HomeMy WebLinkAboutPC Resolution _6361- Case 10.476 DETRESOLUTION NO. 6361 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING AN ANIMAL GROOMER WITH NO MORE THAN TEN (10) PERCENT OF THE FLOOR AREA DEDICATED TO RETAIL SALES AS SIMILAR TO OTHER PERMITED USES IN THE PROFESSIONAL (P) ZONE. WHEREAS, Indohammond Ruthla ("Applicant") has filed an application with the City pursuant to Section 94.01.00 of the Zoning Ordinance for a determination that an animal groomer with no more than ten (10) percent of the floor area dedicated to retail sales is similar to other permitted uses in the Professional zone located at 1800 Via Negocio, Zone P, Section 1; and WHEREAS, on October 9, 2013, a public meeting on the application was held by the Planning Commission in accordance with applicable law; and WHEREAS, the Planning Commission has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including, but not limited to, the staff report, and all written and oral testimony presented. THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to the requirements of Section 94.01.01(B), the Planning Commission finds: 1) That the use is in keeping with the stated intent and purpose of the zone. Pursuant to Section 92.08.00 of the PSZC, "the 'P' zone is intended to provide for the development of a professional district with necessary related retail commercial uses and other compatible facilities." An animal groomer can be considered a professional having repeat clientele requiring a highly trusted and trained staff. Animal groomers offer personal services to customers which can be beneficial to a wide range of clientele and provided a benefit to the overall community. 2) That field investigations have disclosed that the subject use and its operation are compatible with the uses permitted in the zone wherein it is proposed to be located. An animal groomer use in the Professional zone is compatible with other permitted personal services such as an art supply store, florist shop, medical equipment supply store, and pharmacy. The building at 1800 Via Negocio is a professional office building divided into seven suites able to accommodate retail / Planning Commission Resolution No. 6361 Case 10.476 Determination October 9, 2013 Page 2 of 2 offices and other similar uses. Any accessory retail use shall remain incidental to the animal groomer business with retail sales area occupying no more than ten (10) percent of the floor area. 3) That the subject use is similar to one (1) or more uses permitted in the zone within which it is proposed to be located. Permitted uses including an art supply store, florist shop, medical equipment supply store, and pharmacy Pursuant to Section 92.0$.01(A)(5,6,10,15) of the PSZC, are similar permitted personal service uses to an animal groomer. 4) That the subject use will not cause substantial injury to the values of property in the zone within which it is proposed to be located. There are no known evidences or proofs to conclude that the proposed use is likely to cause substantial injury to values of property in the "P" zone. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission hereby approves Case No. 10.476 Determination. ADOPTED this 9th day of October, 2013.
