FOR APPRAISAL OF A 19.17 ACRE AGENCY-OWNED PARCEL AND A 22.21 ACRE CITY-OWNED PARCEL NEAR THE NORTHWEST CORNER OF SUNRISE WAYAND SAN RAFAEL ROAD (APN 669-500-001 AND 569-500-025) RECOMMENDATION: It is recommended that the Agency approve the Contractual Services Agreement with MacKenzie, Wagner&Associates, Inc. to perform an appraisal of two parcels near the comer of Sunrise Way and San Rafael Road in an amount not to exceed $5,500. BACKGROUND: The Community Redevelopment Agency has received an offer from Burnett Development to purchase an Agency-owned parcel of 1917. acres, as well as an adjacent City-owned parcel of 22.21 acres, northwest of the corner of Sunrise Way and San Rafael Road. The parcels were originally part of a 100-acre tract purchased by the City of Palm Springs for low-income housing. Since that time, several projects have been built on the land, including the adjacent mobile home park, Coyote Run apartments, and Sunrise Norte single family homes. The Agency purchased the land under the mobile home park, including the 1917. acre parcel (they are part of the same 40 acre parcel, since the previous owner had plans to expand the park), from the City in 1995 for$1,510,000. Since Burnett is not proposing to construct low-income housing on the land, they would need to pay "fair market' value, as the Low/Mod Housing Fund would not be able to write down their land cost. There is a separate proposal from a non-profit housing group to purchase and rehabilitate the mobile home park. That purchase is not affected by the Burnett offer, except that the lot line that now separates the 19.17 acre parcel from the 2221 acre parcel would have to be moved to separate the mobile home park from the 1917. acre parcel. A map is enclosed that shows the various properties. In order for the parcels to be sold for fair market value, the Agency must perform an appraisal to determine their value. Since there is a significant difference in the price Burnett has offered and the previous (1995) appraisal, MacKenzie Wagner was chosen because it was the firm that did the 1995 appraisal. It was asked by staff to address the reasons for any potential difference in the appraised price of the land. If an agreement with Burnett on price and terms for the land arises from the appraisal, staff will return to Council/Agency with the necessary actions and agreements to convey the parcels. By a separate action, the City would convey the 2221 parcel to the Agency for inclusion in the final Disposition and / Development Agreement as Agency-owned property and to effectuate the lot line adjustment. The net sale proceeds, however, will be shared by the City and the Agency based on the respective value of the two (2) parcels, after a proportionate share of the 1995 $1.5 million sale price is deducted for the mobile home park, which is not a part of this transaction. OF PALM DESERT, CALIFORNIA FOR AN APPRAISAL ON PARCELS 669-500-001 AND 669-500-025 WHEREAS the Community Redevelopment Agency owns a 19.17 acre parcel of land near the corner of Sunrise Way and San Rafael Road; and WHEREAS the Agency has received an offer from a developer to purchase the land, as well as the City-owned parcel adjacent to it on its northern boundary; and WHEREAS, if the use is to be for other than low- or moderate income housing, the Agency must sell the land for fair market value; and WHEREAS the Agency commissioned Mackenzie Wagner&Associates, Inc. to appraise the entire 40 acre parcel 669-500-001, of which the 19.17 acre parcel is a portion, when it purchased the land from the City of Palm Springs in 1995, and desires to use the same appraiser. NOW THEREFORE BE IT RESOLVED by the Community Redevelopment Agency of the City of Palm Springs, that the Contractual Services Agreement between the Agency and MacKenzie Wagner& Associates, Inc. in a form approved by the Agency Counsel, is hereby approved.
