to be
manufactured for the project were considered to be'main members'. Due to
this designation, it was required that a significantly more stringent standard of
welding,testing and repair of these members be followed. This designation
and subsequent use of the higher standards resulted in additional costs being
incurred by the contractor. In addition to these are costs associated with
additional spot blasting, cleaning and undercoat painting due to actual
quantifies exceeding the original estimate.
This change order includes reimbursement of costs to the contractor due to
additional requirements dictated by the design engineers, and payment for
pertinent additional materials. The total adjustment to the agreement for these
items is$28,436.20.
Cal Trans has agreed to reimburse the City for all costs associated with this
change order. Sufficient funds to cover this change order are available in
account number 4491-50171 Indian Avenue Overhead Seismic Retro

C. REASONS FOR CUMOES:
Actual, measured quantities for bid schedule, item No. 8 (Spot Blast Clean and Paint Undercoat) were
in excess of the estimated quantity of 192 SF. Actual quantity was 256.74 SF. These quantities
were verified by the design engineer.
Transverse Tie Plates and Girder Brackets were designated as Main Members by the design engineer
after the start of construction. This designation required a significantly higher standard of welding,
testing, inspection and repair during the manufacturing process.
21 working days will be added to the contract for the additional work involved with girder brackets and
Tie plates.
• Note: No additional mark ups will be added to any Item on this Change Order.AN cost per each
hem are fatal.
