HomeMy WebLinkAboutPC Resolution _6381- Case 10.477 DETRESOLUTION NO. 6381 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING MOTORSCOOTER, MOTORBIKE AND MOTORCYLE RENTAL AND SALES IS CONDITIONALLY PERMITTED IN THE C-1, C-2 AND HC ZONES AND THAT SERVICE AND REPAIR THEREOF BE CONDITIONALLY PERMITTED IN C-2 AND HC ZONES. WHEREAS, the City has requested a determination pursuant to Section 94.01.00 of the Zoning Ordinance that motorscooter, motorbike and motorcycle rental and sales be conditionally permitted in the C-1, C-2 and HC and that service and repair thereof be conditionally permitted in the C-2 and HC; and WHEREAS, on January 22, 2014, a public meeting on the application was held by the Planning Commission in accordance with applicable law; and WHEREAS, the Planning Commission has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including, but not limited to, the staff report, and all written and oral testimony presented. THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to the requirements of Section 94.01.01(B), the Planning Commission may grant the requested determination if it makes the following findings: 1.) That the use is in keep with the state intent and purpose of the zone. The C-1 commercial zoning district is intended for business districts, retail in character with hotels, service and cultural uses. The C-2 zone is intended for general commercial uses. The HC (Highway Commercial) zone is intended to provide for the retail and service uses of freeway travelers. The retail sale and rental of motorscooters, etc. is appropriate with a CUP in C-1, adding service and repair with CUP in C-2 and HC zones. 2.) That field investigations have disclosed that the subject use and its operation are compatible with the uses permitted in the zone wherein it is proposed to be located. Uses are proposed to be allowed with CUP only, making the opportunity to fully analyze specific sites. That the subject use is similar to one (1) or more uses permitted in the zone which it is proposed to be located. In C-1, auto sales & service is allowed with CUP; in C-2 auto repair including body work and sale and rental are allowed; in HC recreational vehicles and truck sales and service are allowed. 4.) That the subject use will not cause substantial injury to the values of the property in the zone within which it is proposed to be located. There are no know evidences or proofs to conclude that the proposed use is likely to cause substantial injury to value of property in the proposed zones. CUP's will be necessary in order to assess and impose any Necessary conditions to mitigate land use concerns. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission hereby approves Case 10.477 Determination. ADOPTED this 22nd day of January, 2014.
