AWARD CONTRACT FOR CITYWIDE FLOOD GATE CONSTRUCTION
RECOMMENDATION:
That the City Council award contract to G & M Construction for Schedule A only,
in the amount of$11,000, for the Citywide Flood Gate construction, City Project
No. 99-18_
BACKGROUND:
The 1999/2000 Capital Improvement Budget included funds for construction of
flood gates on several of the City's major arterials where they crass the
Whitewater River, or other flood channels. The streets which were proposed for
the flood gates are, (1) Indian Canyon Drive across the Whitewater River, (2)
Gene Autry Trail across the Whitewater River, (3) Vista Chino across the
Whitewater River, (4) Golf Club Drive across Palm Canyon Wash, and Araby
Drive across Palm Canyon Wash.
The purpose of the flood gates is to allow for a complete physical closure of the
roadways in the event of a major rain storm which involves flows in the rivers or
the channels, as well as wind storms that would necessitate closure of the
roadways due to blowing or drifting sand. Currently, the City must set out
individual barricades and man those barricades to preclude people from driving
through the closed roadways. Use of the gates will not only make the closure a
less labor- intensive operation, but not require use of paid overtime personnel to
man the closure, because once the gates are closed and set in place, vehicles
will not be able to traverse the roadways.
Based on informal estimates from fencing contractors, it was projected that a
couple of these locations could be completed with the initial phase of this project.
Staff completed the preliminary design for all of the locations, except the Vista
Chino crossing (this crossing also involves Cathedral City), and brought the
designs before the Planning Commission for review. During the course of the
review process with the Planning Commission, staff received public direction from
a Planning Commissioner, who also is involved with the Desert Health Care
District, that funds would be available for the construction of all of the gates, if an
application was made to the Desert Health Care District. Staff then completed
the design for all of the gates, with the exception of the aforementioned Vista
Chino gate. These designs included the recommendations of the Planning
Commission which involved additional landscaping and aesthetic improvements
to the gates.
Simultaneously, the Fire Chief made application to the Desert Health Care District
for funds that would allow the construction of all 4 of the gates. Unfortunately, •
the application was not approved. Subsequent to this rejection, the Fire Chief
submitted a request to the Agua Caliente Tribe of Cahuilla Indians for a grant for
the construction of the flood gates. As of the date of this staff report, however,
there has been no approval of that grant.

The contract was divided into 4 bid schedules. Schedule A involves the
construction of the flood gates at Indian Canyon Drive at the Whitewater River,
Schedule B is the flood gates at Gene Autry Trail at the Whitewater River,
Schedule C is the flood gates at Araby Drive at the Palm Canyon Wash, and
Schedule D is the flood gates at Golf Club Drive at the Palm Canyon Wash.
On January 29 and February 5 2000, the project was advertised for bids and, at
2:00 p-m, on February 29, 2000, the Procurement Division received bids from the
following contractors:

Plans and specifications were prepared by Engineering staff and the Engineers
estimate was $44,605.
Due to the grant funds not being available for this project, it is recommended that
the Council revert to the concept as originally envisioned to construct a portion of
these flood gates as a first phase, and award Bid Schedule A only.
The low bid was submitted by G & M Construction- The company is a
Corporation, and its principals are George Marantz, Mike Marantz and Dianne
Marantz.
Sufficient funds are available in account No. 133-4298-50162 (Emergency Flood
Gates, Indian Canyon)

CITY-WIDE FLOOD GATES -Update by Engineering Department
Director stated that a Planning Commission subcommittee worked with the Engineering
Department on the redesign.
Dave Barakian, City Engineer, stated that the Commission's suggestions have been
incorporated into the gate design, including sheet metal in spaces at the ends and coaling;
that the Fire Chief is pursuing a grant for the extra costs involved, that the project will be
going to bid.
Director stated that the landscaping will be more freeform,giving more backdrop when the
gates are opened and shielding slightly from the approach, and that this a functional, safety
issue which will have visual appeal, yet blend in.

Director suggested doing a small-scale study as part ofSection 14, develop a program
for undergrounding all the utilities in Section 14xspread the cost among all, and it

stated that this could be a model for the 5ps'f of the City; however, at this time the
Planning Commission cannot change th equirement of the ordinance; and the other
option is to defer this portion to Phas I.
Applicant stated that there was other architect in the beginning; that he thought they
had passed Design Review; "at his client will wonder why redesign is necessary,
which will include startin ver from Walgreens in Chicago; that Walgreens process
takes time, which is why'it has taken him so long to come back to Commission. He
said that he tried to address comments made to the original architect; that he also tried
to address the entrvay issue, and when Phase II is done there will be a focal point.

SUPPLEMENTAL AGENDA-
CITY-WIDE FLOOD GATES - Update by Engineering Department regarding flood gates
proposed atl'o trtocafie r - Discussion.
Marcus Fuller, Associate Engineer, stated the Engineering Department is prepared to
move forward with a City project to install emergency gates on four City streets (Indian
Canyon Drive, Gene Autry Trail,Araby Drive, and Golf Club Drive). During high wind
storms or floods these gates can be swung shut quickly and efficiently to keep traffic
from getting sandblasted or swept away. Golf Club Drive has a landscaped median and
the current plans are showing additional plant material to be installed near the gates
to screen them. The gates will be on the median, but will not be highly visible until
they are closed. The other three locations are in areas where there are no landscaping
improvements. The gates are standard, galvanized metal pipe gates. The gates on Golf
Club Drive are single gates to avoid impacting the sidewalk, Indian Canyon Drive and
Gene Autry Trail locations will have double gates, and Araby Drive will have one
single-swing gate, as it is a narrow street. Installation of these gates is supported by
Police and Fire, as it facilitates street closures when needed.

Commissioners expressed concerns about aesthetics, and the need to camouflage the
appearance. Fuller responded to Commissioners comments, and stated that powder
coating (as opposed to galvanized) would be too expensive, with a proposed budget
of $30,000.
Blake Goetz, Assistant Fire Chief and City's Disaster Coordinator, stated that the City
had five federally-declared disasters in the 1990's, with the last one being last August
due to flash floods, during which the Fire Department rescued numerous people from
the washes. Other events have been wind storms or traffic accidents where the Fire
Department equipment gets severely damaged or lost, and that people should not be
out there. He further stated that the City does not have a closure policy; that only the
Police Department could decide when to close a road, but working officers did not
have the expertise to make the decision. It was decided that Police, Fire, or Streets
personnel should be allowed to determine road closure; that the current system of
using barricades requires that street workers be called out from home, resulting in lost
time, and that the public frequently ignores barricades, driving around them. He stated
that their solution is to install gates that can be easily closed, and can be reopened
much more quickly than removal of barricades; that the gates at Araby Drive, Indian
Canyon Drive and Gene Autry Trail will be subject to sandblasting; that the Golf Club
Drive location deserves more aesthetic consideration; and that the one area where a
gate is lacking is Vista Chino through the wash into Cathedral City (a partnership with
Cathedral City would be needed). Different materials and designs were considered,
and the final recommendation was based on the City Engineer's determination.
Commissioner concerns included: safety and visibility for drivers, advisability of gates
with "road closed" signs on them at entrance points to the City, and that methods could
be used to make them blend in. Suggestions included: improved aesthetic design,
lighting, painting (especially on Golf Club Drive), and camouflaging with boulders/
landscaping.
Assistant Fire Chief Goetz responded to questions by Commissioners, and stated that
"road closed" signs will be used and police personnel will coordinate until the signs
are in place, and that U-turns will be possible.
Director stated that the locations proposed are not normally subject to sand storms
during which visibility is severely impaired; that there is a need for a better way to
close the streets, and that the design concerns are secondary; and that the Commission do
could recommend an upgrade of materials, which would result in a higher price.
Goetz responded to comments, and stated that while rocks may look good as a
camouflage, vehicles are more likely to hit them; that color coded signs have been
posted in the washes so that public safety personnel can tell where the road is and how

deep the water is; that the signs have not been damaged after being in use for two
years; and that it only takes 8 inches of water to displace a car.
Chairman Mills stated that the pressure install to do it this year should not override the
need for a quality project with good aesthetics and he would be willing to assist the
Engineering Department.
Fuller stated that it is easy to accomplish a design for the gate itself or to do a treatment
to it; but he would recommend against adding more or creating a statement because
the gate itself in an open position is going to be an obstruction to traffic.
Director stated that additional information will be presented at a future Planning
Commission meeting.

— Director stated that Bob Mohler submitted a grant application for landscaping for 2.5 Iry
miles'on Gene Autry Trail, and 0.5 miles on Ramon Road.

basis of the total sum of Bid Schedules A through D inclusive, and
reject all other bids, as it may best serve the interest of the City.

Documents .
(b) As a condition of award, the successful bidder will be
required to submit payment and performance bonds and insurance.
N-4 BID SECURITY: each bid shall be accompanied by a certified or
cashier' s check or Bid Bond in the amount of 10 percent of the total
bid price, payable to the City of Palm Springs.
N-5 BIDS TO REMAIN OPEN: The Bidder shall guarantee the Total Bid
Price for a period of 60 calendar days from the date of bid opening.
N-6 CONTRACTOR'S LICENSE CLASSIFICATION: The Contractor shall
possess a valid Class A or C13 Contractor License at the time of
submitting bids.
N-7 CALIFORNIA WAGE RATE REQUIREMENTS: The Contractor -shall pay the
general prevailing rate of per diem wages as determined by the
Director of the Department of Industrial Relations of the State of
California for the locality where the work is to be performed. A copy
of said wage rates is on file at the office of the City Engineer.
The Contractor and any subcontractors shall pay not less than said
specified rates and shall post a copy of said wage rates at the
project site.

(b) Complete sets of said Contract Documents may be purchased at
$25 . 00 per set and are obtainable from the office of the City
Engineer, 3200 East Tahquitz Canyon Way, Palm Springs, CA 92262 . No
refund will be made of any charges for sets of Contract Documents .
(c) An additional fee of $15 . 00 will be charged for sets of
documents sent by mail.
N-10 ADDRESS AND MARKING OF BIDS: The envelope enclosing the Bid
shall be sealed and addressed to the City of Palm Springs, and shall
be delivered or mailed to the Procurement Manager at 3200 East
Tahquitz Canyon Way, Palm Springs, CA 92262 . The envelope shall be
plainly marked in the upper left hand corner with the name and
address of the Bidder and shall bear the words "Bid For. . " followed
by the title of the Project and the date and hour of opening Bids.
The certified or cashier' s check or Bid Bond shall be enclosed in the
